That's crazy! My husband is a lawyer he said her lease is valid and no one should enter her apartment without her permission.

Exactly. Even with an eviction, the landlord has to follow the legal process and have the tenant formally evicted and the eviction happens with the sherif. The legal paperwork would have made sure the tenant was notified and served. The apartment owes her everything because it is wholly their fault.
They've done nothing to correct their mistake so far, I'm willing to bet they're going to avoid that at all costs. There's all kinds of slimy stuff they're going to pull, just watch them. Hoping for the best for this lady and her family. But I have no faith in the legal system of Kansas where money talks and it's the only thing those crooks listen to.
I wouldâve owned the whole apartment complex after this mistakeâŠor some people wouldâve been missing

I'm calling the police b/c they illegally removed and discarded my ish idc if it was by accident. WTF??!!! Next thing to do on the list is get a lawyer. And they gonna have a stank attitude in the beginning.
THIS...is not covered under rental insurance. Rental insurance covers flood, water damage, fire&smoke damage, burglary, which none of these apply. She has to sue the complex.
The worse part is that most likely they will only give her the depreciated value of the items: a $1K mattress is worth $200 after it's been used. She is going to have to fight to get punitive damages. In order to punish the apartment complex, punitive damages can exceed the value to replace the items. She has emotional distress too. Sue for all of that.
It's a good thing she didn't have any pets. I would have lost it. Plus I believe they probably kept some of her belongings.

The legal system in Kansas is only going to help the rich. I can see her getting the shaft on this. You know the management company has enough slimy lawyers that they'll figure out a way out of this and she'll be left without.
I hope this encourages everyone to purchase legal plans offered through your employers health benefits package. Its pretty cheap and you always have access to a lawyer. Just a consultantation with a lawyer can run you about 50-100, but if you get the legal plan you can get the basic legal assistance covered. Chile I use it every time I get a ticket, not points for me, hello!

Wow...this happened to me in 2016...turned on my road as I'm approaching I could see that my curtains weren't there and I'm like wtf...get out the car & could see that all of my stuff was gone. I called the police after the neighbor told me who was @ my house...my landlord...showed my current lease and receipts and changed the locks. Next day I'm leaving a friend house and went by my house going to church and caught him there. I called the police back and he was informed to not come on the property again, he couldn't collect rent anymore because it was now a legal matter...I won my case...while I was out of town my landlord stole all of my stuff...he was white...terrible terrible experience. She should NOT have to use her renterâs insurance, her rates will go up if she files a claim. And the apartment complex definitely has insurance so they need to use theirs.

There is no way you could accidentally move EVERYTHING out of an apartment and say it's not your fault.. What her and her followers fail to realize was that it was a crime for them to come into her apartment when you living in an apartment complex they have to give you a 24-hour notice to enter. okay they supposed to have got the numbers confused or whatever that may be but a lot of this it just really doesn't make sense I'm just not understanding how a apartment complex can be that freaking stupid where they have a apartment filled with furniture and food in refrigerator it looks lived in and they just come in and not questioning anything and just start throwing all her stuff away

I think the renters insurance would apply depending on how the state would look at it. Here in Texas it would be considered theft and the insurance covers that but like everyone said just file a lawsuit to get the max

Wait I had an apartment do me like this before but it was my move in they screwed all the way up! They cleaned out 1203 and was supposed to clean 1223. I done cleaned out my entire unit packed my whole house and then upon move into my new apartment and it was fully occupied I almost went into cardiac arrest twice I had to get a whole storage unit and a hotel for a week while they clean out and get new stuff for my real unit! I was livid. Maintenance accidentally put the wrong number on the work order to clean up and turn over!! Girl when I moved in I could still smell the cigarettes and pets from the quick turnaround it was bad but sis definitely got worse treatment than me tho

How in the world does a person/company with even average intelligence go into an apartment totally full of stuff and not realize they are in the wrong unit? I hope she sues for millions. Something wrong....don't they change locks after an eviction? Even if it was a mistake and they thought they were evicting the apartment....it's required to change the locks because if you go in there and you see a person stuff still there then you assume the person would come back so they change locks....that doesn't make sense....
