The IEC does not create parliament by mere announcement of the election results. The elected person MUST be sworn-in as members of parliament. Upon taking oath of office, it is then or only then are they members of parliament (MPs). Just like a president-elect is not officially a State President until he or she is sworn in.
The National Assembly is not constituted if it has less than 350 members. Hence, there shall be no lawful parliament if the National Assembly does not consist at least 350 members.
Section 53 quorum only kick-in after the elected persons on the party-list take the oath of office, that is become MPs.

All these people are too short sighted. Think a bit farther ahead and see whether those selections will have any stability or not. No she's not. The 350 number has nothing to do with swearing in. It's the minimum number that has to be set out in legislation to be elected. The legislation as written sets the size of the National Assembly at 400, and 400 members were elected on 29 May, so that threshold is met. The National Assembly is still composed of 400 seats even if some of them are left unfilled because people refuse to or are unable to take up their seat. Refusing to be sworn in doesn't mean the seat you were elected to doesn't exist anymore.
