Court didnt make law, Supreme Court only interpreted the law in this case of mining taxation. In case of clash of sections of different acts, SC has the right to interpret those laws - for eg, SC had said in one of its verdicts that GST council(which is a constitutional and federal body) orders are only recommendatory and Union and states are not compulsarily bound to follow those orders.

I think rather than uneven development, we should accept the fact that most of the mineral rich states are underdeveloped especially the mining rich regions there are too backward and the resource benefits doesn't contribute in their development, So, I think this will atleast give them revenue to develop such backward regions and make policies for it with negligible dependency for finance.
SC will not except PIL on minority status of Hindus State-wise population. But, it will give States power to levy tax on Minerals. Illogical decision....

The way Industrialised states with corporate offices use corporate taxes and they developed their industry using freight corridor uniform rates by center to buy raw materials leaving mineral rich states poor by driving industry closer to ports, the resources rich states should have same right. You can see it clearly in income parity. Just like nations with minerals have right to decide price based on their conditions, a state has too... They have to manage their population. Otherwise they are labelled as getting handouts.
It is good because the people of the state are also harmed so the responsibility of that effect must be fulfilled by that company.

If central government can differentiate between states, when they give relief package to states and other central subsidies.Then why can't states have this right.

I think this is right decision of supreme court , ek bar aaapko un rajyo ke bare me bhi sochna chahiye jaha se minerals to nikal liye jate hai par uska benefit rich state ko milta hai jaha unka procress hota hai , isse vo rajya ki janta na keval prabhavit hoti hai, balki pradushan me jiti hai, bhrastachar bhukhmari or lack of education vahah jyada hota hai, unko thik se muavja bi nhi milta or majdoor ban ke rah jate hai,......... ek bar is baare me vichar kare
SC should also give the verdict that all states can charge upto a maximum limit in % for royalties (different for each mineral) and not more than that this will result in uniformity of taxes all over India

रॉयल्टी तो राज्य सरकार ही ले रही थी किन्तु केन्द्र ने सिर्फ सीमा तय कर दी थी। निःसंदेह राज्य सरकारों को लाभ होगा किन्तु इससे कंपनियों के लिए खदान लगाना महँगा हो जाएगा और संभव है कि कंपनियां ऐसे राज्यों में निवेश नहीं करना चाहेंगी जहाँ रॉयल्टी अधिक होगी। तब न चाहते हुए भी कुछ कंपनियाँ विदेशों से सस्ते खनिज आयात करने को बाध्य होगी। यह देश की अर्थव्यवस्था के लिए अच्छी स्थिति नहीं होगी।
