Kimberlé Crenshaw: How Society Embraces Male Denials, from Clarence Thomas to Brett Kavanaugh

  • democracynow.org - When President Trump’s Supreme Court nominee Brett Kavanaugh testified last week before the Senate Judiciary Committee, he called Dr. Christine Blasey Ford’s accusations against him and the subsequent fallout a “circus” orchestrated by the Democrats. His language echoed Clarence Thomas, who nearly 30 years ago said of the Anita Hill trials, “This is a circus. It’s a national disgrace. … It is a high-tech lynching for uppity blacks who in any way deign to think for themselves.” We speak with Kimberlé Crenshaw, professor of law at UCLA and Columbia University who assisted Anita Hill’s legal team. She is the founder of the African American Policy Forum. Her piece for The New York Times last week was headlined “We Still Haven’t Learned from Anita Hill’s Testimony.”

    The employment of Mitchell was even more disgraceful and craven by Republicans. It reeked of mysogyny and not the "dignity" they kept allegding to have extended to her. Lindsey Graham claimed "we would've driven out there to speak to you" but they could barely address their questions to her personally during the hearing. What a sham!
    I found it odd that in her report on her thoughts on Dr. Ford, in no part does Mitchell question _why she got to question Dr. Ford for her entire sitting_ but only asked BK roughly 3 questions and was never heard from again.
    Lastly, I believe Dr. Ford.

    For any man who thinks these events in a woman's, or girl's life don't matter after 5, 10 or 40 years, then I dare you to ask any woman you know -- family or friends -- whether they've ever been harassed, raped or assaulted.
    Men and women need to talk one another and stop assuming there's nothing important to say to one another. Because a woman is silent doesn't mean it never happens/happened.

    Dr. Jennifer J. Freyd has coined an acronym - DARVO - which, when seen along with our other checkpoints, can be very helpful in shedding light on our situation. DARVO points to a typical response that perpetrators of wrong doing, particularly sexual offenders, always seem to enact when being held accountable for their behavior. *DARVO stands for Deny, Attack, and Reverse Victim and Offender.* This characterizes Judge Kavanaugh's response perfectly - he totally denied the accusations, went on the attack with self-righteous, indignant rage, and portrayed himself as being the victim of an organized smear campaign and political hit-job. Playing the role of "the victimizer disguised as the victim," he cast Dr. Ford in the role of the offender who has destroyed his life.

      There are so few of them it is hard to know. I have sympathy for anyone falsely accused of a crime, but this particular crime is the most under reported of all crimes. So you tell me what is appropriate.

    I think that the Republicans thought that Dr Ford WAS going to act in the unhinged way Kavanaugh did when she testified. They thought they would be able to portray her as a hysterical woman and dismiss her claims. But when both Kavanaugh and Lindsey Graham go on hysterical rants, their emotion is supposed to enhance their credibility? So. Much. Hypocrisy. And my “favorite” part of Lindsey Graham’s defense of Good Ol’ Boy Kavanaugh was when he asked/told him “you want justice? Boy, did you come to the wrong town!” He’s speaking to a judge who has been a Washington insider for DECADES! In truth, that “sympathy” is much better directed to the West Coast college professor who reluctantly pulled herself from obscurity because she thought it was her civic duty to tell the truth. But Lindsey Graham is unapologetic about being a “single white male” so his concerns are purely for the other entitled white male whose quest for power has been temporarily thwarted.

      Lindsay Graham's concerns are mainly for himself. He wants the Attorney General spot so he was talking to Trump (tho' it was also a good tactic for the team vis-à-vis Kavanaugh's over the top snivelling performance in order to 'normalize' it). Some are also saying that the administration has something on him which explains his conversion from his orginal never-Trumpism to complete lapdog. Or maybe it's just his protector McCain gone, he has to make hay for himself.

      This is clearly a result of the "frat boy" mentality of the 80s. Correct me if I'm wrong, since I was born then so I don't know much about the frat culture mentality, but it seems as though that's how they bought their way into politics, earning a living as lobbyists despite knowingly being highly unethical. Now we have a "frat government-run" system that enables these heinous behaviors most people despise in the fraternity mentality (buying one's own friends, buying one's own career, human indecency).

