20% रकम भरने के लिए आरोपी के पास नहीं है,ओर न कोई बैंक बेलेंस न कोई स्थावर जंगम मिलकत तो आरोपी के बचाव पक्ष में केस चल शक्ता है या जेल जाने का कोर्ट हुक्म कर देती है।
बहुत सुंदर तरीके से आप ने 1-1 बातों को बतलाया है। जससे बात आईने की तरह साफ हो गई। इस हेतु मैं आप को बधाई देता हुँ।
बस 1 बात मन मे रह गयी है। अगर शातिर आरोपी जान बूझ कर लेट लतीफी के बाद भी कहे कि मेरे पास ना पैसे है और ना ही मेरे पास कोई चल या अचल संपत्ति तो ऎसी परिस्थितियों में क्या उसे जेल होगी । या क्या प्रावधान है कि आवेदक को न्याय मिले। क्या करे आवेदक। उसे कैसे राहत मिलेगी।

Madam Maine ek bande ko 2lakh RTGS kiya hoon aur 9.5 lakhs cash diya hoon sath me agreement bhi Kiya hoon, accused ka 4cheque bounce hogaya hai Maine usko 2legal notice bhi beja hoon uska koi reply nahi mila mujhe toh fir maine NI Act section 138 case file kiya hoon woh agar court me maine cash paisa nahi liya bolega tho kya karna padega? In this case I am complainant, my friend is this case advocate.
I was case filed jmfc NI act 600000 rupees check amount, the judgement was passed accused was convicted with 8 lakh rupees penalty and one year simple imprisonment,
Then acused was apeal that case in session court, that was dismissed.
Then acused was apeal that case in high court of Karnataka kalaburagi bench,
That case is pending I hope that case is 100% dismissed in 2 months.
My question arised now, how to recovery that amount of 8 lakh rupees,
1) continue of old CC case? Or
2) the filing another new recovery case, like as fdp, EP,

If a person lend rs 1 lakh rupees and lender get a blank cheque.after some time lender fill 5 lakh in blank cheque and deposit the same in bank.which resulted bouncing and a case of 138 filed.which is wrong with accused. In this case ehst is your views

Hello Medam, humara bhi ek case last 1.5 years se chal reha hai or usme court ne 20% compositions ka order bhe kar deya hai, lakin abhi tak hume kuch mila nahi hay, August me 60 days complete ho rehe hai, phir bhi agar wo 20% na bhare to court kya action lege? Or hume humare pure paise kese milege?
Yes if Court orders a person has to pay, if the Accused doesnt pays then there will be action for sure

In a another 138 N.I. act case, inspite of many authentic documents in the hands of the complainant, 143a, interim compensation was not given by the court. An order was passed without giving compensation. There is no rebuttal of 139. The Accused having no documents but getting benefitted. He has only reply of demand notice in where false story was given. inspite of this accused getting benefit. huge money cheating case. Now question is::. What is the remady
for obtaining again the interim compensation. what is to be done by the complainant now? sir please 🙏
