    omg thank you !! especially the part you said "dont go quiet into the night". I feel a lot better after watching this, i never made any request of theirs easy, pissed them off my family begging me to stop fighting them and to just do as they say to get my kids back even vendors telling me doing as they say is the fastest way to get cps out of my life and get kids returned, i went with my heart and what felt right to do and was starting to loose hope, not anymore! sorry im ranting but just thankful to ur video! Renewed and ready.. got trial/final in August

      I'm so glad you found benefit from our video! Definitely, do not go quietly, but don't forget who you are fighting FOR. It's not enough to simply fight because beating CPS doesn't necessarily mean that you win. Fight for your kids and do whatever it takes to get them back.
      Save your kids from the system first, and then you can fight to bring CPS down. 😁

      This is absolutely abuse of power. My children's fathers family worked with CPS and had access to files. They have kept my kids away from me illegally for years. I was the protective parent but my children and i were put through un necessary trauma and basically....denied my constitutional rights among other things. It's so corrupt that I couldn't get an honest lawyer in my area that could be trusted. It sounds unbelievable but it happens every day to good parents.

      They take your kids & your rights & claim you got no rights! They furnished a warrant on me with no evidence or anything.......came in my home when I wasn't there/threatened me to bring my kids or they where pressing charges over the phone/the next day pinged my location & took my kids & put them under the states custody & tried to drain my resources & put me through hell for a year while I took care of my kids & I won them under my custody now I want to file a civil suit........Does anyone know a good lawyer to take on on my case please let me know .....I got documentation & time line & a video

    Had 3 caseworkers as a new mom while I was the “protective parent” and they all failed to show up to their subpoena. CPS is a total failure and needs a role reversal investigation!!

      That is insane! How are they not going to show up for a case that they started?
      CPS needs to be torn down to the last brick, and rebuilt on a system of balancing parents' rights with protection of children instead of incentivizing removals of children from families and expansion of governmental powers.

    Part of the trouble is we have all seen cases where CPS have lied to got the sort orders they wanted so they can remove children, then even the best parents have had to struggle through the court system to get their kids back, and it shouldn't be that hard

      You are absolutely correct. I have caught CPS workers perjuring themselves in Court, but it is such a systemic problem that they aren't terminated. We need real CPS reform that balances parents rights with the safety of children.

      This happened to my daughter. CPS falsified allegations of Domestic Violence and sexual abuse. Removed her new born babies and never left the hospital with her babies!!!!! Never in her entire life did either of those crimes take place nor ever experienced!! Rights terminated now being adopted!!!!!¡ I HATE HATE HATE THEM

    I have endured a similar struggle, finding myself innocent of any wrongdoing, yet still facing the heart-wrenching removal of both of my sons. In response, I lodged a formal complaint with the Civil Rights Commission in Washington, D.C., and we are now courageously pursuing a federal lawsuit against the state of Mississippi for such grievous actions. This matter, I regret to say, extends beyond mere legalities; it is both a spiritual challenge and a calculated attack on the alpha male's role within the home.
    Spiritually speaking, I serve as a minister with an untarnished reputation, surrounded by family members who were more than capable of caring for my children. Despite this, one of my children was placed in foster care, while the other was given to my mother, their grandmother. This occurred even though their mother relinquished them to the state, where, by all norms, they should have been placed with the next of kin. Yet, this fundamental principle was inexplicably ignored.

    I live in Guthrie,Oklahoma in Logan County. When that overzealous CPS worker walked into my son's hospital room when I was feeding him and began to interrogate me, I am invoked my fifth amendment rights, my fourth amendment rights, and my sixth amendment rights and she harassed me for more than a week and then at an interview she made the call and stole my child 3 hours later. My wife and I had just brought him home from the hospital.

      Good luck! Make sure that you RECORD yourself telling them that you do not want to answer any questions without having an attorney present, but also record them telling you EVERY single allegation of abuse/neglect that has been made against you.

