Stalked Inkubass shall forever remain as one of my favorite Vinny streams of all time.
While awkward and not something I'd recommend doing with your game, at the same time I don't consider pulling images from Windows' common Pictures directory to be a "borderline malware" thing for a game to do.
Games are computer programs like anything else on your system, and plenty of normal programs can access folders like that both for viewing images from them and placing images into them. It is mostly just taboo to do stuff like that with games because people tend to prefer a game was very self contained (especially online games due to then also having an internet connection running through the program...)

Well, I've got some pictures to delete if I ever want to stream this game.
this game really isn't that scary. what's really scary is it breaking the law of invasion of personal privacy to pull your personal pictures off of the hard drive. I'd actually consider it malware.
I'm actually wondering, why are people freaking out. There exist other games that were doing the same and nobody considered them "Malware". For example - the Psycho Mantis fight in Metal Gear Solid, where the game reads your other save files. It's not uploading them, it's just reading them to scare you.
Edit: Eternal Darkness, if I remember correctly, is another example. The game opens at one point your memory card on the screen and pretends to delete everything.

The metal gear and eternal darkness examples are way different the what this game did, those are self contained games that break the 4th wall
What are you talking about?
If you think that's bad you should probably just step away from your computer and stop carrying a smartphone, because though the execution is unusual - what it was doing was pretty mundane and about as benign as it gets.
All it (probably) did was what Vinny said; Check his Pictures folder for pictures (because there will probably be pictures there, that's what it's for) probably hoping that you store actual photos in there and not just memes so it can give you a spook when you see a picture of your cat lying on the stretched-texture floor next to the explosive barrel.
It isn't pulling anything _off_ of anywhere because it's a game that's already on your hard drive, with those pictures, and all it's doing is showing your own pictures to you. The picture isn't going anywhere, it's still on your computer when it's being shown to you.
Where is the invasion? Is it making you invade your own privacy?
Being able to read files off of your hard drive is mandatory for basically any program to function, but any of them that are actually pulling _personal_ files _off_ of your computer and sending them somewhere probably aren't going to show you that they're doing it unless that's something you want them to do. So I'd be pretty surprised if this game was doing anything like that, that'd be pretty bold.
When you open up a folder on your PC that contains images, your operating system is basically doing the same thing this game did when it loads up thumbnails to show you the pictures in it. Your OS is software too, just like the game, and it's reading data off of your hard drive. The only difference is that you aren't _expecting_ the game to do it when it does.
The reason why I'm saying this though is that though you seem to be concerned with your privacy, I'm _not sure_ you know what you're talking about going by the way you talk about it.
I'd warn you to educate yourself a bit on the subject to make sure you're worrying about the right things and understand how to actually try to maintain your privacy without going luddite.

tbh when a game does something that obviously then it is probably not going to do anything nefarious in secret necessitating stuff like scanning (moreso than with other games)

Free range eggs is the correct translation, but the joke kinda gets lost.
Bodenhaltung is a combination of two words. Boden und Haltung. Haltung meaning something like Animal Husbandry/Keeping in this case, and Boden meaning ground (The chickens aren't kept in cages and range freely on the ground).
So, a man without legs has eggs from 'Husbandry/Keeping on the ground'.
