Parents suing Royal Caribbean say cruise line played "major role" in daughter's death

- The parents of a toddler who fell to her death from an open cruise ship window are telling us why they filed a wrongful death lawsuit against Royal Caribbean. Chloe Wiegand's grandfather, Sam Anello, says he lifted her to what he thought was a closed window when she fell from his arms. He is charged with negligent homicide. David Begnaud spoke to the Wiegands.

Nope. The cruise line never encouraged Grandpa to pick the child up nor did they encourage him to place her near an open window. Grandpa did that all on his own.

That's was my thought as well, Royal Caribbean has been nothing but nice to this family put them in a nice hotel, provided counseling, and I didn't make any comments about the poor judgment that cause this little girl's life. It was the family that made her out to be a court case. The family is trying to make Royal look bad when Royal was trying to help the family.

@@shaed1298 I actually think the hot coffee lawsuit was reasonable - coffee shouldn't be scalding hot. This case is different, however, because the toddler could not have reached that open window by herself and this man picked her up and placed her in the open space - 11 stories up! She didn't ask for that...that poor, poor child. Grandpa is squarely at fault but they don't want to sue him - why?

Sorry you lost your child, but the grandfather was negligent and this case should be thrown out of court immediately.
Legally, that’s not how it is. Regardless of who caused the death, they obviously foresaw a risk of someone falling, being pushed, slipping etc. out of the window otherwise they wouldn’t have safety policies that they ignored.
Would the grandparents’ obvious negligence amount to an intervening act? Any good lawyer would argue not. And win.

I am very sad for the loss of Chloe but the grandfather stuck his head out of the window. Even if he was colour blind, he would have felt the sun, breeze or smells from outside. He also actually, physically lifted her up and over the obvious railing.

Would you place a child on the railing on an apartment building over the ground floor - or at all - even if there were windows? The parents should be charged too, to find out what the story really is. I am so sick and tired of the whole family blaming the cruise line, and not the grandfather who for whatever reason held the innocent child over the railing. After watching the video of the incident, I have no compassion for this family at all. Justice for Chloe, may she Rest In Peace.
Kind of get it. Went up an escalator at the mall the other day and there was no sign not to set my dog on the hand rail. Was a close call. All escalators should have signs “do not set you dog on handrail”.

But, she thought by pushing her narrative out there on the same day the child died, that she "fell from an open window in a children's play area", that the rest of the public would be as stupid as they are. I honestly cannot stand this family! I don't think they're going to drop this lawsuit. She's a prosecutor and she knows most big companies settle rather than suffer the bad press. I'm very happy to see that RC is coming out strong on this one.
@NYCPizzaman, I've been on this ship and that whirlpool you see on the video is not in a child's play area, that is where there are other pools and hot tubs my kids which were teenagers at the time hanged out in that area a lot. The family is trying to make a case out of nothing, which it's look like greed on their part.
@@kym0515 From the photos I saw, the splish splash areas and the hot tubs are in the center of the deck, and these hangout/ loungy areas are on the perimeter of the deck. In essence, there IS a water play area on the deck, but Chloe wasn't in it, and the window wasn't in it. You definitely have better perception of the layout since you were there.
I truly, truly cannot stand this family! It's unnatural how quickly they attempted to distort the facts and blame the cruise line, and it makes me sick.
@NYCPizzaman This case gets under my skin in a way that I can't explain (and that's saying a lot, because I'm a lawyer!). I wasn't shocked when they blamed the cruise line at first, because it's somewhat natural when you're in shock. But I was TOTALLY shocked when one day after their baby splattered on a concrete pier, they completely distorted the facts, and LIED to say, "What's a window doing in a children's play area?"
I was SHOCKED when the news headlines CHANGED from : "Grandfather Accidentally Drops Toddler From Cruise Ship docked in Puerto Rico" to (after the mother spoke)
"Toddler Falls to Death from Open Window On Royal Caribbean Ship"
That is a SICK distortion of the facts! That could only have been done for personal gain. Sick!

