  • Attorneys for accused University of Idaho killer Bryan Kohberger have filed documents saying their client was out driving in the early morning hours when four students were killed. And they’ll use a cellphone expert to make their case. Jacksonville State University forensic expert Joseph Scott Morgan and NewsNation contributor Jesse Weber discuss how the defense’s argument will work, considering that the prosecution not only has cellphone data but also surveillance photos of Kohberger’s car near the murder scene.

But I'm really hoping the state has more strong evidence. Such as fibers ect. Something solid like the dna on the stealth. As long as they have a couple things solid like that, i think it's a good case against him

    I’m confused as to why you think immediately that “you,driving around with no one to corroborate your claims is the smoking gun as to why the police and prosecutors have their guy????? WHO CARES WETHER HE WAS STAR GAZING OR NOT…TOTALLY IRRELEVANT!!!!!       Serious question: Can you explain to me how you drive around stargazing in a residential neighborhood in the middle of the night? When I drive in the night or day I have to watch the streets, roadsigns, traffic lights, other vehicles, pedestrians, etc, so how does Brian gaze at stars?

    Do the photographs have tine-stamped geotags? If so, is there a way to schedule photos to be taken into the future? Just because BK's phone never crossed state lines doesn't mean the phone was with him.

    The location of the phone is NOT necessarily the location of the perpetrator. It doesn't show his location. Just the phone .

    WRONG ..what the videos show is a White Elantra , NOT a single video shows his tag.
    Also cellphone data has a range , it has a 15-30 miles radius.
    Now if he is taking pictures of the area and a previous history of being in that area , there ia a problem
    The police said they were looking for a 2011-2013 and said the area had 32,000 of them registered in the area .
    His car was a 2015. So the number in the area is much larger if you include 2011-2015.

      You’re getting a bit ahead of the game here. The ‘expert’ is going to provide testimony, not proof, and it’ll be weighed by a jury against testimony to the contrary to determine which is more believable. In my opinion no matter where he was it’s not believable that a person could drive around stargazing in a residential neighborhood. When you’re driving you don’t have time or even opportunity to gaze at the sky. The suggestion is ludicrous.

In any case the detail many people are missing is that the location of a cellphone is not necessarily the location of the person, making this ‘alibi’ extremely weak, especially if the cellphone is determined to be stationary. Let’s see what comes out in the courtroom.

      @@rayray8687 oh my mistake, thanks for the correction. You’re right about the phone’s location vs the user. It’s not that I completely believe Bryan is innocent, personally. I have issues with who did the investigation and how, and that two of the investigating officers two years prior had tried to pin a murder on a man who then turned around and sued the city and won for defamation. There are other issues on top of that. I just want the right person on trial.
