    A drug dog is the police version of a signed warrant to search. If a cop asked if he can search your car, that must mean he does not have that right unless he gets a warrant. Bringing in a drug dog is usurping our 4th Amendment rights. What makes it even more egregious is the police dog cannot be cross examined in court.

      the canine has a credibility issue in court. I would point out to the jury that the "people's" case revolves around a dog and then point to the dog as it likes its own balls.

    Even though a case is dismissed, the arrest remains on your record, you must ask the judge to expunge the arrest record. If you wait until later the expunge process is much harder.

    Was violated about 2 weeks ago. They had no suspicion but prolonged the stop 10 minutes for a drug dog. I told the backup cop that they were going to stage an alert and not find anything, which is exactly what happened.
    I filed a complaint and am waiting on the results but I'm not holding my breath. "We investigated ourselves and found we did nothing wrong."

      This is what I'm afraid of them doing. You tell them that you don't consent to search so they use a drug dog as a tool to just say yes the drug dog says there are signs of drugs in your car. They can say the drug did show signs of drugs when he actually did not. How you sapose to fight that?

      I can't think of any court that'd entertain an "unreasonable" stop over a TEN MINUTE delay. Sorry, but the cops have that much latitude to mess with you. Were you able to film them taking the dog through its "dog and pony show" to "alert" to the supposed presence of contraband?
      The one out that police still claim is that there might be "residue" of meth and/or cocaine on currency you have. The only problem with that is, assuming that the pooch can reliably detect that, which I say is dubious, is that whether or not the mutt actually detects the "residue", if it can be reliably detected by lab analysis, then all it "proves" is that this residue might endure after the currency changes hands, several times, in effect, being "laundered" into the legitimate economy. That's what is known as REASONABLE doubt.

    The dog becomes a witness against you and the 6th Amendment assures you the right to confront witnesses. The dog cannot bed confronted because he has no common vocal understanding.

    This just happened to me in OKC, cop said I didn't signal 150 ft b4 changing lane on I40 pulled me over I refused the search sat for 21 minutes till the K9 showed. They said the dog hit, they tore the rental car up used a x-ray device found nothing. Then wrote me a warning for following to close. Waiting on the body cam footage as we speak.

    A drug dog violates your rights everytime it’s used to get probable cause.Courts ruling that an animal can subvert a persons constitutional rights is completely absurd.Police abuse this “loophole” by manipulating dogs to get a false alert on command.

      Given the average, normal traffic stop, 20 minutes is considered a reasonable amount of time for police to obtain your information, run your records, perform their investigation, issue you a warning or citation and allow you on your way. Further investigatory purposes can allow them to extend it, but anything beyond 20 minutes requires justification.

    It is getting harder and harder to get a dog hit on a traffic stop to be admissible. A good rule of thumb for a police officer is 8 minutes before you have illegally extended the stop. Unless there is some unique reason the stop would have taken longer, the data collected on traffic stops suggests that over 8 minutes is not a reasonable time to cite someone and therefore detaining them longer than that for a dog to arrive is illegal.

    UPDATE: To counter your right to decline a search, the police have a new trick to fool you into consenting.
    During the traffic stop, probably as the officer issues you a ticket or warning, he may ask you a pair of back-to-back questions.
    "Do you have anything illegal in the car? Do you mind if I do a quick search?"
    This is two questions: 1.) Do you have anything illegal in the car? (And) 2.) Do you mind if I do a quick search?
    If you answer "no", saying you do not have anything illegal, that same answer (no) is applied to the second question, "Do you mind if I do a quick search of the car?", So, by answering "no" to whether you have anything illegal, you consented to a search because you said you do not mind if he searches your car.
    Same thing if you answer "YES" to the second question, ("Do you mind if I search your car?"), You are declining a search, but that "yes" answer is applied to the first question, "Do you have anything illegal in the car?". By doing that, you are admitting to having something illegal, which gives the cop probable cause to detain you further and to search your car.
    The proper way to win this truck is to say "No, I don't have anything illegal, Yes, I do mind if you search my car.".

      Just refuse to ANSWER the question. If you have something that you MIGHT believe to be contraband, why the hell CONFESS it? Let the cop put out some effort, at least! And yes, I would "mind", I don't have to justify WHY I don't want to have my car, my home, my "effects" (records and/or possessions, including my cell phone), or my PERSON searched, it's called PRIVACY.

    They can circumvent this by asking to search, you say no, they go back to their car and call a drug dog before they even start to issue the ticket in fact they don't even start to do the ticket until after the dog arrives.

    I've had it done to me in Indiana. The dog was there and was goaded into alerting. They found nothing because there was nothing to find.

