    I was able to secure a security clearance with a non-violent misdemeanor and work federally, but I have been declined simple jobs such as collecting tickets at a ball game, and denied apartments to where I was forced to the streets for some time. Honestly I'm not sure what to do.

      I cannot give you legal advice. But, it sounds like you need to get the conviction expunged. In Oregon, there’s lots of lawyers who do this, like: lohrkelaw.com

      If it was your first time committing a Misdemeanor you would qualify for ARD. It's a probationary period. Still be on your record but it would indicate you were found not guilty not you pleaded guilty. After the ARD process your record is clear. ATTY@LAW.369

    Having a Misdemeanor and getting a job.
    First be honest about your background before the company tells you that your background check failed.
    Second sell yourself, your skills and state anything that would make you stand out after telling them about your Misdemeanor or Felony.
    Third follow up after an interview.
    This makes an employer remember you and increases your chance significantly of getting a well paid job.

    I also think it depends on whether they like you or not and willing to give you that chance also whether the misdemeanor relates to your job responsibilities or not. More skilled jobs with professional licenses may be of concern.

      I explain in the video that most people are able to have their convictions set aside after a certain period of time. That’s why I say it won’t ruin your life. Please talk to an attorney if you have further questions about setting aside a conviction.

    So will a First degree Misdemeanor charge affect my ability to purchase firearms?

    • @clootenlawyer
      @clootenlawyer  Před 2 lety +3

      I’m not sure what state you’re in and this is not advice. Is it a charge or a conviction? If it’s just a charge, talk to an attorney in your area to know your rights.
      One option will be to contact the DOJ before applying for a handgun purchase.
      You may consider a petition to the court to set aside the conviction (arrest) and seal the record. In Oregon, this is referred to as expungement. Once the conviction is set aside, the conviction is “deemed not to have occurred,” and you may answer all questions about it under oath as it it never happened (on the firearm application). Take a look at this guide: www.oregon.gov/osp/Docs/PrePurchase%20SelfAssessmentQuestionnaire_06-30-2020.pdf
      As you see, not all misdemeanors in Oregon prevent you passing the background check.
      A misdemeanor does not tend to affect a person’s ability to legally acquire firearms in Oregon, but certain misdemeanor convictions of domestic violence or a violent misdemeanor can and often does.
      Please talk to an attorney for additional
      questions. Thank you!

    I just found out I have a reckless driving misdemeanor from driving through Virginia. No previous criminal or driving record. The state trooper told me to just pay the fine and I never received a notice in the mail to appeal. Virginia don’t allow for expungements of traffic violations. Is there anything I can do? This is making me sick.

    • @clootenlawyer
      @clootenlawyer  Před 10 měsíci

      I am not licensed in Virginia. I’d recommend talking to a Virginia attorney. In Oregon, you could motion to vacate the default conviction then try to work out a diversion with the prosecutor.
