The highlights of today’s Court of Appeal ruling are:
1. Rt. Hon Martin Amaewhule and 24 others hold their respective positions and seats in the Rivers State House Assembly.
2. All reliefs sought by the appellant Amaewhule and his colleagues were granted on the merits.
3. Only the Federal High Court has Jurisdiction to hear issues of tenure or Vacancy of the Office of Governor , Deputy or Member House of Assembly.
4. An appeal can emanate from an exparte Order of a High Court hence the appeal before the Court of Appeal is competent and section 241 (2)(f) of the 1999 constitution as amended is superior to section 14(1) of the court of appeal act. It therefore means that section 14(1) of the Court of Appeal Act is null and void.
5. The Ex Parte and Interlocutory Injunctions of Justice C.N Wali are Null and Void and of No effect as the State High Court lacks jurisdiction ab initio.
