    There is so much that can go wrong with filling out paperwork. It may sound like it'd be easy to do but it's not and judge's DO NOT have any sympathy whatsoever for the unrepresented. Self help is not helpful. I've tried it in the past. This information is helpful. I'd love for you to show an example (names crossed off, just for others to see if they're on the right track.

      Your experience might have been that judges have no sympathy for unrepresented litigants. If you speak to enough landlords, you will eventually find that some of them have had the opposite experience.
      If you can afford a lawyer, you should ALWAYS use a lawyer. If you cannot afford one, there might be county resources that will put you in touch with a limited scope pro bono attorney.

    My problem isn't technically a tenant, it's my son. My son is a combative alcoholic. He was only given a roof over his head to get a job and get detoxed. now I cant get him to leave. It is so bad he has even called 911 because of alcohol poisoning and he's been detained and attested for drunk in public. He has even endangered my dog by leaving the doors open and my dog walking outside. Thank God he didn't hurt anyone and after 30 minutes alone walked back inside. (The whole thing was caught on my Ring video.) Huntington Beach PD told me to have him evicted which I have tried to do at the Santa Ana court but the forms are so complicated I failed to get it filled out properly and told me to come back, which I can't do for at least a week, I work. He needs to be institutionalized 51/50 which he has even asked to do! I know there is housing out there for someone like him. He has no key and literally climbs the backyard fence to sneak into my back patio and he passes out either on the couch or the dog bed. Why must I evict my own son when he was never supposed to be living in my home in the first place? In my opinion, eviction implies that there was a formal rental or lease agreement, there was not. Do the dishes, clean the house, take out the trash and help pay for the utilities, understand? Please help me!

      It's a terrible situation. Not that it assuages your anxiety but it is a fairly common eventuality for people who try to do the right thing for someone in need. Keep in mind that he has very little reason to leave without being forced.

      @@NickC9545 He was served a retraining order. There was no other way. Now he must get that help he needs.

    Thank you so much for this informative video. Everything I read to help me in this process as a first-time landlord is so confusing. Do you have a video detailing how to fill out each of the unlawful detainer forms you noted in your video? I am at step 4 (filing the unlawful detainer), and there are many fields in each form that I do not know how to answer. For example: #5 at the bottom of SUM-130. How do I answer that?

    For eviction of a holdover owner following foreclosure, what is different in filling out the UD forms? The standard UD-100 has a note at the bottom saying not to use the form for evictions after sale. Do you have any guidance on filling out the forms following a default by the defendant after being served with the Unlawful Detainer?

    Thank you for all you covered in this video. I just need to know my rights as a person forced into a situation making me a "sublease" month to month tenant. The original lease was with the "Primary tenant" whom abandoned his lease and me, this left me responsible for everything. Which has turned into a 8 year nightmare. A Ex-person turned out to be a fraud... I thought I was in a relationship, turned "shit-suationship" or at the very least a friendship..?
    I don't want to be homeless 🙏♥️ I just want to relocate peacefully 😔

      It is your responsibility to relocate your self or the government should be responsible to shelter you not your landlord who is a private citizen

    Thanks Nick. One thing that I am not clear about is how do I count the days in a 3-day notice if we are posting and mailing instead as the tenant was not at home. Do we need to give additional time to the tenant since mailing takes time to reach the tenant?

    If the original 3 days or quit notice was pinned to the door and then mailed, does the landlord have to wait 15 days from the mailed day, or from the received day before filing UDI? And is it the court days, or calendar days? If the landlord did not follow the timeline, can the tenant quash?

    The court told me to drop of the Unlawful detainer forms in a box. What happens next? I have not been asked to pay the filing fees yet.

      If you were not asked to pay, that's either a mistake or you filed a fee waiver.

      Most judges would insist on it being delivered in person ("personal service") and seeing the signed proof of service tear off.

    I got a 3 day to quit as nuisance because I found an item from another tenant and they claimed it was theft. What can I do?

      Can you return the item to the tenant and explain the circumstances? You might not need a lawyer if you can resolve this.

    it has taking me more then 4 months now. and im doing everything through a law office. they are still in my home and they owe $15k ! will i see that money back? and this why i will NEVE VOTE DEMOCRAT AGAIN!
