All i'm gonna say is that if sample clearance just involved asking joel "yo can i use this sample" a lot more people would do it. But unless you know the artists damn phone number, you have to do hours of research to even get to the contact information of who you need to talk to, it's never the artist directly, and unless you're already a rockstar, it's not even worth their lawyers' time to answer your email.
Partly why I’m so hesitant to chase after ambitious samples. It honestly kinda demotivates me in fear that all the hard work will amount to nothing and potentially even COST me money. I’d love more than anything to sample old video games or a small snippet of other artists but the amount of time and energy it would take to get a reply… the juice isn’t worth the squeeze. Sad because I think people are so caught up in copyrights and trademarks that they don’t understand how limiting they are making it to find an original thought.
I think he means if your track is sick enough to get some kind of attention and you make decent coin you probably have the connections to get a hold of him someway

This is the Porter Robinson call in question: czcams.com/video/5TDohA22STk/video.html What I got out of this is that deadmau5 made a quick joke about Languages sounding like The Veldt and Porter Robinson mistook that joke for a DMCA takedown and even (albeit indirectly) accused deadmau5 of committing plagiarism. My view is that even though the dates were in Porter's favour (languages was played live about a month and a half before deadmau5 started working on The Veldt) the songs themselves are incredibly different in pretty much every way. The only similarity I can hear is that they might've both used the same scale at one point which can happen purely by coincidence; hell, around 2013 I was putting together a song that I thought had a pretty nice melody until my mate pointed out that it sounded almost exactly like an Adele song I'd never even heard before. My point being that there's only so many scales and chords in existence so it's inevitable that at some point any music producer or composer will make a melody that sounds like someone else's.

I’m 37 on may and I had that game when I was 7 years old. He’s not the only person who lived in the 80s. Anyways, everybody sample everything, I think he used those samples In very clever ways.
Don't get me wrong I love Joel but in this instance I think he was overreacting a little yelling 'exposed' when clearly there was no malicious intent to expose anything in the video, just trivia.

I love sampling and enjoy finding out the original versions of the samples and seeing how the artist altered the sound and how far he went with it. It's what's so interesting about sampling, taking some music idea and altering it to your liking and style. Where would BoC or most of hip hop scene be without it?

ALL those people hang out together on a daily basis. Thats why he can use that vocal. Not to mention that the artists he used also has agreements
with the owner of the label Gladis Pizarro and Groovilicious records which are the same company run by the same owner.
Anyone from the old house days and everyone that got released on their labels are ALL friends with each other VERY VERY good friends...

You can NOT get sued for drums, as drums is not a melody. Even if you use a loop, its not copyrightable by the eyes of the Copyright office and the federal courts.
So long as there are no melodies within the drum sampled loop. And you can NOT get sued for a snare sound, as its drums that carry no melody.
Not correct - You can't get sued for a drum GROOVE, but you most definitely can get sued for a drum SAMPLE. That's what Joel is talking about here. If you use a master recording that is owned by someone else, you are stealing. Its about the recording of the drum groove, not the drum groove itself.

Drum samples last 1 second.
Even a drum pattern can NOT be copyrightable.
I believe you mean drum loop, and it has to be more than 30-seconds to be considered in court, and even then its a huge fight.
otherwise 99% of the music out there would be sued.
If you go to the copyright website, they even say drums are no longer allowed to be copy-written.
ONLY lyrics and Melodies can be copy-writable.

That's sampling and its technically illegal without clearance no matter how long or short the sample is. You can't steal a master recording. A drum pattern is not copyright-able, correct. If we play by your standards - the "woo" from cthulu sleeps should be legally allowed to be used because it meets all the criteria you laid out. Its less than a second, it is not a melody, (a melody is multiple notes in a specific order), essentially it is a transient only. However, you cant find cthulu sleeps on streaming. Why? Because Joel used someone elses master recording and when they found out - they made him remove it. It's that simple. You can not use a master recording of someone else's work. If you think you can - then you have spent the past 5 decades of your career in the music industry looking like a real fucking idiot. Look up the law regarding master recordings.
There is a whole market built on companies creating and selling drums samples. If you couldn't copyright a master recording in order to sell it - that business wouldn't exist. It is clear you have no clue what you're talking about, Dunning-Kruger in full effect here.

He did technically sample Axwell. He owns a sample pack called Vengeance Essential House Vol. 1 which contains a loop called "VEH1 House Beat 07" that is literally the Feel the Vibe drums with the synth plucks filtered out.

02:50 "It's not a sample" Technically you program it, and it plays back audio. I mean that's all rom based keyboards do as well. Korg Triton or Roland XV 5080 as examples.. You program them (or play them with a keyboard) and they playback a pre recorded sound. It's just that in this instance, that wasn't really the intention of the product when they launched it, but the TB -303 was never designed to be used for making bass lines for house music either.
