It was a failure on the lawyers part to make sure their client actually was ‘injured’ by the acts of the government for them to have standing. Just like how I can’t sue because some cop violated your rights. The ‘injury’ didn’t happen to me, therefore I have no standing to sue. In theory, anyone whose social media account was interfered with in any way as a result of making statements contrary to the Administration's position on COVID, Hunter's Laptop, etc. was "injured". Many of those who experienced a reduction in reach, ban, or demonetization directly had their First Amendment rights impaired by the Administration's actions. All of those actions could also be an unconstitutional "taking" because the governments actions restricted the account owner's rights so much that the governmental action becomes the functional equivalent of a physical seizure.
Anyone who was directly injured could therefore have standing to sue the Biden Administration under the First and Fifth Amendments.

Smith-Mundt Modernization Act of 2012 (obama administration) - Amends the United States Information and Educational Exchange Act of 1948 to authorize the Secretary of State and the Broadcasting Board of Governors to provide for the preparation and dissemination of information intended for foreign audiences abroad about the United States, including about its people, its history, and the federal government's policies, through press, publications, radio, motion pictures, the Internet, and other information media, including social media, and through information centers and instructors. If these were good people why should this matter? Only when you have a divided Supreme Court do I question their judgement as to why they voted this way !
It should be unanimous in most cases !

The Congress must act to declare that social media companies are the same as other public utilities. This would require them to serve all of the public equally.

We as a society have empowered social media and big tech to an unprecedented level. Totalitarianism was inevitable, they are in every aspect of our lives on their terms. Cast off the shackles of enslavement, dump social media, smart phones, cars and appliances

Free speech does not cover: endangerment to others, personal threats, insightment to rebellion or riot, slander or libel (private redress allowed), and certain anti-government speech especially during war time.

Show me the part in the first amendment which supports your theory? The Founders intended you to be free to speak especially about politics but people love to post straw man arguments about things that have nothing to do with the case. We MUST be free to say anything and Responsible if we LIED.

I not a conservative by any means, but allowing the government to pressure social media companies to dictate what is and isn't true seems like a bad idea. The government and private companies shouldn't have control over the public forum.