      The prosecutor came CLOSE (July 1st 1982 , calendar entry, drinking during week !, the names for that scheduled meeting would fit - that could have been the day of the assault. It was also the day when the drinking age in Maryland was raised to ) - so Graham helped with a little distraction and threw the tantrum, then they had a break, and then the Republicans dismissed prosecutor Mitchell.

    Here's a reminder to all potential victims of sexual assault: you better make sure you have "evidence"! Nothing you experience is real without "evidence"! Wear a body cam, keep a stenographer with you at all times and keep legal forms handy to gather signatures of witnesses as needed. I'm sure I missed some steps but you get the jist of it. I know it seems burdensome but we need to make sure men feel safe! Better yet, skip all that nonsense and just DISAPPEAR. Nobody wants to hear you anyway

      mai i guess facts are meaningless when you are a partisan extremist huh? She said that she didn’t want to testify because she is afraid of flying. That was a lie, she flies frequently for work and vacations. She said that she doesn’t remember when this happened, how she got there or how she got home, but remembers exactly who it was. That is sketchy. She says that the music was so loud that when she yelled for help no one heard her, but later said she hear the boys talking downstairs. Everyone of the witnesses, including her friend say either that it didn’t happen or they know nothing about it. Two other males have come forwarded and claimed it was them.
      Like i said i don’t think he should be a justice based on his record as a judge. However, Ford is not believable. Bit then again I’m not an extremist.

They have to have an EXTREME right judge. That ABA disowns. That 1000+ lawyers from his own school disown. They have to slap the MAJORITY in the face. This will ignite a 30 year war. Every election, at every level, voters will be reminded a rapist is on the court because of the GOP. Every day he sits there will be a burning ember that will set fire to 1/2 the US population. It could have been easy. Now it will be a multi generational war. And for what, less worker and environmental rights? The ability of no population Red states like Oklahoma and Idaho to outlaw abortion? MAGA has ripped the country to shreds over virtually nothing but arrogance and petty power.

    Its pretty simple men, who are most likely to be affected by a false accusation are going to be more hyperconcious of it while women who are most likely to be affected by a sexual assault are more hyperconcious of it, that's why you will always have people that jump to either conclusion in these situations, none of us know the truth and we never will so we all try to interject with our emotions on the subject. For men they think this could happen to anyone anyone could come out of the woodwork and accuse you of this and none of us are comfortable with that being wholly believed and the accused gets crucified and loses their livelihood, women aren't comfortable with the fact that they can come out and get second guessed and have to go out of their way to prove something horrific was done to them.

Hope you're not gonna try out for judge because you're already proving you have a pretty limited range for evaluating situations. The best friend cited by Dr Blasey, in whom the latter did not confide at the time, apparently finds the circumstances plausible for having been at such events and she believes her allegations.

    I know nothing about the Clarence Thomas and Anita Hill thing so I’m not going to speak on that. However, I did follow the Kavanaugh thing and from what I saw, there was a lot of inconsistencies in what Ford was saying. Am I not correct? Wasn’t there something with her being incorrect with timeframes and who was there? And she told her shrink and husband about it many years later?
    So, I ultimately don’t know what happened but we have to get beyond mere accusations. Everybody agree with that, right? Everybody agrees that people do make false accusations out of malice intent. This DOES happen and it is why we have processes to examine the details of the case so that people aren’t unjustly punished. I am aware this doesn’t always happen.
    We also know that politics is a filthy, backstabbing game. We KNOW this. People are smeared, falsely accused and killed in the world of politics. So, forget the specific people involved, forget republican/democrat, forget identity politics...just based on what we know happens in politics, we must agree that people will go extreme means to achieve their ends. And so, based on what I saw of the hearings, I wouldn’t feel comfortable punishing somebody based solely on an accusation. ESPECIALLY, knowing the current climate of politics. And I know that pissed a lot of people off but I am trying to be robotic about this.
    I see the Trumpers up in arms about lots of things that they think is wrong. Like, the election. They are freaking out because they say there was widespread cheating. Well, show me the evidence. I’m willing to sit down and put some time into researching and looking into these claims, but if it’s only accusations with no significant evidence then it just sounds like political bs to me.