      @@RH-xr8ms that's terrible advice because lawyers get paid to defend you so if there's no case then they don't get paid don't talk to them that's better advice you don't have to speak to anyone they have no case if you don't say anything if you say anything even if it's positive they will twist it around it's sick and twisted but studies show that kids are more likely to be abused sexually physically or even killed in CPS custody I was taken away by CPS twice as a child I could speak from first hand knowledge they abuse children they put you in a bad facility they don't protect you from other children kicking your ass it's all a scam to make money and steal kids away from people

    I've already been intimidated with them. I do have an attorney. But it's ridiculous how this came to light. I'm protecting my kid and I'll continue to advocate for her and the school who twisted this should not expect anything less from me. I'm pulling my kid out of this school system as soon as her year is over which is a few weeks. We are actively working to get rid of them. My signature was foraged on forms by computer from the school, to make things worse my kid is forced into counseling because they failed to protect her from bullies and she wrote a nasty letter to retaliate. She is only in 3rd grade. I will not back down from this fight and the school is fixing to be sued.

      My situation is similar my son is in school and the school called CPS and now they’re coming to my house Tuesday I was just informed about this. When my son gets mad he says very crazy outlandish stuff and that’s what alarmed the school. I’m at a loss of words because at home he is an amazing kid And he’s happy and very outgoing at school it’s different he’s depressed he doesn’t want to be there and some bad stuff happened a couple years ago in school. That has pushed him to this point a teacher was very mean to him and the year before he loves school and he loved his teacher and ever since that one teacher was really rude and profound to him It makes him very scared to go to school he does not enjoy it

    Something to remember: While they CAN and WILL get a "tame judge" to grant them all sort of stuff for you to do, IF you have the money, you DO NOT have to use THEIR "Service Providers," but can use someone of YOUR CHOOSING! The Court Order simply requires you to do some THING, but NOT HOW to do it! PISSES them off, but there is NOTHING they can do about it.

      That's an excellent point! I can't even count how many times I've seen the Department's "counselor" refused to recommend reunification of the family after a year, but then a private counselor recommended reunification. Did you know that the Contracts of the Department's providers are publicly available?

      My daughter went through this and they made her go to a CYS appointed psychiatrist which I didn't think was right the guy was a complete asshole. I hired an attorney for my daughter who did absolutely nothing for her never fought for her at all. I brought up all kind of things and nothing was ever done in fact my daughter failed for four things on a drug test a substitute attorney told her they can have it sent out for further investigations so that's what my daughter did. It came back where she only failed for two things and one thing was medical marijuana which she has a card for. So my question is if we would have sent it back again would it have come back is that she failed for absolutely nothing. It's a racket it's corrupt. They know what they're going to do the minute they take those kids there's money in adoptions.

      @ManySeasons when we went through this, we paid for drug testing ourselves. Funny thing is, the same company that said she failed when CPS paid gave her a CLEAN RESULT. I wish we had the money back then to hire a psyche counselor. If you can, that would be my suggestion.

