    I made family class Responser last five months and the officers working on it as they told me and they didn’t oversee the Application can u explain what you think thanks

    Hi Mary - You video is absolutely fantastic and detailed. The way in which you approach the subject is smart and tactical! I am curious, do you recommend paying the fee for criminal rehabilitation before approaching the boarder with the entirely completed application and significant documentation for review by a BSO at the POE?

      Thank you! An officer at the port of entry cannot make a determination on a rehab application. Only on a TRP so for the TRP the fee is $200 and you can pay at the border. If you want to be criminaly rehabilitated, that application has to be filed at an Embassy or High Commission outside of Canada and you need to receive the decision.

    Hello i was pulled over by DOT in Phoenix Arizona on January 14th of 2008, And was charged for possession of marijuana for sale , 6 months later i took a plea deal for 1.5 years and and at the end of the sentence i was held by immigration and deported to Jamaica in april 29 of 2010. Is it possible for me to be successful filing a criminal rehabilitation form to drive tractor traler in Canada?

    I applied for rehab in 2016 but was denied. I reapplied in 2020 and was approved this week. It was for serious criminality and cost 1000. The charges were from 2002 but fines were paid in 2017 and so I had to wait 5 years to elapse

    what if not.convicted and happen 7 years ago? Do I have to apply for criminal rehabilitation?

      It depends of the type of conviction and the criminal assessment we make. It could have happened 20 years ago, we still need to look at the facts and make an assessment to determine admissibility.

    What if it was a misdemeanor attempted assault that has been expunged in America. Does Canada count expunged records?

      Hello Larry, you still need to get a full criminal assessment of your case, as expunged records are not relevant in Canada in terms of immigration.

      Hi Bhinda. Deemed rehabilitation happens automatically with time, but we would need to make a criminal assessment of your case to determine this.     My question is if someone have criminal record ( trafficking of human charges ) and still name in europol he can got visit visa of canada and enter canada after he will apply case in rehabilitation or before apply visa he need to clear this matter. Normally case in rehabilitation how much time required for decision and case chances %.

    Thank you so much for this informative video. I wanted to ask a question about the original clearance I’m originally from the Congo DRC but I’ve lived in the United States since I was a kind and I got deported to Congo at the age of 24. How can I get a original clearance from the states 🇺🇸 . I don’t think I’ll be able to get one from the Congo, because our country underdeveloped.

      There are agencies where you can go to outside of Canada to provide your fingerprints and mail those to the US in order to be issued an FBI report

    Hi,
    Thanks for the video. I arrived in Canada from Australia a year ago. I was granted a TRP at the Vancouver airport on arrival and an open work permit for 2 years. We want to apply for permanent residency... Been advised to apply for rehabilitation once my criminal charge is past 5 years (this coming May 2022)! My ridiculous crime was my gun (I had a gun license) was locked inside my gun safe but it wasn't bolted to a wall. This was because we had been moving house at the time. I got a record on my police check and a fine which I paid.... So I still apply for rehabilitation if I'm already in Canada.... To start to PR process? Thank yoh

      Hi, thanks for your inquiry! Typically, individuals must wait until they are eligible for criminal rehabilitation in order to apply for permanent resident, or else it will likely be refused. I encourage you to meet with an immigration lawyer to confirm the timeline of your criminal rehabilitation eligibility, and also to discuss this application with you in detail as it can be difficult to prepare.

    Hi,
    Your videos have been very helpful.
    I had a DUI in April 2017 in New Zealand, had my licence cancelled for 6 months with $800 fine and court fee , Got my licence reinstated in October 2017, however I had payment plans for my fine, last instalment was paid in June 2019.
    My wife is eligible for Express entry
    . To apply for criminal rehab application, will it be 5 years from the last date of my fine or the day I got my licence back.
    Or it is up to officers discretion??

      In general, the five years following the completion of any sentences, including any fees paid. So it would likely be five (5) years since you paid the final installment of your fee.

    I'm from Nigeria. I got misrepresentated in 2019oct, i didn't even know because of the stupid agent in charge of the application was unprofessional. i still went ahead and proceed with obtaining another visitors visa and sponsor visa. The sponor visa was approved but the visitor visa wasn't approved, it says I'm inadmissible to Canada. That made the ircc close my permanent resident application till 2024. Me and my wife are really going through hard times. As you said in your video that if you are misrepresentation you can still get TRP. and am I gonna be approved because we wasted lots of money and time.

      Is this payment plan part of a sentence following a criminal conviction? Individuals are typically eligible for rehabilitation five (5) years following the completion of all criminal sentences.

    If I committed an offence and have been rehabilitated, can I don't mark that in my application? Obviously not, but why then do rehabilitation? There is a large competition amount potential immigrants and province rather choose a clear person🤔

      It's always important to contextualize your immigration history to IRCC. They will have it on record if you previously applied for rehabilitation or were inadmissible to Canada, so they will know already.

    Quick question, I am eligible to apply for rehabilitation (USA). But I also have to have a TRP for this coming up in January for work. I live in the states and come to Canada once a year for work. My question is, as I understand right now with Covid, TRP's are only being accepted via email PDF. Are the rehabilitation applications still paper only?? There was no mention of those in the last email from the consulate. Also where would someone in the United States send the rehab application nowadays? Thank you so much!

    Hello, Mary. Thank you for your great videos. Asking for a friend. My question is - in general, - if a person was arrested in the US for intoxication/disorderly conduct (2015), but the plea entered was NOT GUILTY, and the case was dropped without going to court; Is it necessary to apply for rehabilitation for immigration purposes, and if yes is it done before, after, or during the the actual PR application? Most likely, the fact of the arrest itself will come up on the FBI report, but since there was no subsequent court trial and no conviction, I am not sure if the immigration still perceives it as criminally inadmissible? Is it typically necessary to write and attach an extended explanation with the answer to this question on the application itself? Thank you so much.

    actualy before some month ago an employer want to hire me he send me offer leeter lmia also got and visa also approved for 2 years but between all these process almost 7 months spent and in between the period company had been sold and new managemnt not hiring foriegn worker so now what should i do ?