      And if you really think that the US works on "all men are created equal" you are somewhat naive.

      The US-constituion speaks only of "inalienable rights" - the thought of "egalite" first came some years later in france.
      The fathers of the constituion where all elitistst of some measure.
      Not only did they of course except women, blacks, indians, felons,ct. from voting, but it was a close call - most of them wanted a property-based voting sytsem where rich people had more votes.
      .
      And looking at the modern US with voter repression, completely unrepresented colonial areas with millions of second-class citizens, "citizens united" which equaled money with speech and made black-money-PACs the most important actors in all elections.....
      Animal farm was kind of a literary fable on the east bloc - modern america is the reality of the same rot inside capitalis systems.

    I think society embraces male denials on the basis of an an understanding which is rarely articulated, though it is a theme (perhaps the dominant theme) running through all forms of art, literature, and all over the natural world outside of humanity as well: Women are attracted to violent men, to aggressive men and repulsed by "nice guys". I'm sorry to say it, and correct me if I am wrong, but I can't imagine women having conversations like "Oh I can't wait for the party. I heard some of the guys who will be there do volunteer work and are super polite and respectful". Does a piece of dialog like that ring true to anyone?
    Kavanaugh is obviously a heinous person and it seems equally obvious that he committed the acts of which he is accused. But why can't we talk at all about the demand of women for aggression in men, how inherently dangerous that is to them, and how that shapes society? Men and women evolved as a species together. The reason there are so many male transgressors in the world has something to do with the choices and preferences of women, right?

      It takes two to tango, as they say. I'm just a nice guy who has been told by women (never guys) to "grow some balls", or "put your dick out there", and things like that in response to my polite behavior in every day social situations (I won't argue or fight over things of little or no value). I guess I'm that sucker who bought into how a man is supposed to behave. But the way that men are prodded into being aggressive assholes is seen everywhere, all around us, and is promoted by men and women alike. More or less everything men do is for to win the favor of women, and women are there lavishing their affections on overly aggressive guys. It would seem that that dynamic is behind a lot of behaviors this society fosters. But it's like this can't even be discussed without charges of "you're blaming the victim".
      I don't think this analysis applies to situations where the woman is involuntarily in the company of said aggressor, as in the workplace. But when I heard an actress complain like "and then the second time I went to Weinstein's house for dinner he was even more sexually harassing" it's like well, ok, you like playing with snakes...I hope you don't get bit but if you do it's kinda your fault.

      Dee Pattison I don't want to know women who disapprove of well behaved or sensitive or cooperative men, but that is pretty common. I think most people, myself included, want to live in a world where women are free to go about their lives without fear of being harassed or raped. But that is going to take a collaborative effort. Reforming men alone is not going achieve much.
      The serial killer Richard Ramirez received mailbags full of love letters and marriage proposals from women. And that is not uncommon for serial killers. Many women are aroused by serial killers. That's just a fact about the world that we should deal with in trying to make the world a better place. Both men and women will have to change their behaviors to reduce aggressive behavior in general, not just sexual but other forms of violence. Men have to change their behavior and women have to stop incentivizing it.

    Society does not embrace male denials.
    Half of our society is male. An overwhelming majority of males are not rapey individuals. We support women and want equal treatment for them. However, we also see issues like this with Kavanaugh, and although we don't believe his denials, we also understand that there is no proof of the claims against him.
    As males who aren't rapey, we can empathize and see ourselves in that same situation. Women fear, rightly, being raped. Men fear, rightly, being falsely accused of rape. It's one of the few accusations in our society that can ruin your life with no evidence. And even in the cases where the accuser has been proven to be lying, the accused's life remains in shambles having lost jobs, scholarships, relationships, etc.
    We don't embrace male denials. REAL MEN DON'T SUPPORT RAPIST. Yet, we begrudgingly accept that a lack of evidence exists in most cases.

      We need to have a videographer on hand for these assaults because it is the only way for some people to accept that it happens. See how the system is stacked. My comment is tongue in cheek but meant to cast light on a flawed system. The only way to have evidence is to have cameras all over and lose any privacy that still exists.
