The bike overtaking is legal and is right. The driver is in the wrong because he did not check his blindspots and didn't use his turn signals.
Its not a Overtake, the biker was lane splitting and almost on a oncoming traffic lane. The driver has the right to use all the way he is occupying. He didnt crossed the middle line to pass the bicycle. Biker is wrong.

18:30 What this biker did, is forbidden in Poland. If the vehicle is moving even 5 km/h, it is not allowed to overtake it with a motorcycle. And suddenly he quickly positions himself right in front of the car. If he had shown the video to the police, he would have been punished.
