      I have mentioned the sections wherever required; otherwise, I have tried to keep it relatively simple .

    isn't mediation a non binding process?

    • @LawMint
      @LawMint  Před 9 měsíci

      Mediation is a 'Voluntary & Binding Process' - i.e. the parties voluntarily agree to participate in the mediation process. They can withdraw from the mediation process at any time. However, once a mediated agreement / settlement is reached and agreed to by the parties, it becomes binding.
      Think of it like a normal contract. The parties have the option of starting discussions and arriving at a draft contract. They can walk away from the discussions at any time. However, once an agreement is reached and the contract is signed by both the parties, it becomes binding.
      While the syllabus for this year will not change, I will be updating this entire series for next year, since the Mediation act was enacted in 2023 and there have been some changes in the fields of arbitration and conciliation also, which will be in next years syllabus.
