    Atty. What if the employee is on his rest day the day immediately preceeding the first holiday, is he entitled to his holiday pay?

    Meron lang po sana akong clarificatory question…
    Under Art 229 LC, decision of LABOR ARBITER reinstating the employee is IMMEDIATELY EXECUTORY even pending appeal.
    Ang tanong ko po - What if LA ruled in favor of employer thereby upholding the legality of dismissal. However on appeal, NLRC reversed the decision of LA. It ordered reinstatement of employee. Is the decision of NLRC on appeal ordering reinstatement likewise IMMEDIATELY EXECUTORY even pending appeal to CA? Thank you very much in advance po.

      that is different. you need to ask for a writ of execution when the decision of the NLRC becomes final and executory. ang covered lang kasi ng Art. 229 ay decision of the LA at hindi ang decision ng NLRC on appeal

    Sec 26. Regular Holidays and Nationwide Special Holidays. 1. Unless otherwise modified by law, order or proclamation....
    Ibig po bang sabibin, the president can modify these holidays through issuance of presidential proclamation? Specifically December 31, malapit na po kasi 😊

    Atty, you said that if there's brownout for 20 minutes, bayad pa din ng employer. Paano po nowadays na marami nang naka WFH. Nagbrownout mismo sa bahay nung employee kung saan nandun yung computer na provided ng company. Bayad pa din po ba?

    Hello Atty.! Would just like to ask, yung case po ng JR college vs NLRC na binanggit nyo dto about holiday pay for private school teachers, would this apply to other enployees? Like office employees, as long as covered ng Labor Code? Thanks po

    Sir, question po. If employment contract provides for, say, 6-hour normal working hours, then the employer asked the employee to work for 8hrs for two months. Is the employee entitled to any extra pay for the 2-hr extra working hours? If yes, ano po tawag doon sa extra pay? Sorry po.

      thats not what the law provides but if the parties agreed so be it. their agreement is their law. there is no term under the law because overtime work is normally after eight hours. let us allow the parties to call it the way they want in their contract

      naku wag ka maniwala dyan karapatan mo magbackout kung ayaw mo hindi ka pwede ipakulong ng dahil lang dyan. sila ireklamo mo sa POEA para mabawi mo ang naibayad mo pero yung nagastos nila sa processing ng papers mo pwede naman nila ibawas dun

      pwede kasi nakalaayy yan sa Art. 92 ng Labor Code...
      In case of actual or impending emergencies caused by serious accident, fire, flood, typhoon, earthquake, epidemic or other disaster or calamity to prevent loss of life and property, or imminent danger to public safety;
      In cases of urgent work to be performed on the machinery, equipment, or installation, to avoid serious loss which the employer would otherwise suffer;
      In the event of abnormal pressure of work due to special circumstances, where the employer cannot ordinarily be expected to resort to other measures;
      To prevent loss or damage to perishable goods;
      Where the nature of the work requires continuous operations and the stoppage of work may result in irreparable injury or loss to the employer; and
      Under other circumstances analogous or similar to the foregoing as determined by the Secretary of Labor and Employment.
