He knew who did it & hadn't told Tony. & as far as I know, The Hammer's worthiness is determined by the user. To answer the question, it is a different hammer. Half the movie was about the forging of the new hammer. The old hammer was magicked by Odin for Thor, so only he could use it. Odin is dead, so the new sword can be used by anyone.
