Did a detective come to your house? Did you receive a phone call from a detective? You found out you have a warrant for your arrest - what can you do now?
Let's examine a few options you have if you learn you have a warrant for your arrest:
You could handle the warrant on your own - how would this work? You would need to call the police department and determine the warrant number and the bond amount. You would then need to locate an honest and reliable bondsman that can help you schedule a time to turn yourself in to jail.
If you find yourself facing a warrant in the North Texas area, you would want to turn yourself in to the county jail facility. We recommend turning yourself in early in the morning - 5am or 6am. By doing this, you will ensure that you are seen by a magistrate judge the same day so that a bond can be set.
One of the most frustrating aspects of turning yourself into jail is the time it takes to be released. If you process in through the Tarrant County or Dallas County jail, it is not uncommon that it can take 24-72 hours to be released from custody. It is important to know this before you turn yourself in so that you can plan accordingly.
A second option would be to hire a criminal attorney to assist you - what can a criminal lawyer do? The first step for a criminal attorney would be to contact the detective who issued the warrant and have a determination if the warrant can be recalled. There are rare instances where evidence of innocence can be provided to a detective and a warrant may be recalled. If this is not an option, your attorney can obtain the warrant information and recommended bond amount and help you schedule a time to turn yourself in.
Depending upon the crime, you may be eligible for a walk-through or waiver of magistrate. In Texas, you are required to turn yourself in on an active criminal warrant unless your attorney is able to obtain a waiver of magistrate. Essentially, a waiver of magistrate allows someone to perform a walk through at the jail where they are never arrested and booked in at the jail. Instead, you meet at the jail, fill out some paperwork, and you are released.
Alternatively, you could work with a criminal attorney that is also eligible to post an attorney bond. Under Texas criminal law, a criminal defense attorney that has surety through a county can post a bond for their client. At The Hampton Law Firm, we provide attorney bonds for clients in Fort Worth and Tarrant County, Texas.
Finally, how does the book in and book out process in jail work? As mentioned earlier, it takes 24-72 hours to bond out of jail in most cases. However, depending upon the severity of the crime, the judge may require you to have restrictive bond conditions. One of the most common questions we receive from clients is whether the bond conditions can be changed or amended? That is always a possibility but the only way for that to happen is to have a criminal lawyer file a motion to modify bond conditions and request a hearing to have a ruling on the request. At the hearing, your lawyer can present evidence establishing the bond conditions are unreasonable and possibly receive a modification.
For example: many Texas counties will place a bond condition that the defendant is not permitted to leave the county they were charged in. What if you live in another state? What if you must travel back and forth for job reasons? This is a good example of where you criminal attorney can file a motion to modify the bond conditions and amend your conditions to allow for travel.
Finally, how long until your criminal court date? This process can take anywhere from a week to a year before you receive a court date. However, it does not mean that work is not being done behind the scene by the district attorney's office on your case. It is critical to work with an experienced and aggressive criminal lawyer to ensure that your rights are being protected and ensure a way to have your criminal case dismissed.

I suggest if the police come to detain or arrest you , immediately plead Habeas Corpus by saying " I plead the writ of Habeas Corpus, as per section 1 Article 9 of the Constitution of USA " then remain silent untill you get legal counsel . Do not answer incriminating question . Donot talk to other prisoners about your case or details , because they are planted informers, who will bear false witness against you in court .

Hi Jeff, just wanted to say how much I enjoy your videos. A lot of the information I already knew, as I spent many years in law enforcement in two states, however I have also learned quite a bit from you as well. I was wondering if you are licensed in any other states besides Texas? I'm sure you know that it is extremely difficult to find a good criminal defense attorney when you need one and have never needed one before. It would be great if you would do a video on how to find a good attorney in the extremely high stress conditions if you have been arrested. Thanks for all the great educational videos!!

In California I had gotten a ticket back in 2018 I went to court on my day n chargers weren’t filled yet, then the courts were closed n so I thought it was just dropped. Bcuz of the fact that I wasn’t driving I was pulled in a empty parking lot in country eating my food n charging my phone bcuz I was loss n about 8 highway patrols had came behind me n asked me what was I doing n long story short 5 different officers did the sobriety test on me n I was polite n I told them I would take off my contacts, I told them that I had just taken a small piece of my anxiety meds. Bcuz I was going to be late n I was lost they said they were going to take me to check my blood they had my car impounded. They put me in front seat of the cop car with my handcuffs in front of me n drove me around from 7 to 1200am then they took my blood n then they took me to the jail n they booked n released me. (I DIDNT EVEN HAVE TO DO THE WEEKEND THAT I WAS ORIGINALLY ORDERED TO DO) n since that day I have been pulled over for driving w license suspended, n I also made me a court date so that I can do my dui classs for a dui that I got in 2011, n when I went to dmv no warrant was never found it said that I had to pay a fine for this case, n I was doing my dui class for this case was included! Now all of the sudden I got pulled over they said I had a warrant n cited me out I went to court n judge wanted to remand me bcuz she said I had a fta , so she has me on a drug patch and a alcohol breatheralizer, n 3 na/aa meeting a week I have spent 685 on this patch n gas going back n forth to court n this is only to stay out of jail to fight this case, n plea bargain is that I do a program n I do 30 days in jail. N I have a lot of medical problems n I have to pay every 15 days85 to change my patch ! N none of this goes towards my sentence if I’m found guilty, but I want to fight this case bcuz when I took my medication I got on freeway n got off freeway n parked bcuz I was lost n I needed to charge my phone

