This legal advice isn't true in TX and several other states that have prima facia speed laws. I pass cops all the time above the speed limit (while driving reasonably and prudently) and never had an issue

In Idaho the law is as long as the vehicle you are passing is going below the posted speed limit, you can accelerate to 15mph over the posted speed limit to get around them but you must slow down to the speed limit as soon as possible. This is to reduce accidents by getting people out of the oncoming lane of traffic faster without “speeding”

Damn. That’s harsh. Here, where I live, it’s something inbetween a speed limit and a speed suggestion. You have to make sure that traffic runs smoothly and if you need to speed up by 5-10 or slow down by 5-10 to achieve that, then it is suggested to do so. Normally, they let people get away with it (5 mph is the buffer in US as well), but in this case it seems that, because she went out of her way to go in front of the police car whom was going the speed limit, that that's what the problem was. She even moved into the opposing lane, wrong way driving just to cut off the police car, breaking the law and flaunting the behavior. It was more about going out of your way to break the law than going a little faster than the limit.
When I was in drivers Ed doing my behind the wheel classes, the kid I was partnered with was driving and I was in the back, and he went 30 in a 25. The instructor told him to slow down. He confidently said “oh my dad says you can legally go 5 miles over the speed limit.” She slammed on her brake and looked over at him and said “child, it’s called a speed LIMIT” and he was so quiet for the rest of the ride. My driving instructor years prior even had us practice safe passing on said high2/6: with yellow lines. Double solid means no one can pass. Solid side with opposing dashes means the opposing lane can pass. Solid side with close dashes means your side can pass. Single dashes means that both lanes are legal to pass in that stretch of road.

Depending on the state of which it happened, some states have whats called a Passing law which states that a vehicle can overtake so long as its within a 5 mph area. So depending on the state going 60 in a 55 to overtake would be legal if passing.

As a truck driver I was on an interstate, the cop was doing 40 in a 70. Unsure what to do, I stayed behind him but seen no danger ahead and passed him. He pulled me over and gave me a DOT inspection which luckily I passed with flying colors. No tickets I was so confused because going 40 is also too slow for the interstate 😂
Your also supposed to adjust your speed for roadway conditions, such as weather. Many states have statutes governing this. You must adjust your speed to what is reasonable and proper. On a rainy wet road requires a reduction in speed.

Depends on local laws... Washington RCW 46.61.425 states that you can exceed the posted speed limit if passing someone driving at less than the posted speed limit and only on highways having only one lane in each direction. You still need to drive at a safe speed and only exceed the speed limit for the distance to safely complete the pass. Considering the rain in the video the cop could say that any excess speed is unsafe. But that's up to interpretation. Personally I'd say its unsafe for my driving record to pass a cop.

Most people go 5-15 slower in the snow (or more depending on the snow), but if you put snow tires on a vehicle, you can do the speed limit without hesitation. With decent tread on your tires, going the speed limit in rain shouldn't be a problem (unless it's a downpour). "Adverse weather conditions" just means you should expect to arrive at your destination later than expected and be more cautious than dry conditions.
In Florida where that took place the speed limit applies under optimum conditions, if there’s bad weather the law says you must slow down below the limit to a safe speed.
In Alabama's basic speed law provides that you must never drive a vehicle at a speed that is faster than reasonable under existing conditions. Which means on a clear dry day I can go 60 in a 55
It's also raining, which means that going 55 probably isn't a good idea and even though they can see in front of the cop's car, they were probably driving a bit too close for the condition. You never know when the car in front of you might just lock up their brakes.

In Idaho the law is as long as the vehicle you are passing is going below the posted speed limit, you can accelerate to 15mph over the posted speed limit to get around them but you must slow down to the speed limit as soon as possible. This is to reduce accidents by getting people out of the oncoming lane of traffic faster without “speeding”

If the speed limit is 45 and the car in front of you is going 45, you cannot pass. If they're going 40, then you can pass if it can be done safely at 45mph. Some police allow another ~5mph buffer, but legally you cannot exceed the posted speed limit.

