This case was just one of many he saw and just another face on the crowd nothing new to see here. This judge is one of many doing this every day.
Just a bit of context from the Middle district of Florida where Embry has been residing since 2019 (5 years or so). The middle district of Florida averages 18 cases per judge per year. So it'd be 1 of close to 90 cases. The case asked after would have been an earlier one as well. In my industry, I suspect I wouldn't remember even a customer let alone a case with them from 6 months ago let alone 5 years.
Give some human grace for questions that the judge hasn't had time to review. A caution which is a quality of a good judge, not wanting to make statements past their understanding of fact. Like or dislike them, memory isn't what he's paid for or being nominated for.

My father in law was from Mexico. He's broke the law incessantly till the day he died. He got deported a few times only to come back and do it again. These crimes were not light and yet in his final years, his dealings with law enforcement never got him deported once more. This is what the US is facing. Lawlessness and unaccountability.