    I was investigated maybe three or four times by Probation, six or seven times by CPS, once by the FBI, and two or three times by the local police, for physical and sexual abuse of our toddler daughter. I wanted equal time joint custody long before that was a known or commonly accepted option. I had one of the messiest divorce cases in my county. She, the Ex-, used her considerable charms and tears, and initially got everything she wanted, and I got almost nothing.
    Almost immediately, she started using me, a supposed child abuser and child molester, as an almost daily baby sitter and several overnights. I eventually was able to prove an extensive pattern of lying by my Ex. Both the court appointed psychologist and court counselor totally flipped. I won total custody at a time when males had zero chance of having primary custody (tender years doctrine). She then kidnapped our toddler daughter and disappeared for nine months. After I finally obtained physical custody, the court bent over backwards ordering the Probation department to investigating me. The daughter had only two temper tantrums with me. Of course, one started just as the Probation officer rang the doorbell. After letting the officer in, I picked the toddler daughter up, asked her to take a nap, and promised we would make things right when she woke up. She woke up about 40 minutes later wanting lots of hugs, but could not remember why she was mad. The probation officer wrote that up as handling discipline with a firm hand.
    My Ex reported me to CPS for child abuse multiple times and to the FBI as the Unibomber and maybe got neighbors to also make false reports. I always cooperated with investigators and always came out clean. I think during the CPS first visit, I was explaining the custody conflict history while the daughter was happily singing to herself a few feet away while swinging on the swing hanging from the living room ceiling. I asked her to put her swimming suit (bikini style) on which she happily did; not a scratch anywhere. The Ex-‘s baseless accusations only stopped when the judge threatened jail time for contempt. Knowing what I know now, I would probably still let the investigators in, but would insist on video recording everything for everybody’s safety.
    I subsequently helped about two hundred people deal with false child abuse accusations with a local volunteer organization. Many were false accusations occurring during a divorce. But about half were CPS cases. Several times, green CPS workers jump to totally erroneous conclusions from ignorance. For example, mentally retarded children tend to be people pleasers. They will often guess at an answer when they don’t understand a question. When asked the same question a time or two again, they will often quickly switch their answer when they sense that the inquisitor does not like the first answer. This quickly leads to gross absurdities. About half the time, the parent or grandparent could not recall or retell the facts in a cogent way, or were grossly inconsistent week to week. I often wanted CPS to keep the kids forever despite how bad foster care frequently is. I don’t know if I was able to convince one father facing a judge for child abuse that research shows that a stern talking to generally works better than a beating. His belief was that he got his ass whipped as a child and he turned out OK.
    The California Attorney General former printed the excellent California Child Abuse Prevention Handbook which did a pretty decent job of explaining all the relevant law and procedures. It is probably available in all California law libraries and maybe elsewhere. Maybe similar in other states.
    Forty years later, the daughter wants absolutely nothing to do with her mother, but gets along fine with all her other maternal relatives (and me.)

I actually support CPS and their true mission of protecting children from abuse, but they've got to stop starting fires and then claim to smell smoke.

    Wow, I used to provide paralegal services for people in Australia who were being railroaded by their version of CPS and the one thing I always thought was, "Thank God our CPS doesn't pull these kinds of shenanigans". It seems I was mistaken. That said, make no mistake that Australian CPS are infinitely better funded, empowered, and staffed than even the most zealous US equivalent. The threshold for direct intervention in New South Wales, for instance, is referred to as ROSH which stands for Risk of Significant Harm. That's right, if they so much as determine that your child may be at risk for neglect or abuse, which the Children and Young Persons (Care and Protection) Act 1998 says can include as little as a single incident of their "psychological needs not being met" or is "at risk" of abuses, then the government can and will take your child. I had the opportunity to see some particularly egregious cases over the years I spent there. Hard to believe that our woefully underfunded system has a track record of similar behavior.

      You're right. It it absolutely appalling how the CPS System is abused and is being used to target certain individuals. We must trust that parents are in the better position to care for their children and that the government doesn't know best. The government should only intervene in the most egregious and serious cases.

    Had a cop try to tell me that if I didn’t let my son go with his father she would call cps and have both of my kids removed! That was a big mistake on her part! Baby first and foremost he’s been drinking and I’m not allowing my child to get in that car and that he even admitted that he was drinking! I told her to her face call cps because and if they remove my kids because I’m concerned for their safety! Not only am I suing the police department cps as well, and my lawyer will be coming for her with a lawsuit next, and I’ll win baby! Don’t threaten me with my kids like that! I know my rights!

      Go to your local court house, there is a law library, and usually a well versed individual working it. They can't give legal advice, but that can guide you to the right information

      The laws concerning CPS intervention into families weren't created in a vacuum. The lawmakers chosen by our citizens are the ones who wrote these laws, or at least passed them into law. If you want to change the laws, then you need to get involved in your state legislature.

    CPS is an agent of the state.
    Let me make this simple. It doesn't matter if it's police, CPS or FBI. Do not talk to agents of the state or government.
    Agents of the state when engaging private citizens are generally conducting investigations. You are not required to assist with investigations and ANYTHING you say whether you are the target subject of the investigation or a bystander witness - can be used in court against you for prosecution.
    You are not required to answer questions. You are not required to assist with an investigation and you are not required to participate in consensual conversation.
    Agents of the state are ALWAYS agents of the state.
    Once contacted by these agents you should immediately seek legal assistance and SHUT UP.
    The more you talk - the more damage you do and the less your lawyer has to work with.

