The alleged crime is violation of NY penal code 175.10. The elements are that the defendant 1) falsified business records, and 2) did so with the intent to defraud that included an intent to commit another crime or to aid or conceal the commission thereof.
“Beyond reasonable doubt” is the legal standard of the burden of proof, and I don’t know how anyone concludes from the evidence and testimony provided thus far that there is no reasonable doubt in either of the two essential elements of the crime. Therefore, the jury must acquit.