what is the point in USA of arresting and taking away liberty before sentencing, for crimes that do not represent a danger to society, or even for which the judge then gives a fine. for calm people who have no chance of escaping or committing violent crimes?? Why isn't a court summons enough? What is the point of doing 2 nights in prison without a sentence from a judge, for pushing a person at a bar, or for breaking the mirror of the neighbor's car? or for tearing up the flowers on the neighbor's property
    Italian constitution say:
Personal freedom is inviolable. No form of detention, inspection or personal search is permitted, nor any other restriction of personal freedom, except by reasoned act of the judicial authority and only in the cases and methods provided for by law.
In criminal prosecution, the police is directly dependent on the judicial authority and no other authority.
The magistrate directly conducts criminal investigations.
Only the magistrate can bring charges.
The police depends on the government and hierarchical superiors only for public order tasks.
    Not in criminal prosecution.
The law specific all the cases in witch is mandatory a police arrest and the cases in witch is optional at discretion.
Art 381- mandatory arrest Judicial police officers and agents has a duty to proceed with the arrest of anyone caught in the act of a committed or attempted voluntary crime for which the law establishes the penalty of life imprisonment or imprisonment of no less than five years at least and a maximum of twenty years.
Art 380- optional arrest in flagranty Judicial police officers and agents have the right chose if arrest anyone caught in the act of committing a voluntary crime, whether committed or attempted, for which the law establishes a prison sentence exceeding a maximum of three years or a negligent crime for which the law establishes a prison sentence of no less than a maximum of five years
Art 349- detention for identification of suspects or testimonies.
If the person under investigation for a crime or the people who witness a crime refuse to be identified or provide personal details or identification documents in relation to which there are sufficient elements to believe that they are false, the judicial police accompanies them to their offices and detains them there for the time strictly necessary for identification and in any case no later than twelve hours or, following oral notification to the public prosecutor, no later than twenty-four hours, in the event that identification is particularly complex.
Art 384- detention out of flagrant cases.
Even outside of flagrant cases, when there are specific elements which, also in relation to the impossibility of identifying the suspect(1), lead to the belief that the risk of flight is well founded(2), the public prosecutor orders at police the arrest of the person seriously suspected of being crime for which the law establishes the penalty of life imprisonment or imprisonment of no less than a minimum of two years and a maximum of more than six years or a crime concerning weapons of war and explosives or a crime committed for the purposes of terrorism , including international, or of subversion of the democratic order.
The judicial police also proceeds to arrest on their own initiative only if the suspect is subsequently identified or if specific elements arise, such as the possession of false documents, which make the risk that the suspect is about to flee and it is not possible, due to extreme emergency situation, wait for the public prosecutor's decision
For all the rest of crimes the police arrest is forbidden.

Texas police officers out of retaliation attempted to transport and extradite me to Arkansas without a hearing, any authorization by the courts or the knowledge of the police department. Is such act a violation of my 14th Amendment and violation of the Texas Uniform Criminal Extradition Act?

this is bad advice, at least in Massachusetts, my home state. You should call a courthouse, the court clerk, rather than the police, and if you have warrant, for something that that they're not likely to take you into custody, go into the courthouse and speak to the court clerk and have her put you on the docket to see a judge. you don't need a lawyer, you don't need a bail bondsman, provided that it's not something serious. the judge will set a date for you to appear before a judge to start the case. (I know this because I've done it, including one time when police detectives called me and asked me to come in, just to talk, supposedly about something else, where it was plausible, not that I believed it, that they might want to talk to me. I asked if I had a warrant out, and they lied and said that I didn't. I didn't go in, to the police station, assuming that they'd arrest me, but instead I did what I said anyone, in Massachusetts, at least, should do, which was that I called the court clerk and went in, the next morning, and appeared before a judge. AND DON'T do it on a Friday, because if the judge, or the police, arrest you, you very well might spend the whole weekend in jail.

    • @hamptonlawfirm
      @hamptonlawfirm  Před rokem

In most states, that is not how it works. If you got a court clerk for a Class B Misdemeanor or greater offense, you will be arrested. If you have a speeding ticket, it is a different story.

    • @mikechristian-vn1le
      @mikechristian-vn1le Před rokem

@@hamptonlawfirm thanks for responding. Like I said, in Massachusetts, the court clerk just puts you on the docket to see the judge that day, if you go in the morning, and the judge withdraws the warrant, but maybe only if it's a bench warrant, and gives you a date to come back on. however, I wonder if, even in Texas, if it's possible to call the court clerk, to as if you have a warrant out, instead of the police and instead of getting a bail bondsman to find out for you.

We have a saying here in Australia that police and judges use a lot: "You do not need a lawyer if you plan to tell the truth." If you lie in court, both you and your lawyer could go to jail for that, let alone the original alleged offence.
In order for an arrest warrant to be issued here and also in the USA, the police or prosecutors have to present their evidence of your misdeeds to a judge, and the judge has to be satisfied that the case if it goes to trial, will lead to a conviction. That's pretty simple stuff.
Lawyers in the USA make a lot of money out of scaring offenders that unless they use them, they will go to jail, when in 80% of cases they will anyway. The first thing a lawyer here asks a client is "did you do it?" It's a yes or no answer. If you say yes, then you plead guilty and you don't need a lawyer. It's the judge's job to make sure your penalty is appropriate. If you lie and say no, then the truth will come out anyway and you have wasted your money.
Criminal lawyers are the biggest scam artists in the USA.