      CPS is not the FBI. The FBI can't do anything if you refuse to cooperate. CPS will take your kids. They have far more leeway and rights than the FBI does and can do pretty much as they please so long as in their view its in the best interest of the child

    Does CPS actually try to help families? They stopped by with seemingly small allegations and gave us papers to help our son get on disability. I denied them entry as we are all sick and I am immune compromised, but they said they will be back to get the forms and inspect the home, but only after calling. Could small town workers be more of a positive impact? Hopeful thinking!

      I wish that were true, but I've fought CPS in both small and large towns and have found them to be exactly the same. They start with small allegations, and then use that as a reason to go on a fishing expedition. For example, they say that there is an allegation that you haven't sought medical care for your child, but then they want to search/inspect your home and look through the kitchen cabinets.

      Just watched it. Sadly, we did answer a few questions and did try to explain the incidences she talked about. I have noticed in other videos and in our visit, someone is always carrying folders that are larger than my medical records. Can I ask for those? Unlikely they would be that thick. Are they recording everything or trusting for the word or the CPS worker? People's memories get twisted fast. Sent the forms they gave us to Legal Shield, but LS didn't tell us what to do if anything at this point.

    Much appriciated for your effort. One question, when police or CPS knocks the door, they usually say we have court order while they don't have. How do we make sure it's true? There was one time I saw video encounter with CPS and they were claiming court order was being issued and they don't have now but it's on its way. What to do in these incidents. Is it legal to follow court order?

      CPS, generally, has an important job to do. However, the way they go about that job is by trampling on the rights of both parents and children because they feel that "the ends justify the means."
      Imagine if police (who also have an important job) began stopping and searching everyone on the street "to keep the community safe."

      And parents have issues and problem that effect the well being of the child. Children become violent and abusive to other child and teachers and to society in general. Therefore DCFS will need to investigate and determine what’s is the next step in correcting the issues the parent is having.in order to protect the child.. simple.

    So, CPS was called on my wife and I and we believe my stepmom called out of spite. This was just last September.
    The only person we think it could've been is my stepmom. She is deceitful like that and has talked about CPS one the past. The CPS lady demanded to see our baby. She saw her within 24 hours. She was happy with what she saw and just wanted to look at the house... A lot of the accusations had nothing to do with our baby. Mainly house conditions that were basically made up. The CPS agent was really nice and said she's prolly just gonna close the case.
    My wife didn't want my stepmom to see our baby ever again, so I said that it's not fair to my dad. So as long as he's around my stepmom will get to see her by default. She really spoiled her up until this point and we thought she was gonna be a good grandma
    Well my wife and I got in an argument one night and they were there so my stepmom used that as a reason to call. So, we think. We're almost certain. The things that were said could've only been said by someone who had been in our house recently. We're 90% certain it was her and didn't want it to come between our baby and my dad so i still let her see her.
    Well, my dad passed away a couple months ago and we've all but kept her out of our lives. She's been my stepmom since i was 12 (I'm 45 now) so i feel like on the off chance that it WASN'T her, we're really doing her an injustice but CPS refuses to say whether or not it was her.
    I really think it was, but it would be terrible if it wasn't. Is there ANY WAY to find out for sure?

    CPS talked to my kids at school 3 weeks ago, and they came to my house and left their card with a number to call them I didn't call them, and I didn't open my door to them because I refuse to cooperate. What will happen next? Will they go back and talk to my kids at school? Will they keep coming to my house? I have no idea what I'm being accused of. I'm in Indiana. I can't afford an attorney.     I think what I would do if I had kids and some Karen made a false report on me or their mother is, not let them in the house without a warrant. Nor answer any questions. Then after they leave, I would immediately take some vacay or PTO, pile the children and their mama in the car, and get as far away as I could. I'd have cash so I wouldn't have to use my check card, and I'd turn off GPS and all tracking apps.

      Oh, you definitely wouldn't want to flee. That would be a crime and would open you up to arrest and prosecution. Plus, it would make the Judge assume the worst and then there'd be no escaping the ensuing Amber Alert.
      Definitely don't allow them into the house, but instead of refusing to answer questions, just tell them that you decline to answer questions without you Attorney present.
      Then, don't be afraid to ASK them any questions you want. What are each of the specific allegations against me? What exactly are you asking from me? Who is your supervisor?