    I had a similar situation but the thing is that the officer gave me the speeding ticket and ID registration after the k9 sniffed the car and searched the car.

    The very idea that the action of an animal can serve as probable cause to suspend your 4th amendment rights just boggles my mind. How did we get to this point? It makes so sense. The day a dog can come to court, get sweared in, and endure cross examination is the day I will accept this concept. Until then, it’s all bullsh!it.

    I got a good question as well. I was pulled over for speeding, so I gave my information to the deputy, then he asks me to step out to go over the citations, but while outside my car, he asked me if I had anything in my vehicle that he should know about and I told him there's nothing in my vehicle. He asked me to if he can search my car and I told him I didn't consent. He ran a dog around my car and then he placed me in hand cuffs, read me my rights and told me his dog alerted to illegal narcotics in my car, which I know is a lie, so he had the reason to search my vehicle. He searched my vehicle and found no narcotics in my vehicle, then takes me out of the cuffs, asked me how much I had to drink today and I told him I had 1 a few hours ago, not gonna lie, then he did a field sobriety test on me, saw that I'm not impaired, gave me my citations and let me go. My detainment was 30 minutes, but I feel the search was illegally done. Can I get some insight on this?

I didn't have time to sit there and have him arrest me on suspicion, so he searched my vehicle, I did the field sobriety test, which shows I am not under the influence of anything, but I'm still pissed that he did all this because he thinks I have something on me.

    I was a K9 trainer for 23 years. If a dog is brought to your traffic stop watch the dog carefully. If the dog’s mouth is open during the search the dog is not sniffing and might not be a real narc dog.

    Murfreesboro TN MPD & Rutherford County sheriff make their dogs false respond on EVERYONE that refuses permission to search. There's video evidence from several years ago of someone that secretly filmed it. I had this happen from MPD twice many many years ago and they tore apart my car after i wouldn't give permission. Drugs had never been in my car, no one with or on drugs had ever been in my car, so i knew it was complete BS and of course they didn't find anything reluctantly let me go. 6 months later a video went viral of the same officers pretending the dog hit when it didnt during a July 4th roadblock. K-9's give officers an excuse to violate your 4th amendment rights.

    Great video! A police officer cannot keep you in a traffic stop for more time than it takes to write a citation or a warning. Here is the question. How much “time” should take to write the citation or warning? 5 minutes, 10, maybe 12, but I would say 15 max. If the cops are dragging their feet and taking beyond say 15 minutes to write the ticket what can you do? What if they are dragging their feet when writing the ticket or warning to give them time to get a police dog to the scene. How much time is too long?

    When handled by a uniformed police officer, I would say drug dogs are 100% untrustworthy. Get me someone and a their trained dog that stands to lose big time should an alert turn up false.

    I have 2 current police officers and several former officers in my family. Every one of them says "If a cop wants to search you, they will always find some probable cause". Dogs are just one of many tools the police use to bypass the 4th Amendment.

      Possibly, but some of those "reasons" would fall apart in court. So always decline a request for a search. Also, refuse to answer questions about where you're coming from or where you're going.

    Clearly, the unusual amount of air fresheners is not illegal. On top of that, if a cop wanted to use that as a reason why was the smell not noted at the beginning of the stop due to it’s overpowering nature which may give them a hunch (which is still not enough). Once the stop is over the officer no longer have the right to detain unless they have probable cause of an additional crime.😊

    Thanks for the Video... I think the concept of "reasonable suspicion" is poorly understood by the general public, and can be very subjective. 2 or 3 Air fresheners isn't suspicious, but 10 or 15 scattered around in a vehicle, I think, could be considered reasonable suspicion, and might warrant further investigation. Perhaps you could do an in-depth Video on that?

      I think @Unapologetic is referring to the use of air fresheners to disguise something illegal in nature. For example, if you are in a state where marijuana is still illegal, often times you see an overload of air fresheners to disguise the smell of the marijuana or whatever the illegal item may be. Happy to do a further video on what “reasonable suspicion“ means, and how it’s different from probable cause!

Not only does it violate your rights if you legitimately are guilty, but it also violates your rights if you are 100% innocent. See the issue?     Hello, this happened to me, they prolonged the stop and the K9 dog got a "hit" giving them probable cause to search my vehicle. I don't do drugs and they never found anything in my vehicle. They ransacked the interior of my vehicle and caused damage, the dog also scratched the paint on my vehicle. This happened around a decade ago before body cams became common. I lost all faith in law enforcement and quite frankly I don't feel safe around them. I was naive at the time and had no interest in pursuing it. If I find myself in that scenario again what recourse would I have?

