Electoral Court to rule on whether Zuma can be face of MK Party

  • The Electoral Court is today expected to hand down an order on whether Former president Jacob Zuma can be the face of the uMkhonto weSizwe Party come the 29 May general elections. The party took the Electoral Commission of South Africa to court, after it barred Zuma from participating in the elections over his July 2021 contempt of court prison sentence.
    Legal expert Modidima Mannya and former IEC deputy chairperson, Terry Tselane unpack this from both the legal and IEC perspective.

      What's happening to Mpofu is a great example that you can never satisfy everybody. Just last week Mpofu won against the IEC on the trademark case and people were saying he was brilliant. Now people are saying he is a terrible lawyer. I can assure you that he wins most of his cases, many which don't involve political figures. But people who are narrow visionsed will take 4 or 5 cases that are in the media spotlight that he loses and they will say he is a terrible lawyer while ignoring the 20 cases dealing with ordinary men and women in the street that he wins. So, my advice is that you must develop a thick skin because you will never please everyone. You can win 50 cases and lose 5 but people will always complain about the 5😂..let us not be narrow minded

    Justice is not justice if it favors the ones with big pockets. The average man would have spent the full fifteen months in prison, and he would certainly be denied even employment, even if that means he would have to resort to even worst than just contempt of court. But am happy that Zuma has won, this will certainly keep the peace in KZN and parts of Gauteng

    FOR ME, AS MODIDIMA SAYS, EVEN WITHOUT THE NEED TO READ THE PART OF THE LAW, IT IS CLEAR THAT MOST OF RIGHTS AND OBLIGATION IN THE CONSTITUITION OR SPECIFIC LAWS, ARE TO BE IMPLEMENTED BY ANY PART THAT DEALS WIT A PARTICULAR MATTER. THUS, IF THE LAW SETS A SPECIFIC REQUIREMENT OR PROHIBITS SOMETHING, THIS HAS TO BE VERIFIED UPON WITHOUT NEED TO GO TO A COURT.

    I agree with Terry on one aspect of Section 47. Anyone who is appointed by, or is in service of the state and receives remuneration for that is not eligible (47(1)(a)). But my question is who takes that decision on eligibility because the right to elect rests with the voter, and such should be left to the voter, within the limitations set by the constitution, and not second-guessed by the National Assembly. So, it follows that some structure should take that decision on eligibility based on whether the person is in compliance with the constitutional prescripts in the first place before it gets to the voters. I think that body is the IEC -- unless another structure has been designated to do so by law. I still think that eligibility must be adjudged by the IEC. The Constitutional Court must give a ruling on this so that Parliament can develop legislation to give effect to Section 47, in the same way it has provided PAJA, for example, to give effect to the Bill of Rights in the Constitution.

      The argument Of MK was, The IEC job is to lookout after elections to make sure they are free and fair and to deliver results "NOT" to select and decide on who should or not be a party leader and who must be a member of paliment, they say that is the job of the national assembly on the first day of paliment sitting.

      Who would employ you with a criminal record - no matter how qualified you are - when you commit a crime you DISQUALIFY YOURSELF - from taking any position involving people, money, or any personal documentation that involves the privacy of any person whose information can be used in the commission of a crime. Once a judgement has been recorded against you it’s for life, no passport, no overseas travel, no nothing. Go learn a trade.

    Teri objections are a jurisdictional factor to whether section 47 should be applied or not. Once objections are raised IEC is obliged to look at them and decide. Teri has just revealed how ignorant and incompetent individuals like him have run IEC for three decades.
