  • The High Court in Pretoria is expected to rule today on the admissibility of a recorded confession by one of the accused in the Senzo Meyiwa murder trial.
    The judge is conducting a trial-within-a-trial to determine whether the confessions made by two of the five accused are admissible.

    From Reading the judgment, the Judge seemed lost and confused…like he is not the one who wrote the notes. When he went for the book I was confused bcoz he was about to list the reasons.

    I don't know about SA But in my country confessions are initialled in every paragraph and every page is fully signed. A declaration by the attorney is also signed and attached to the confession. You can't just say there was legal representation without proof. Attorney's declaration must be signed and attached with the confession

      Accused 1n 2 have confessions contents to be heard of.
      Accused 3's phone is said to have a conversation between him and one of the people who was in the house.

      100%! In fact, on camera, the presiding officer would also be able pick up the deponent’s body language, and all injuries can be recorded so that there is no argument as to the condition of the deponent.

      In the US they have had that practice for years. I am not certain why this has not been implemented in this day and age in SA. It would resolve a lot of conflict, especially during interrogation of suspects and witnesses.

    I must admit, I also thought that a confession to a commissioned officer was admissible. I didn’t know that the law did not place any weight on the rank, but that a confession to a peace officer (of any rank) can only be admissible if reduced to writing in the presence of a magistrate or justice. Interesting

    Anything done unconstitutionally is illegal, unlawful, null and void. Section 5 of Section 35 of the Constitution was flagrantly violated. They should have known better! Furthermore, can someone sign authentically, while handcuffed? Fair is foul. The Honourable Judge was correct.

      The said lawyer produced his Fidelity certificate and the appointment card as a proof the Violent Cronje that he's really a lawyer but her only mistake was that she failed to get them made copies for those copies to be attached to be attached to the statement like those of the three police officers.

      I agree with you. They are taking us for fools these ones! They are crooked and dirty. Have no regard for life. They can even pin a crime on innocent young people to protect the wealthy and influential. I wonder how they sleep at night knowing very well that the murderer is walking the streets. May they never have peace. It's dusgusting because this can happen to anyone who is financially vulnerable.