First, it was the doctored video provided by their attorney. Now, a clipped photograph of the window. What's wrong with the guy looking down while he was supposed to hold the baby up? Keep your eyes on the road!!! If you had your head down while driving and caused an accident, you're the one at fault. By their own admission, the guy was negligent.
They keep acting like this was normal 'play' that well-meaning people do with kids. A good comparison would be me staying on the 10th or higher floor of a hotel and allowing, actually placing, my kids on the ledge of the window (assuming there was some kind of ledge as some hotels have) because I felt the window was closed and would keep kids from falling through. The point is--I would NEVER trust my kids on a ledge. Now, assuming the same hotel had a balcony, I would NEVER entertain the thought of holding them on the railing because babies squirm and that could create an accident.

Well he did and she's dead. Rc didn't hold her up there. Even if that window was closed, he still endangered her and instead of her being dead she could of broken her neck and became peralized. Normal people can't make sense of this foolishness. I have 3 kids. I never would imagine putting them up on a rail, then on window sill. Even if the window was closed...there was no way for her to hold Herself up. He knew it was open, he wanted her to see out. He was leaning forward to be able to reach the window sill and for whatever reason let her go and she fell. Once at trial they'll be able to reenact and everyone will see how stupid and negligent he was and that his actions is why she is dead.
They can make all the window safety codes claims they want. If someone intentionally puts someone over board , it won’t matter. Throw out this case. Sad but misplaced sadness.
Industry standard is only 4 inch open windows?? I've been on 3 cruises and most windows open wide enough to lean out. What if it was just an open deck and a railing?? So their gonna close up open decks, too?? Ridiculous. Grandpa was negligent AF!

@@insaneone4369 One can assume from the video but the fact that when he admittedly let her "slip away from him" she was far enough out that when she fell, she fell out of the window. Open window or not, allowing her to slip from his grasp is the reason she is not with her family.
This is tragic but how could u not know the window is open if u dangle the child out of it for many seconds. I dont remember how many but long enough to take corrective action.

It was pretty obvious the window was open. He went to that specific window for a reason. They had glass that was approximately three ft high (child's height) tragic however, the grandpa is 100% responsible.

As a general rule, one should never lean or press against glass. Especially when 150ft above ground. Either way, the child slipped from his arms. That’s negligence.

Safe windows??? The window wasn't at the child's level, an adult lifted her up and out of the window. I don't think any right thinking person needs someone to tell them that lifting ANYONE out of a window is dangerous. Windows are placed for vent not dangling someone through it.

Unfortunately, we would never know for sure, but it seems kind of plausible--the first clue is that the grandfather apparently kept saying over and over something like "I thought there was glass!" That is the first thing to come to his mind?

He knew the window was wide open and still, he lifts the baby and puts her outside, then he "drops" her and instead of reaching out, he moves back, like hiding or something. @NYCPizzaman A Puerto Rican TV show released the video in early December. They don't show nothing graphic or stuff like that, they just wanted to prove that he lied when he said he didn't know the window was open. You can see him walking towards the window and putting half of his body out of the window and then he lifts the baby and puts her right outside the window.
The parents, in their distress, need someone to blame, and it's too hard to realize that the blame lies with their own family, so they are trying to blame Royal Caribbean. Once they settle down in a few years and take a deep look at the situation, they will probably realize that it's the step-grandfather's fault and also their own fault for letting such a fool watch their child.
How are none of them crying. Especially after seeing the released video.

Okay..with the picture they just showed, there was glass at the bottom. She was already down there then looking out the window, why didn’t he just leave her down there looking out of an obviously closed window. He didn’t HAVE to pick her up. As little as she was the bottom window was perfect for her to see out of. Her grandfather picking her up OVER the railing to dangle her and losing his grip caused her death...sad!
In his first interview since this tragedy occurred, Mr. Anello says he checked the lower window and felt it was "too far away for Chloe to bang on" so he lifted her up to bang on the upper glass. Makes absolutely no sense. The lower glass would actually be very accessible for Chloe, all she had to do is move a bit closer to it. There is no type of railing or safety barrier to prevent her from banging on the lower glass. The lower windows don't open, for obvious reasons, and Chloe could've banged away on these windows to her hearts content. It was Mr. Anello who decided the upper window was a better option. Doubt he still believes that.

