  • In this episode of 'Editorial,' Mr. Sujit Nair discussed a noteworthy statement made by Justice Chitta Ranjan Dash, who retired as a judge of the Calcutta High Court. Justice Dash, who concluded his tenure on Monday, openly acknowledged his long-standing association with the Rashtriya Swayamsevak Sangha (RSS).
    Speaking at his farewell in the presence of fellow judges and members of the bar, Justice Dash expressed his willingness to return to the RSS if they sought his assistance. ""To the distaste of some persons, I must admit here that I was and I am a member of the RSS,"" he stated.
    Reflecting on his 14-year judicial career, which included a transfer from the Orissa High Court to the Calcutta High Court, Justice Dash credited the RSS for instilling in him values of courage, integrity, and patriotism. He noted, ""I owe a lot to the organisation... I am there from my childhood and throughout my youth.""
    Justice Dash explained that he had distanced himself from the RSS for about 37 years due to his judicial responsibilities. However, he emphasized that he never leveraged his RSS membership to advance his career, as it goes against the organization's principles. ""I have never used my membership of the organisation for any advancement of my career because it is against its principles,"" he remarked.
    He concluded by affirming his impartiality throughout his judicial career, treating everyone equally regardless of their socio-economic or political affiliations, whether they were wealthy individuals, Communists, BJP, Congress, or Trinamool Congress members.

    The Supreme Court immediately review all his Judgements in his long carieer to know about whether all judgements have impariality. Value of judicial imparility of him should be assessed by SC urgently.

      He should be asked two incidents his judgement
      1. RSS never raised Indian tricolour in their main office at Nagpur 52 long years disrespecting Indian true freedom - why?
      2. What his view on Nathuram Godse who killed Mahatma bapuji and got praised by Pragya Thakur a MP from Madhya Pradesh believed to be involved in malegaon bomb blast case.

India's most valued dictum "Sathemye Jayade" is throw away by this Judge and his sponsor political party.

    Interesting editorial
    If the EX-HC judge was really upright, honest and a man of principles, he should have disclosed his membership of RSS and that he follows its ideology, at the time when he was taking his oath as a High Court Judge. His insincere behaviour has cast a dark shadow on the impartiality of the judiciary.
    God knows how many persons are presently judges of higher judiciary and are dispensing justice with biases

    Sujit, thank you for your simple clear exposure of where we stand , when we seek Justice from our Courts. There seem to be no background checks prior to Appointment of Judges. Where does a Citizen go to seek Justice. Frightening.
    PLMA, UAPA, and all draconian Laws need a review: they have no place in a Democracy.
    We look forward to the North Star, the CJI, to point the Way.

      I am sure that you have no objections when the collegium of judges whole-heartedly selects and permits people like Chitta Ranjan Dash and Victoria Gowri to be judges.

    Definitely, it is highly disturbing. Questioning those in power, engaging with them until wrongs are "righted" is the only way forward. For that we have to feel the pain of one another to be able to reach out spontaneously. Thank you so much for this editorial. I hope many more will watch it. I'll certainily do my bit.

    Judges are like a fathers figure. The judges instills Sense of security, hope and confidence to the people. They're the sole custodian of the constitution. They're delegated with an extraordinary powers to protect the constitution and the task to see to it that justice, equality, security and liberty be brought in the country. Now if a judge don't know this values then he is deem unfit and unworthy. A judge shouldn't even think about being biased at all.

    strict vetting on judges who are to be elevated to higher judiciary is a must. We are a secular country, one can have a soft spot for certain ideologies that cannot be stopped. But being a member of a religious organization while being a judge is a no-no whether you belong to any faith.

    Armed Forces and Civil Servants and Magistrates cannot be members of any Organizations or parties. Why is it not applicable to judiciary.

    The fact that the judge revealed the truth only after retirement shows that even he knew his position was not right. He should not be the one to give himself character certificate, rather he should have revealed his background openly and allowed the people who appeared before his bench to decide.     What values, ethics and discipline are we talking about post 2014. All institutions have been compromised , absolutely brazenly and most damage to common man is the state of judiciary. Even for a peons job a background check is done, how come a judge is appointed without understanding his political leanings!

    Hi sir, please make an editorial on the EC not revealing numbers of voters, rather only percentages, which is dangerous as they are changing. Assuming a voter count of 90 crores, a 6% manipulation, if introduced by the EC, can translate into 540 lakh votes. Dividing this number by the 545 seats, it could mean roughly 1 lakh votes difference per constituency, which is sufficient to decide the winner.

    To my knowledge, there was an unwritten rule since independence that no one affiliated to the RSS could be an employee of any central, state, PSU or government organisations. This includes the judiciary. This stricture was removed in 2015. He has breached employment rules and disciplinary action needs to be taken.

    Justice V R Krishna Iyer was a member of the the first communist government in Kerala. Subsequently he went back to practice in the SC. He was elevated to the Supreme Court later.

    Sir, There are declarations to be provided in applications to any Govt job. Memberships of any religious, social, political organizations have to be mentioned and membership of the RSS or the Communists would disqualify the application. So, in this case the man would have lost his job at the very outset. Only now some awareness of the constitution and the morality that is entailed is being discussed. When a man admits to his loyalty to an organization superior to the constitution , his fairness in judgments is doubted. Ultimately it is the integrity, honesty and probity of the individual that matters. We as a people have failed to inculcate these values and sought compromise.

    Sir you just answered your question the judge is looking for a well paid job post retirement, where would he get a good well paid position, so the judge just marketed himself by saying he is part of RSS to get a job as simple as that.

      Not so simple dude, at least he has the guts to tell the truth, whereas elsewhere in the Abrahamic majority countries where the majority of judges are either Christians or Muslims and their allegions are already known without any fuss then why should India be different in the world and create a storm in a glass of water. Indian Judges must deliver their judgements according to Sanatan Dharma principles in India similar to Abrahamic judiciaries despite the 75 million Christians and 200 million Muslims of India. The majority rules everywhere!

    Verification systems before and after making him as judge also need to be questioned, before claiming infiltrators or morality of systems. Because whether people and agencies don't know about links of these officials.

    Sorry to say that but every person should judge another person by putting himself in the other person's shoes but are they doing it. I fully understand that every case should be judged by the merit of the case. The decisions should be reviewed taken by this judge, just to be fair because the fact is staring all of us in the face.. thanks Sujit for this editorial. My view is the system should be overhauled by the CJI., because we trust the CJI.