      1) What is your definition of "overcharging?" (I'm not defending the attorney, but I need to know this before I can explain)
      2) I'm not sure of your state, or state law, but in Texas you can countersue for CPS filing a frivolous claim. You may also be able to sue for violation of civil rights.

      @@MatthewHarrisLawPLLC My husband and I are indigent and were kicked out of our home with my in-laws after being held captive for six hours in a room by CPS 'workers'. The issue was never our daughter's safety it was me. They were trying to force me to commit myself and as a result I submitted to an evaluation of my issues and it was confirmed that I was fine. Now, every attorney I speak with wants 2,000.00-9,000.00 as a retainer and I have been told this will cost up to 35,000.00. We have been forced to live in hotels for three years, CPS involved my ex husband and caused a mess with him and my three children by telling my ex husband that I hurt my child that I have with my current husband. That would mean I have to hire an attorney to work that issue out in Tarrant County where my ex husband lives, and Colin County where my current husband and I live. I have been through a lot concerning DHSS and doing twice over what the Governor's office said to do with DHSS. My current in-laws have custody of our daughter in order to keep CPS out of it, but I never was given a chance to go to court or given the option to retain an attorney. We have terrible credit and the long story continues. We would have savings and a house by now if we hadn't been told to leave our home at my in laws' immediately after the six hour torture CPS in Plano put us through. Anyway, it's an issue that we thought was settled via a final meeting at my in laws' home. It was not. It's a huge mess.

      Oh goodness. That is so heartbreaking to hear! CPS is a virus that destroys every family it infects. I'm aware that there are some cases that warrant involvement, but I can count those on one hand while the cases where CPS involvement wasn't warranted can't be counted.
      I know those attorney's fees are high, but I don't think they are overcharging. Unfortunately, attorneys have a LOT of overhead just to keep a office open. Not even counting the attorney's salary, they have to afford malpractice insurance, licensing fees, client management software, legal research libraries, and support staff just to answer the phones.
      In case you didn't know, if CPS files a case against you in Texas to take custody of your children, you're entitled to a Court Appointed Attorney if you're indigent.

      @@MatthewHarrisLawPLLC Thank you. I found a form online recently to attain a court appointed attorney. No one tells parents this and the children are the ones who suffer. CPS is actually harming and not helping children. A judge determined our child become a ward of the state without letting me know there was going to be a hearing. Therefore, I was not present nor was I informed of our rights. I understand the overhead of attorneys, but I have heard of them doing a few pro bono cases in my former family law office. Anyway, I have a clearer perspective of what they have to cover in their practices. I am going to file this form for a Court Appointed Attorney as soon as I have an apartment or have bought a home. It's easy to lose hope.

    CPS and other workers in social services agencies should follow the Constitution, no doubt. As they do so, and that "one case" falls through the cracks and a person is harmed or killed, social services and/or law enforcement are then the first ones blamed. And for every interested party who is claiming violation of rights, there are just as many if not more - in particulsr the reporting parties - who are claiming that enough isnt being done and if it doesnt get done theyre going to sue, call the media, complain to the county board of supervisors, etc. Sometimes these situations are just no wins

      I've been doing this for over 10 years and have put expert witnesses on the stand to testify regarding hair test results. Respectfully, 7 years of history through a hair test simply isn't possible. Even a fingernail scraping doesn't go back that far.

    My 13 year old autistic daughter had shoved a couple of markers in her crotch last Monday, and I went to the ER to get her checked out to make sure she didn't injure herself by a female Nurse Practitioner. That's the basis for this "report" and now the police are gonna get involved. She was okay. No harm done to herself. There is no abuse of any kind! Just the normal discipline parents have to do. The police want to have her checked out at a hospital. I don't know what else will be discussed in a few minutes, but I'm ready to record because there is no abuse! She has been acting up in school, inappropriate behavior, and erotic, even though I don't know why she's doing that! We don't expose her to anything inappropriate or of a sexual nature. My husband says it's because of her hormones. I'm at my wit's end about what to do to remedy this so she will stop this extremely bad behavior. Is it a good idea to cooperate and let the police submit her, an innocent autistic girl, to a pelvic exam to prove to them that she's fine?? Please respond asap!!

