Eschdero saying; "the burden of proof lies in the accuser" i believed escudero meant; the "onus" of proof rest on the defendant". It should be the other way around. Because the "accuser" in this case is the government. The government which we can call the "plaintiff" have already given statements and evidences as to the wherewithals of the case. Now. It is the defendant (alice guo) to prove otherwise.
Little knowledge is dangerous! 😂 Since when is the senate hearing a replacement for our courts who are tasked to hear, try, and decide the issues raised by the parties after determining the facts with finality as proven to its satisfaction? Not all of your wherewithall are evidence. Your most cherished allegations, no matter how sensible, aren't proof, so are your plausible doubts, your favorite bias or worse, your reckless prejudice. You would do well to consider the basics first so you wouldn't lose your way in your journey towards articulating about the burden of proof or onus and whether it has indeed shifted as you imagined especially in that particular forum.😂

Dahil nga si poe ay foundling with no known biological parents (nakita lang sa tabi ng simbahan) and yet she enjoyed the legal presumption since, like you said, may adoptive parents. So, to be fair, this alice guo, having been born & resided here for more than 3 decades albeit in a farm as claimed, amongst other circumstances, should be given the benefit of the doubt because she is likewise entitled to the presumption although subject to the burden of proof which may shift at anytime.
Don't raise your hypocrisy to the level of an art by casually depriving anyone or someone of the legal presumption to which they may be entitled. Follow the law, be fair in the process which means hold & control your prejudice, and let the chips fall where it may. Is that so difficult for you?

It's called presumption of innocence. Until the accusers can prove their accusations with concrete evidence in court of law, the accused remains innocent. Yan ang basic creed ng demokrasyang tinatamasa ng bawat Pilipino. Alisin mo yan tulad ng lahat ng mga nagpost dito, then kahit sinong Pilipino pwede mo ng ikulong ng walang kaso. Trabaho ng ombudsman ito at di ng Senado! Trabaho nila ay gumawa ng batas at iready ang government budget for next year! Ang daming batas na di umuusad sa Senado kasi inuuna ang mga hearing na ito na wala namang pinupuntahan! At this point, dapat iniimbestigahan na si Mayor ng Ombudsman to confirm whether or not Filipino ba tlaga sya and then file the appropropriate case sa korte if they have enough evidence to prove na hindi.
