We know lawyers have to somehow defend their client, but when you have lawyers and American Airlines trying to shift the blame onto a 9 year old girl, it's a whole new level of scummyness.

The bathroom is a place where you expect privacy. It’s not like being out in public. Yes you’re still in public, but you’re in the restroom. Nobody should have cameras in the restroom, definitely not if somebody’s in there.

Honestly, it wouldn’t be that weird if an attendant said, “Here, use the 1st class bathroom” to me. I would just assume they were trying to be friendly, control traffic, or deal with a maintenance issue. So to expect a 9-year-old to pick up on any subtext is ridiculous. We’re trained to trust these people because they’re the ones meant to keep us safe while traveling 600 mph at 30,000 feet in the air and boxed in with 100+ total strangers.

These types have a verrrry hard time... because the 1st thing inmates do when you go in is demand to see your papers to see what type of charge you are in on.

The response the airline took is truly bizarre. I could see them challenging the suit by asking how they were supposed to know, since asking about what someone’s sexually aroused by is not an acceptable job interview question. Unless they failed to do a background check that would have revealed prior sexual misconduct convictions, it should be a slam-dunk defense that they hired someone who gave them no reason to be suspicious.
What’s really messed up is that THEY CRAFTED THAT DEFENSE FOR THIS CASE. This isn’t a case of leaving in generic, boilerplate language about customers being aware things could go wrong. It’s specifically stating a child should have known better about the possibility of being illegally recorded.
