In my friend case, if I do the calculation the compensation amount will be 35,00,000. Do insurance company will pay huge amount to insured person.?
Vehicle insurance is different from an individual human body insurance. If any person sustained injury or died in a road accident, in that case if offending vehicle is insured than whatever compensation amount is determined by the court, the same is given to the injured person or the dependent’s of the deceased. So if your friend sustained injuries in a road accident then he is entitled to get the entire compensation, irrespective of the amount, from the insurance company of the offending vehicle.

Yes you can. But you are allowed to receive one claim only. So far as amount is concerned it will depend upon Income, age, and nature of injury.

Sir in case if the deceased or the injured person is a student aged 20 years or unemployed, what will be the procedure for calculating the compensation?
Generally Student is treated as skilled labour subject to the education. In each state minimum wages is fixed for the labours dividing them into different categories such as Unskilled, Semiskilled, Skilled etc. And for each category monthly wages is fixed for example in Rajasthan the monthly wages for Skilled labour is 6474/₹ per month. So do the calculation accordingly.

In July 2022 High Court in modification of the award dated XX.XX.2011 in OP (MV) XX/2004 on the file of Motor Accident Claim Tribunal granted 5lakhs with interest 9% from the date of petition till date of deposit. During the pendancy of the above appeal 1st appellant had expire in 2019. The son and sole legal heir is already in the appeal as 2nd appelant.
1) Is the judgement still valid due to the inclusion of a deceased person?
2) Will Tax Deducted at Source be applied to the awarded amount and the interest?
3) Is the 9% interest compounded or simple interest?
4) If the judgement is not valid, what is the next course of action?
5) How long is this expected to take for me to get the awarded amount?

नमस्कार सर मेरा नाम अजय है और मैं यह जानकारी लेना चाहता हूं सर जैसे कि मैं शुरू का जो लोग जनता उस लोग दोनों में किसी के गाड़ी गाड़ी पर आनी मेरे को वह लेकर गए ₹800 झाड़ी के हिसाब से और वह मेरे को बोले थे सुबह 5:00 निकलेंगे बिहार जाना 15 दिन के लिए तो सर वह सुबह 5:00 बजे की जगह जिस टाइम में पहुंचा हूं रात को ईमेल के बिहार के लिए लेकर चले गए और उन्नाव उन्नाव से कम से 50 किलोमीटर पहले मेरे को नींद आने लगी लोगों को बोला कि मेरे को नींद आ रही है मगर उन्होंने मेरी एक भी बात नहीं मानी मैंने गाड़ी रास्ते में रॉकी हर 15 किलोमीटर की दूरी पर 10 किलोमीटर की दूरी पर बार बार मुंह जलवा तेरा बार-बार बोल तेरे चलो आगे रखेंगे आगे रखेंगे और मेरे से बोल रहे हैं लखनऊ में रुकेंगे होटल पर वहां तुम चाय वाय पी ना ना ना और नींद आने के कारण 14 10 गाड़ी रोकने के कारण फिर मैंने 5 मी द है मेरे को इतनी तेज नींद आ गई मेरे को खुद को नहीं पता मेरे को नींद कब आई और हल्का हल्का उस टाइम कोरा भीतर का टाइम और गाड़ी डिवाइडर से टकरा गई टकराने के बाद में पलट गई 24 पलटी मारने के बाद में फिर से लौटती नीचे गिर गई उसमें उस दौरान दोनों की मौत हो गई है और एक बंदा फिर अस्पताल में 20 से 25 दिन के बाद में अस्पताल में उसकीघर पर बात हो जाती है और मेरे को गाड़ी मालिक और जो दिलों की जो लोग मेरे को लिखेंगे तो उनके घरवाले मेरे को उन्नाव थाने में मेरे को बोल रहे आने के लिए लेकर गए साथ में गाड़ी छुड़ानी है और कोई बात नहीं है अब गाड़ी कहां पहुंचे हम लोग तो उन्होंने मेरे को वहां पहुंचने के बाद उन्होंने मेरे ऊपर ही केस बनवा दिया और मेरे से बोल रहे थे जो तुम्हारे हाथ में चोट लगी है उसका पैसा हम तुमको दे देंगे और कैसा मिस लिए बनवा रहे हैं कि लैंप लेने के चक्कर में सरकार इंश्योरेंस कंपनी से और जो हमारा खर्चा हुआ वह भी हम इंसुरेंस कंपनी से निकलवाना चाहते हैं और आप का भी खर्चा आपको मिल जाएगा जब तू मेरे को प्यार से बोलते थे और मेरा आने जाने का किराया भी देते थे मेरे साथ जाते भी थे मगर अब ना तो वह आना या ना तो आते हैं साथ ना जाते हैं और दूसरी बात सर वह टिकट के लिए बोलता हूं जैसे मेरे को वहां जाना पड़ता पड़ता है कभी दूर जाना पड़ता है वकील कर रखे उन्होंने अपनी एक वकील मेरी साइड से मगर वह मेरी नहीं सुनता है वह उन्हीं की तरफ से जैसे वह बोलते हो ऐसे ही एक-दो बंदे हम बच्चे थे एक आगे जो मैं था और एक बंदर था वह भी उन्हीं के रिलेशन में उन्हीं के यहां काम करता है और उन्हीं के कहने पर वह बयान बाजी वगैरह लाडला मूवी वकीलों ने के गाने वाला है और उनकी तरफ से लड़ रहा मूवी लेकर जाने वाला उन्हीं के कहने पर चल रहा है सर हेल्प चाहिए मेरे को कैसे लिखा जाए और मैं यह चाहता हूंटूटा मेरा हाथ में दो प्लेट पड़ी है मैं ड्राइवर बोलना सर यह मेरे को फसा रहे हैं और मेरे को फालतू में झूठा झूठा बोल कर मेरे ऊपर केस करा दिया था जिन्होंने मैं यह मुसीबत से निकलना चाहता हूं और मेरे को मेरा कि नहीं मिलना चाहिए सर मेरा हाथ टूटा मेरे भी बच्चे में किराए के मकान में रहता हूं मजबूर मजदूर आदमी हूं सर आपसे हाथ जोड़कर रिक्वेस्ट है यह मेरी बात आगे तक पहुंचा यह सर सरकार पर आपसे हाथ जोड़कर विनती है मेरे को इस मुसीबत से निकाली और मेरे भी छोटे-छोटे दो बच्चे किराए का मकान है मेरा नाम आ जाए मेरा मोबाइल नंबर उधर कोर्ट में जाता हूं ना तो वहां पर जस्सा में से कुछ पूछते ना द्वारका कोर्ट में जज साहब द्वारका कोर्ट वाले जैसा भी कुछ नहीं पूछते ना उन्नाव वाले कुछ पूछते सर सब उन्हीं के जो वजह से वह करा रहे हैं तो कर रहे हैं शर्म से हाथ जोड़कर विनती है मेरा मोबाइल नंबर 9971732580