    This is really not a public service message about your personal rights. It's an advertisement for legal services. The person that the case was dismissed had to pay you or they would have been convicted. You don't just have rights like it should be, you have to pay for those rights. I would bet my life that this law firm has never got a dismissed case or especially a trial victory when they were appointment by the court.

    What do the police do with evidence that was obtained illegally? In this situation it doesn’t seem lawful for them to keep the evidence, and it doesn’t necessarily seem lawful for them to return narcotics to the prior suspect. What do they do with it, let it sit in a locker until the end of time?

      Once the legal matter is over with, they will likely have to destroy things such as guns and drugs. As a matter of Public policy, those items are not returned if they are seized from a person illegally possessing them.

    Inform the K9 handler that he is not to touch your vehicle during his process of seeing if his k9 key's to a detection. And tell them you want to know before they proceed what the dog's que if it detects contraband. Sit, bark, ect...

    What criminal action was taken against the officer for clearly breaking the law? I am willing to bet, that like in most cases, nothing happened to this officer, including not losing his job or going to jail!
    I am also willing to bet, that the lawyer did not proceed to press legal charges against the officer to the point that it went before a judge!

    I recently had a work accident cut my finger off. I was given hydrocodone pills by the doctor. I didn't use them but they where in my car Incase I needed them (the accident was 2 weeks before the cops searched my vehicle -in other words they where legal for me to have.
    Police saw me asleep in my car woke me up asked me if I was ok asked if I did drugs I showed them the prescription. They they said get our of the car saying their dog (I never saw a dog) had detected drugs
    They searched mt car. This was in Idaho. How the hell is this a legal search. I don't do drugs it highly upset me
    Did they have the right to search my car. They didn't ask me they told me they where searching my car

    Was traveling with another person in another car.. After an hour they were printing me ticket to let me go. During this time she got arrested for drugs however this did not change my officers intention to just give me a ticket. Then another officer came looking for reasons to arrest me so they could use the tow truck they called and they called the dog before coming back to my vehicle and then threatened me with it. The other driver was related to one of the officers and recieved 3 months probation and3 months rehab and this was her 3rd offense .I had never been in trouble before and was blood tested and they are now threatening me with DUI when officer asked two people if I was under influence and couldn't tell them to be to sheriff's office for field sobriety test... The he urinated on my lapel camera, dropped the glove he was using for my blood draw in the trash and used it, and tried charging me with 16g of meth and there has now been 4 different amounts given by him and no Miranda rights were given until 2 hours after the stop and the da and my attorney are only putting in evidence that makes me look guilty and ignoring the perjury by the police officer and the misconduct and everybody even the judge is looking the other way of the facts... WHAT CAN I DO?

      Get the most expensive lawyer you can find and file a countersuit against the officers, department, city, county, and anyone else your lawyer advises. It's going to cost you a bunch plus a percentage of whatever they settle for if you win but it's worth it.

    The flaw in the canine cop dog is that they only do it for a reward. Dogs are smart and some dogs will cheat to be rewarded faster! I also do not think that killing a police dog that is ripping me apart should be classified as murder.

    Drug dogs false alert all the time. Officers wanting the dog to alert will often signal them to alert. Ask for their supervisor to come.

    Drug dogs are simply a means to violate the 4th amendment. Dogs are wrong more than they’re right. I’ve heard numbers like 90 percent where they don’t find anything, but they keep you for hours and trash your vehicle, and of course, do not put everything out that they’ve dumped into the floor. The dog alerts because his trainer prompts it to alert. This should not be allowed as probable cause. The cops don’t care if you file a complaint. The only thing that matters to them is losing their qualified immunity and getting sued personally, but they know that even that takes years to work through the judicial process, and chances are you won’t follow through.

    I would like to know if there is some sort of secret signal the cop can give the dog to cause the dog to alert on your car? Some time back they tore my truck apart looking for whatever the dog alerted to. Even made me open the toolbox in the bed of the truck. I don't do drugs, so I knew the truck was clean. But the dog still alerted.

      After alerting, a K9 is often given a toy, a treat or both. So the dog is conditioned to alert, even when it doesn't detect an odor.

    A friend was stopped for a cracked windshield. Was not cited for that. Cop smelled weed. The drug dog was called. She was arrested and spent the weekend in jail despite being the primary caregiver to the severely autistic grandchild. Between her husband and myself we managed but the grandchild was clearly having problems without her grandma. The smell of alcohol is given protection but not weed. And the windshield wasn't dangerous or obstructing the view. Had they been in a higher income bracket the windshield would have been fixed, thus, no police stop. Windshield is used to profile. Eh?