When you see the whole video, the grandfather went over to the window and leaned out of it before bringing her over to it so I don't understand why he isn't in jail. He clearly knew the window was open. Both of them can't be seen at all when he holds her out of it so I don't buy that he didn't know the window was open. I think the parents want to relieve their pain by suing the Cruise Line and maybe the Cruise line should look at the window issue. I don't know. The Grandfather should serve time. It doesn't even look like an accident to me. I can't believe Gayle King was saying she was glad the family was standing by Anello.

The funny thing is, I do believe the ship's company is winning in the court of public opinion based on the vast, if not every single, comment under these videos. I don't think anyone would take it as meanspirited if the company countersued for defamation, slander, and whatever else you can sue when someone badmouths you. When you think about it, this lawsuit, because it involves nonsense, ultimately hurts all of us in our pocketbooks. I really think a countersuit would help protect the majority of us against price increases.

Watched the video..grandpa clearly held her out the window for more than "a few seconds" certainly long enough to know no glass..and looked like with only one hand at times. Initially they said was in child play area..not true either. He was 100% at fault.

Even if there were warning signs posted that the windows do open or to not put a baby on a railing (which is not made to do) this tragic thing would've still happened. The family is suing because there wasn't any warning signs, well you can't put warning signs on everything, people need to use their own better judgement. This kind of thing has never happened on a cruise ship before. I've been cruising for many years (I also been on the Freedom) and you can tell when those windows are open, the breeze by itself not to mention I can be 30 feet from the windows and tell which one is open.

Grandfather got 3years probation. Parents case thrown out. It was not the cruise line fault. Their lawyer totally wrong. Grandfather looked out of the window then claimed there was no window. What would you lift little girl out of window after poking head through it? Sad…….
It is really hard to accept that they are the one’s who made a big mistake that’s why they have to blame the company😔

Colorblind people can tell there is a tint on the window they just may see the color as different. It would be very hard for a family to see the truth that her father did this on purpose. In denial. Will lash out at people who might point this out. I feel empathy for the husband.

He needs jail time to send a message to others to NOT play STUPID games with babies, and this is why you don't play the stupid 'dangle the kid over a loooong drop' game. As far as the civil case goes, the cruise ship should NOT settle out of court. It would be fairly interesting seeing how the lawyer will argue in court that the ship's owners should have been able to forsee a stupid imbecile would choose to dangle a kid OUTSIDE a railing and an open window where there was a 150 foot drop! Good luck with convincing a jury on that one!

No granddad played a major role, he is the only one to blame! He will have to live with his mistake for the rest of his life especially when he has refused to take full responsibility for his actions, and the parents of the child need to stop and admit the grandad made a fatal mistake that took their child's life and admit how instead of being angry at the grandfather their taking their anger out of the cruise line who's windows are far from the toddler reach seeing as grandpa needed to pick her up for her to reach the window! You know how many kids climb over windows in apt building? Alot! Never have I heard of a parent trying to blame the landlords or whoever owned the building because in the end the parents took their eyes off their child leading to the fall whilst granddad put that child in a dangerous situation!
I would’ve felt more sympathetic for the parents, until they decided to pin the blame on something else for money.
I'm sorry, but they're most likely not going to win anything. Thd cruise ship did not drop the baby, the grandfather did. The parents play the even bigger role than anybody. Watch your damn kids! But don't try to sue the cruise ship just because they have Windows
Tragic indeed but not the Cruiseline fault ... mom looks fairly young so hubby just needs to get back in the saddle and ride till he can't no more ... and when the knew one comes ... granddad gets supervised visits

I don’t believe it had anything to do with biology. My parents trusted my siblings and I with non- biological relatives and nothing like this ever happened. As far as I know the parents here are / were the biological parents to that baby and yet they defend the non-biological grandfather who killed her.
