Hello. If a case is mutually dismissed, can I still sue for false arrest ?
My stepdad had a domestic charge against him in state of Florida in 1983(39 years ago) with his ex wife. I live in CANADA and I’m filing for my mom to live with me but she is married to him so he automatically tags along. We did a fbi background check and it shows his arrest and it shows that his case was dropped from a felony to a misdemeanor and then it said it Disposition Dismissed( Not Applicable) how do I get that expunged if he lives in the Caribbean if his charge was in the us? Also do you think this will stop him from getting a PR to come to CANADA?

pay a lawyer in the jurisdiction like $500 or so to get them expunged as well as arrests. With prejudice of course.

I had just gotten my permit after having to wait 3 years and get a sr22 . Got a traffic infraction just a few months before the 3 years was up . The Judge dismissed all but 42-2-140 Driver's License -permit Unauth Person/Dr .no points taken . But now the DMV sent me a letter after I just had my permit for 3 days saying revocation. For involved in a traffic accident that occurred while you were suspended for failure to provide proof of liability SR22. And records indicate that you were convicted of traffic offense occurred while you were under restraint. But the judge dismiss those so do I have to go to a hearing for the DMV. Also I was not involved in a car accident at all.

I been sued by car insurance, i file for bankruptcy. The car insurance dismissed the lawsuit. But i do have a reschedule court date, the part i don't understand is "the plaintiff had leave to reinstate in the event that defendant bankruptcy is dismissed without discharge".🤔🤔

For a crime to proceed in court they must be a proof of date and time and where the crime happen . If they can’t provide date and time the case will be dismissed ? Yes or no
What If someone was charged by the Deputy D.A. but wasn't arrested, tried, or convicted?
My fraudulent charge was transferred to a Veteran's Court. The judge assined me to a PRSD Divergent Program for a year. I graduated this month and the Judge gratefully dropped the charge.
Will this charge still show on a Background check?
In Texas, it would still probably be a public record unless you clean up your record.

Great video and very educative , question Before a crime could go to trail.. they must be an actual date , time and location of the crime documented if no actual date or time will the case be dismissed ?
They can always say on or around a date. There are lots of cases where they don’t know exactly when an alleged crime happened.

I have a question . I got caught with concentrated marijuana on me did a pre trial diversion program in Florida and my case ended up getting dismissed (no info filed). I was wondering if I could buy a fire arm? Or would I fail the back ground check?
I’m not sure of the laws in Florida but I would be surprised if a case that was dismissed prevented you from buying a firearm.

I’m not sure. I only handle criminal cases in Texas. You may want to contact a landlord tenant attorney in your area.

I’m sorry that you went through that. I don’t know any good attorneys in that area in Pennsylvania. I would look on Google and talk to a few attorneys and go with the one that you trust.

It sounds like your case was dismissed outside of trial. If that’s the case there are a lot of reasons your case could have been dismissed even if was you fault. It doesn’t necessarily mean you weren’t at fault, but it’s good.

In most cases they can charge and arrest you again on a case was dismissed as long as the statute of limitations hasn’t passed. Depending on the timeline you may have an argument that they violated your right to a speedy trial.

It depends on the employer. It’s still going to show up on your background check. It should show up as dismissed, but in Texas the employer can use that against you. You need to get your record cleaned so that it won’t show up on background checks.
I was talking to jail for child abuse was in there two days and the third day I was sapoesd to have a video court and they did not call me for it later that night I was released with no pending court and no charges

Municipal Court cases don’t show up as much. I still recommend getting an expunction if you can.
Defendant had no knowledge they were being sued on a case that was filed, and the plaintiffs won. The judge granted them to take the domains and posted the lawsuit on it. Defendant appealed. The case was dismissed without prejudice does that entitle the plaintiffs to keep the domains and defamation posted on the domains

Background checks are looking at public records related to you. Any charge is usually a public record and so it could come up. It's going to depend most on what they're looking for. I'm not sure what state you're in, but here a low level theft is the same level as a speeding ticket and wouldn't show up on most background checks.

@@anythingrandom2247 If your case was dismissed, there's no problem with you leaving the country. It's up to other country's laws on whether to admit you. In most cases if your case was dismissed though, you shouldn't have a problem.

Why even have a trial if a not guilty finding or a dismissal has the same collateral consequences as going to prison? I had a conviction that was overturned but I am still a convicted felon with all the collateral consequences. Basically I am considered a felon but just can't be incarcerated because it was overturned.

Yes you do, make sure you have a valid passport and valid green card. As far as you are allowed to travel, you’re good. Make sure you don’t have pending charges or awaiting trial… or court few.
If you don’t have any of that, you are good to go every where.

Nice 👍 my nephew pulled a gun on me and I grabbed the barrel then he fired twice under my arm pit I leaned forward holding the barrel and his foldarm falling to the ground I tell him I am calling his dad and his dad said it was probably my fault so I called the law and I was arrested because he said I hit him on the back of his head with a hammer and I didn't know that and officer asked if I own a hammer and I said yes!!! I'm a felon but been doing great for years now like 10 years and I have to go to court because state picked up his lie to use against me ! It is possible to be considered a convicted murderer even if the remains are thousands of years older than the person. My grandparents knew a man and his wife who found pieces of a skeleton while plowing. They were charged with murder then it was dropped because the bones were 11,000 years old. A background check would show they killed someone in 9000 BC which is not possible. The record should be completely destroyed and not just expunged.
If the charges were dropped, then they were never convicted. The process for getting an expunction varies by state, so it will depend on which state they were charged in.

Now, I’ve been wondering, how can I get my brother evicted from my house. It’s my property, I live with my mom and my little brother(who ain’t so little; he’s 22 years old) for years he’s been verbally and physically abusive....Punches holes in the wall and throws stuff around while screaming every slur under the sun....Any little thing could set him off...Someone being too loud, him losing his phone or etc. He Verbally abuses our mother, and in the past 4 months alone has physically assaulted me several times, I have pictures and videos of him hitting me. My mom has said she doesn’t feel safe with him in this house anymore and I don’t either....I don’t wanna call the cops on him , but if it happens again, I would like to get him evicted...Think I have a case? And how would I get that ball rolling?

Take pictures of all the damage set rules up you have to put your foot down
Call the cops….have him arrested for domestic violence…get a temporary restraining order, then get a permanent restraining order at first court date. He can not come back to your house if you get the restraining order. Then No need to evict.