      Sorry to hear what happened to your friend. Ultimately if the police see any traffic violation, that includes broken tail lights, or outdated registration tags etc., they have a basis to stop you, but only for a traffic violation. From there, they simply cannot keep the person detained for longer than what is required to issue a traffic citation unless they have reasonable suspicion of criminal activity. Hope this helps!

    I want to create a school that trains and certifies k9’s to sniff out corrupt cops, and have that serve as probable cause for an investigation into everything about their lives. We’ll dig and dig until we find some charge to pin on them. Just as the police say, everyone breaks the law in some way, we just have to figure out what YOU did. Let’s see if they find that fair.

    So what if the cops calls for canine and deliberately slows the writing of the traffic citation so that the k9 unit shows when he finishes?

      A cop has to justify his delaying a stop. Subpoena video. If he were doing anything other than writing the ticket, you'd have a basis for a lawsuit/suppression of evidence.

    Ok , So if im not mistaken, the S.Court said a dog can sniff around your property without a warrant, because its free airspace.
    My question is once this "K-9 Police Officer" made contact or maybe even interred your property, hasnt the dog gone past the "free airspace" ?

      Technically, the K-9 officer cannot enter your items, otherwise that would be an unlawful search. They can sniff around your items if an officer would have a lawful right to occupy that space. For example, the K-9 dog can sniff around a car but cannot enter a car to sniff otherwise that would be an unlawful search.

      However i should have been a bit more clear, Im talking like when the dog or even handler makes phyisical contact with your car outside or inside , such as when the handler touches the spot he wants the dog to sniff or when the dog jumps up on your car. / Im sorry, i guess i didnt absorb all that was in your reply, just the same , if the dog or handler makes physical contact even on the outside , for all we know the dog and or handler has contaminated the car, seems reasonable that they have probably been around illegal substances.
      Not trying to nit pick , just asking.

    A man is pulled over for speeding. The cop asks for licence, registration and insurance.
    The man replies oh I don't have a license. It was revoked after my fifth DUI.
    Also this isn't my car. I stole it.
    The cop exclaims you stole this car?
    Yes officer he replied but I think I saw the insurance in the glove box when I put my gun in there.
    The cop exclaimed there's a gun in the glove box?
    Yes says the man, I put it there after I shot and killed the owner and stuffed her in the trunk.
    There's a body in the trunk the cop exclaimed.
    The man is placed under arrest.
    A supervisor had arrived. After checking the man's wallet he had a driver's licence and it was valid.
    They carefully opened the glove box and didn't find a gun.
    There was insurance regulation in there.
    The car was his and insured.
    Carefully they opened the trunk.
    There was no body in the trunk.
    The Sgt questions the man.
    The officer who stopped you reported you told her that your licence was revoked, you had a gun in the glove box, killed the owner and stuffed her body in the trunk?!
    The man replies yeah?and I bet she told you I was speeding too!

      Great Question! Every situation is different but the entire police encounter from start to finish counts. All that is simply required is that the police officer not delay the traffic stop any further than what is necessary to issue the ticket. If they delay releasing you from the traffic stop simply to get a drug dog, then it may be infringing on your Constitutional rights.

    I can answer that question in the title without even watching the video, The dog violates the people's rights when it can't get up on the stand and be sworn in for questioning... People have a right to face their accuser, at least according to law. Dog and accuracy is in the high 80 percentile... Doesn't sound reasonable to me.

    If you kill, hit, or injure a police dog you will be charged as the dog is an "officer" but the dog can search your car without a warrant. How is this legal. The dog is a officer one minute and is not the next.

    I have a question: to day I was in a cargo storage at a NY area airport to pick up food item from Africa. There were about three cars lined up at the entrance of the cargo open to load the boxes. Then I noticed a k9 officer exit the airport side of the cargo station and walked around sniffing the cars. We are not inside the airport. Are they allowed to do that without asking? What if the k9 signals a hit? I don’t have a problem they run the k9 around the actual cargo item but why random cars who came to pick up? Is it legal to do so?

    I don't do drugs, but with marijuana being legal in many states, what if someone was smoking in their car on their property and later pulled over and the cop says they smell marijuana?

    Also, it seems to a trend but cops will "Aledge a traffic infraction" such as failure to come to a complete stop while exiting a drive just perform a pretextual stop never intending to issue a ticket only a warning. Then they pull the i smell weed can i search bs. Could the officer be charged for falsely pulling someone over if they write a traffic warning if i have dash camera showing i stopped? Or is it not considered offical document?
