  • @wrongtermmemory

I'm from Glasgow. I love the way Americans say Glasgow, pronouncing the W :) Anyway, people accused of 'hate' can be reported, not only by the person that feels hated, but by someone else that feels that the person who was hated against was hated. So, Jim can report David for saying something perceived as hateful about Matt. This report does not have to have any legal basis other than it hurt someone's feelings, or someone else's feelings. Once this has been reported, the police will investigate, and if it is deemed that there was no actual hate, the police will still keep the report on file as a 'non-hate crime incident'. In turn, this means someone could get rejected for a job for something that was never proven to be true - it was just reported. On the first day of the law being enacted, the most number of reports were against Scotland's first minister, Humza Yousaf, for his racism, and yet there were no 'non-hate crime incidents' lodged against his name. At the same time, a member of the Conservative party had one complaint lodged against him and suddenly had a 'non-hate crime incident' placed on his police file! It's complete madness.

Here is a scenario that I am interested in seeing play out:
Christian person gets asked by a trans-woman if they see the trans-women as a women and that Christian person says "no" and explains why. The trans-woman starts screaming "how dare you" and reports that Christian person for "hate crime" because it hurt this trans-woman's feelings and feels attacked because the Christian said "A women is a biological woman the way God intended" whiles at the same time cussing him out with having apparently "old time views, from some old book." (The Holy Bible)
    Who will be arrested?
    A) Transwomen for selecting person who happens to be Christian and screaming at them showing anger towards their faith and view
    B) Christian sharing their view and faith only raising their voice to be heard and said "biological woman is a real women"
    C) Both for equally not agreeing with each other.
    D) Neither because they realise if they arrest one they need to arrest the other with this law and arresting one or the other causes problems in society.
This "law" is wrong, you can not arrest someone on "hate" purely on its own, there needs to be other actions towards it to become a criminal offense such as but not limited to: physical violence or verbal threats, abuse refusing to employ someone based on that one thing for no reason apart from you hate it. (even the last one can be tricky to prove)
By this "hate law" I guess it means that any woman who turns me down because they don't like short men, I can get her arrested for hate crime against short men. "She doesn't like short men that must mean she absolutely hates short men which is offensive!" and because I then lead on to say "its caused psychological harm" I can now demand money to fix the money lost from not being able to work due to "psychological damages."
..... How stupid does this sound?

My understanding of this law and other dystopian ideas like "non-crime hate incidents" is that the answer is dependent on who reports it to the police. Essentially who identifies as the victim automatically identifies the other person as the perpetrator.
So the Christian because part of the trans movement is praising victimhood above all and claims of g-cide. The Christian most likely wouldn't involve the police.
But yes theoretically it's an absolute mess because it essentially relies on who involves the police first and does the second person make a similar report.
It's also worth thinking about the thought experiment involving sex. A trans identifying male says incredibly misogynistic things about women. If you've heard of A Long Chu think along those lines. The women then politely challenges the ideas of what being a woman means.
      Who goes to jail?
      The woman.
Because sex is not a protected characteristic. Gender identity is even if it is based on an entirely offensive premise.
And until recently she'd be sharing with a disproportionate number of "trans women" who had a history of very specific crimes. She'd be one of only around 200 female prisoners in the whole of Scotland in the one women's prison.

I was born and raised and live and work in Edinburgh. There was never a problem in the good old days…! People stood up for themselves, invoking personal responsibility and, if necessary, seeking help from the good old police force of better times. The ‘hate’ has been started by those misguided and dictatorial enough to actively promote a now authoritarian, divisive, hateful and depressive ‘nanny state’. It’s plainly totalitarianism. There is a general depressive feeling here, a black cloud has descended over the country. This is just the latest in years of cumulative authoritarian oppression. This nonsensical hate- and division-PROMOTING ‘law’ must be repealed and, the way things are going, I expect that to be sooner rather than later.

Wether or not or on the basis of social contract theory, natural law theory or any basic damn sense these laws are reprehensible: constitutional, punitive and administrative laws all have the purpose of regulating the relationship between a government, or better put state, and its citizens. Not some citizens (for people with the right opinion trademark or against people with wrong people (disinformation, hatred etc.)), but all the citizens.
Act within the framework of the law, but do so quickly for a government or state that would legislate like this will turn that framework into a noose, evermore closing around your neck.
