    VA Disability Benefits for Migraine Headaches
    Military veterans, particularly those with service in Iraq, Afghanistan, and the Global War on Terror, have a significantly higher rate of migraine headaches than the general population. In fact, migraine diagnoses in the military increased by 27% from 2001 to 2007 as a result of the increased deployments to the Middle East.
    The effects of migraine headaches are fairly well-known. Attacks can last up to three days at a time and usually include severe, throbbing head pain, sensory sensitivity, nausea, and vomiting.
    Migraines are the second leading cause of disability among veterans but are sometimes hard to identify as there are no visible symptoms. If a VA disability attorney establishes a service-related connection and disabling symptoms, financial benefits and free medical care are available.
    The two main causes of migraine headaches in veterans are mild to moderate traumatic brain injuries (TBI) and exposure to toxic burn pit smoke.
    Laying the proper foundation is the first step to establishing a service-related connection. A current diagnosis must be readily available in the file. A diagnosis from active duty of a concussion, TBI, toxic exposure, or other related illness is also helpful to establish a link. The burden of proof is only “as likely as not” in these situations.
    The rating scheme for migraines is rather straightforward. There are four categories of disabling migraine headaches depending on the severity of the symptoms: 0%, 10%, 30%, or 50%.
    Though the maximum rating for migraines is 50%, a veteran can seek a total disability rating based on unemployability (TDIU) if he or she can prove the migraines get in the way of holding full-time, gainful employment, along with other conditions.

    I had a C&P exam for Migraines via telephone. The Exam starts I and can't understand the doctor. She spoke broken English and I kept asking her to say things again. Then I asked if she was calling from another country and she said no and was pissed after that. . Anyway , I told her what Meds I took and she wrote down that I don't take Meds. So many things she wrote down just weren't true. Anyway, of course ___ I was denied and now I'm appealing. How do I go about appealing the decision ? Since the denial I have gotten more evidence , another Nexus letter and diagnosis from Neurologist and Brain Cat scan and MRI. I think I'm in a good spot to win an appeal, but you never know.
