California bill looks to protect "right to disconnect" after work hours are over

  • Workers in California who are sick of work calls and emails after hours might be getting some back-up from the state legislature. A new bill would give workers the right to ignore calls and messages from their bosses until they're back on the clock. It would be the first law of its kind in the U.S., though France already has a similar law on the books and Australia will implement one later this year. California assemblymember Matt Haney proposed the legislation and joined CBS News to talk about it.

    No one should be calling after work. Salaried employees aren’t paid anything extra for it and it negatively impacts work-life balance.

      ​@@PaulFromCali overall income may be higher, but when calculated to the money made per hours worked, salaried workers who don't get overtime pay and are expected to work over 40 hrs/wk can end up making less per hour than those in similar fields and positions who are paid hourly and/or receive overtime pay.

      The thing is that the employer can still fire someone for not responding. It’s an at will state. They don’t have to give a reason for firing.

    I had a boss who felt as though you should answer every text and email, regardless if you were working or trying to enjoy a day off. Even went as far as buying me an iPhone, so that I could "participate" in the group chat for managers.
    I had an android, but I wouldn't respond when I was off and sometimes the msgs from iPhone would come in separately and so she took it upon herself to buy my an iPhone to receive all her msgs and emails without any hiccups...her words!
    Happy to say, I left the company after two years and started my own business. I don't bother my team members after work and I don't expect them to respond right away especially because they have a life outside of the few hours they spend working. I just try to be a good, respectful and appreciative business owner.

    “Thanks” to cellphones…my bosses expected me to be on call 24/7 for the last 20 years of my career. It totally burned me out and was a big factor is why I decided to retire early.

      Yup exactly. I've told people when I leave work, I don't look at my email. We used to have to carry pagers. After hours, I would turn it off.

    There was a time when calls from work weren't a problem. Employers didn't call unless they had to and employees knew when they picked it up that it was something genuinely needed. That was before employers decided workers didn't deserve the basic human respect of not calling them ALL THE DAMN TIME.

      What your mind set should be: "It's sad the government thinks they can dictate a companies relationship with the employee". If you don't like them Quit! This will make companies fire more people. You are not in charge no matter how you think you are. No one is truly hearing your voice. Maybe learn to stop expecting a certain treatment and suck it up like the rest of us and work.

    By the way, many states have laws that require a minimum salary for people that are on call 24 seven. In Oregon it’s 68K per year.

    As a salaried employee I have never worked over 40 hours. I would say I average 25 hours a week of actual work. I make sure to get my work done in the allotted time since I do not get paid OT. Those who work "off the clock" are either on-call and should be compensated for it, workaholics, or have bad time management. There is no other reason.

    This is a large issue. I receive so many emails and text messages after work. I even get messages between midnight and 6am. Tech makes it so easy to reach out and always be connected/accessible. If I don’t respond I get text messages asking if I saw the email. I disconnect and put my phone on do not disturb after 6pm.

    Employers will be sneaky about this, I bet its going to be stated in small fine print in a contract that you must answer at all times. Also, what constitutes as an "emergency" is going to be highly subjective.

    It’s a nice idea, but I personally don’t need a law like this. Just don’t answer the phone when you are at home. Your boss will probably leave a message, so if you want to know why they are calling just check your voicemail. You have to learn to put the work phone down once you get home. Only check messages and then decide if you want to call back or not.

    We been called to cover somebody callouts. Or to come 3 hrs earlier coz the store is buisy. We have life too and we dont get paid much. We work for our plans in life but most of the times it affects you as person it becomes a stress.

      I'm in IT at a university in CA and I don't look at my mail when I leave the office. Nor do I look at it on the weekends. If I'm not getting paid OT, you won't be hearing from me until Monday, after a holiday, or when I come back from vacation.

    So system administrators, network administrators, doctors and the like will no longer be on call 24/7? 8 hours a day max? Honestly, this only makes sense for hourly employees, not salaried employees with much better pay and higher expectations. When you pay someone $200k a year availability is part of the deal. Additionally, salaried employees have no set hours and overtime doesn't apply. Like to see how they resolve that.

