How can you ban weapons of war? Only those that participate in the agreement to ban anything in war are then bound by that agreement. This is called a participation versus compliance agreement, and it is only binding on those that are a party to the agreement.
If you are not a party to the agreement, you are in no way bound by that agreement, so you are not compelled to comply with the agreement.
This is the point most don’t understand about international laws, including agreements like the Geneva Conventions.
By the way, these participation verses compliance agreements are treaties, and for the United States to be a party to these agreements they must be made, by and with the advice and consent of the Senate, providing 2/3 of the States concur through their Senators Present. Each State may have 2 Senators, each with one vote, but the State has equal suffrage in the Senate, not their Senators which only represent their State’s legislature. This does not require ratification which is after an agreement is reached, because by and with mean before and during, not after, which means that the Senate must first consent to discuss the treaty, and provide the parameters for that discussion, when those parameters are reached, then the President is empowered to sign the agreement in the name of the United States.