Damn. That’s harsh. Here, where I live, it’s something inbetween a speed limit and a speed suggestion. You have to make sure that traffic runs smoothly and if you need to speed up by 5-10 or slow down by 5-10 to achieve that, then it is suggested to do so. Also not take any unnecessary risks in traffic
Normally, they let people get away with it (5 mph is the buffer in US as well), but in this case it seems that, because she went out of her way to go in front of the police car whom was going the speed limit, that that's what the problem was. She even moved into the opposing lane, wrong way driving just to cut off the police car, breaking the law and flaunting the behavior.
It was more about going out of your way to break the law than going a little faster than the limit.
When I was in drivers Ed doing my behind the wheel classes, the kid I was partnered with was driving and I was in the back, and he went 30 in a 25. The instructor told him to slow down. He confidently said “oh my dad says you can legally go 5 miles over the speed limit.” She slammed on her brake and looked over at him and said “child, it’s called a speed LIMIT” and he was so quiet for the rest of the ride.

My niece is married to a former cop. He said he generally ignored anyone doing no more than about 9 MPH over, but if you were speeding and passed him - you were getting pulled over and getting a ticket.

My driving instructor years prior even had us practice safe passing on said high2/6: with yellow lines.
Double solid means no one can pass. Solid side with opposing dashes means the opposing lane can pass. Solid side with close dashes means your side can pass. Single dashes means that both lanes are legal to pass in that stretch of road.

@Santa Clause in 49 states you can ALWAYS get a ticket for exceeding the speed limit by one mile per hour. Only Florida is different; you can get stopped for going one over but can only be given a ticket for six or more over. That is, unless you’re in a construction zone or active school zone

Also, passing on a road like that is not always dangerous. If the opposite side is clear of traffic, then it is safe to pass. Depending on the state of which it happened, some states have whats called a Passing law which states that a vehicle can overtake so long as its within a 5 mph area. So depending on the state going 60 in a 55 to overtake would be legal if passing.

As a truck driver I was on an interstate, the cop was doing 40 in a 70. Unsure what to do, I stayed behind him but seen no danger ahead and passed him. He pulled me over and gave me a DOT inspection which luckily I passed with flying colors. No tickets I was so confused because going 40 is also too slow for the interstate 😂
Your also supposed to adjust your speed for roadway conditions, such as weather. Many states have statutes governing this. You must adjust your speed to what is reasonable and proper. On a rainy wet road requires a reduction in speed.

Depends on local laws... Washington RCW 46.61.425 states that you can exceed the posted speed limit if passing someone driving at less than the posted speed limit and only on highways having only one lane in each direction. You still need to drive at a safe speed and only exceed the speed limit for the distance to safely complete the pass. Considering the rain in the video the cop could say that any excess speed is unsafe. But that's up to interpretation. Personally I'd say its unsafe for my driving record to pass a cop.
In California we have another law in the vehicle code, "no faster than is safe". Over the speed limit pass in the rain would be unsafe.

@@benjamincho4819 Speed limit does not change based on weather conditions. Every vehicle is different and handles different in weather conditions. Most people go 5-15 slower in the snow (or more depending on the snow), but if you put snow tires on a vehicle, you can do the speed limit without hesitation. With decent tread on your tires, going the speed limit in rain shouldn't be a problem (unless it's a downpour).
"Adverse weather conditions" just means you should expect to arrive at your destination later than expected and be more cautious than dry conditions.

Some states actually have it written in law that you can exceed the speed limit by a small amount (I think up to 15 mph) when overtaking.
In Florida where that took place the speed limit applies under optimum conditions, if there’s bad weather the law says you must slow down below the limit to a safe speed.

It's also raining, which means that going 55 probably isn't a good idea and even though they can see in front of the cop's car, they were probably driving a bit too close for the condition. You never know when the car in front of you might just lock up their brakes.