    I don't get why this even requires legislation. The problem is management and people grow accustomed to individuals answering their emails and answering their phones after hours and then begin to expect it. I've told people multiple times when I leave work, I don't look at my phone, I don't look at my email. That also goes for the weekends. And I do I.T. support. On Mondays I've seen people who have emailed me on Saturday and Sunday, but those messages do not get answered until Monday. I don't know why they're even working on weekends anyway. They're not getting paid. I've been offered a work phone and I just flat out turn them down. I don't want to have to carry a work phone on the chance that it could break, get lost, and I just don't feel like answering it.

    this would be great! My mom is French, so I know this rule all to well.I is nice to take the extra hours and more pay. however, you do have that sacristy of if I don't take it then my boss will view me differently.
    life can't just all be about work. This is unfortunately something America doesn't really get.

    I WORK IN I.T. - We are expected to keep an eye on our emails, teams, texts for for any major issue that may need to help with... It's just part of the job unless we are on vacation. We are paid very well via Salary and year end bonus...

      I've done that and it takes everything. You put your whole soul and life into it to make it sustainable and after 2-3 years new businesses don't even make it and they still start over from scratch.
      I'd rather work for someone else and not have the pressure of running everything on my own, and help adds up.
      I'm happy as an employee, just need the cost of living to go down!

    Do legislators just make up stuff for the purpose of introducing legislation. Gesh. Of course employees who are not essential have a right to disconnect when off the clock (not being paid). Just simply don’t look at your work phone or work email or answer work calls. Get back to whoever it was when you are back on the clock! This is crazy. I will say though- a lot of my staff are still teleworking and I am flexible with their work hours. I don’t really mind when they start or when they finish their work day, so long as they are getting their work completed. In exchange, my staff have very willingly answered my emails late into the evening, IF THEY ARE AVAILABLE AND IF THEY SO CHOOSE TO DO SO ON THEIR OWN FREE WILL. There’s no repercussion if I don’t get an answer until the next day when they are back on duty. I don’t “expect” staff to work 24/7, like I have been hired to do. Now, my essential staff, are required to report / respond if an emergency arises. But, they also get paid overtime for doing so.

    California being California will eventually enact a bill to protect "right to connect" after work hours are over. Land of lawyers/legislators!

    This law won’t affect me. Fines are too low. I will continue to call my employees after hours because it’s work I don’t have to pay for. The tactic that I and many others use is to save real work until after a shift is over. This saves considerable money. Typically the projects I assign as emergencis after work hours is about 2 or 3 hours.

    you guys are very lucky now days in the old days if you did not put everything you had into your job you did not have a job and there was always someone standing by to take your job when you got fired for not giving it your all. I see mass layoffs on the way and I sure hope all you overworked and over paid people are ready for it. these 20 million plus unknown migrants are ready to step up and take over your jobs for half the pay with no benefits and they are very hard workers they will even work with no overtime pay and work the weekends no problem. wishing everyone the best.🙂

      Also what you're claiming, is illegal, they cant hire people less then the minimum wage which is $16, & they can't make them work overtime without extra pay and benefits, they'd be in a lot of hot water. What planet are you from

    More socialist policies from California. They are living up to their reputation as a state that is not business friendly. Salary earners are usually not on the clock and are often expected to be reachable; especially managers. Wage earners only work within their hours, but can easily ignore calls or texts from work. As usual, Democrat politicians need to extend government intervention further into private businesses and personal lives. More government…less freedom. That’s what France, Canada, and Australia has as well.

      I've had plenty of salaried jobs. My work schedule was Mon-Fri for 8 hours plus 1 hour for lunch. Don't look for me after hours or on weekends. No job is worth that aggravation. I'm not interested in being that guy found slumped at his desk dead by the custodian or co-workers the next morning because some manager can't go without some piddly thing until the next day or after the weekend. I've been working too long to have to put up with that nonsense.