      Our case got resolved, and closed. They found nothing, like I said. My husband asked if he could know who did the report to CPS, and the lady said we couldn't know because it was "confidential"!! So the case is closed, and I'm just waiting to receive the final paperwork from her that states that. It's January 14, 2023 and I still haven't got that. I'll have to call her about it. But after that, can I sue for defamation, because this is the second time in two years!!!

    They don't protect children, when a case worker slept with my husband. Kicked out in a level 2 storm, with Covid, without a court order. My husband , on illegal drugs, called! I have a speeding ticket, I've been through 5 assessments, 4 hr psych exam, requested to send pictures of prescriptions, my HIPPA laws were violated, she even took my visitations away!
    They have completely ruined my life and most importantly my children!
    If anyone can help, please! He stole my kids, my home, bank accounts, reputation and the case worker laughed in court, asking for another round of criminal counseling! I was with murderers, rapists, bank robbers and even shot at in Oh!
    While he gets my kids!

      It's also not about "if you have nothing to hide." It's about your rights and your child's rights. Do you believe CPS has your child's best interest at heart? If so you need to do some research and stop being naive. You as a parent or guardian are supposed to protect them. Exercising your rights is step one. If you do not they will ruin you, ruin relationships, and harm your child. I have seen it personally. They will. They care about quotas and government payouts based on how many cases they have open, and how many children they remove. It is in their best interest to discredit you, lie to you, and remove your child unjustly. They get a bigger check if they do. These are facts. If you are not protecting your child's rights and your own you are NOT protecting your child period. CPS is literally one of the most evil organizations in the country.       That is a FANTASTIC question! #1) No, a court order isn't the same as a warrant.
      #2) There can be Court orders that require parents to allow CPS to enter a home, school, or other location where the child may be in order to interview the child.
      #3) If the police are there with CPS, and CPS has an Order that says you must let them in in order to interview the child, and you refuse to let them in, that refusal may be used to terminate your parental rights. HOWEVER, there is no requirement that you allow the police to enter your home or for you to allow CPS to search your home.

They furnished a warrant on me with no evidence or anything.......came in my home when I wasn't there/threatened me to bring my kids or they where pressing charges over the phone/the next day pinged my location & took my kids & put them under the states custody & tried to drain my resources & put me through hell for a year while I took care of my kids & I won them under my custody now I want to file a civil suit........Does anyone know a good lawyer to take on on my case please let me know .....I got documentation & time line & a video

      Its certainly a fine line and I do my best to walk that line every single day. One of my greatest fears is misjudging a family and fighting to keep a child with a family where they are ultimately harmed. I do my best to remind myself to focus on the children and not solely on the desires of clients who are willing to give me money.
      There are some things in life worth more than money and I've had to turn down cases where I didn't feel like I would have been on the right side.

      @@MatthewHarrisLawPLLC i am looking for an attorney to help cause honestly I can't afford one. i hired two got ripped off twice. my attorneys would say they were doing stuff like filing motions and wouldn't. when we got to court they would be all pumped telling me all kinds of good stuff but not following though in the court room. i had to fire both. after i did that i was able to file my own motion and after 3yrs i was finally able to meet my son. so i been learning what I can but its hard to separate the emotions in the end. so its definitely necessary to have an attorney to represent you. i have a question? so I was the one who actually called cps on my ex cause i observed some stuff through a video visit that was concerning. the next thing I know they are calling me asking me all kinds of questions about my medications and I was very honest. i even told them about the little bit of marijuana use. im in nj where it is legal. i send them the info they want plus some from the court to show i already jumped through these hoops. they come back with they want me to take a drug test and want to look at my house over comcerns i may be using. to that point I was doing everything very voluntarily. i just decided im not going to submit like i always do. they say this is going in their report. what's the next move?

      @@lilredrhinoproductions6083 Wow, that is absolutely terrible to hear! I'm sorry you went though such an ordeal with previous attorneys. We're supposed to be there to help you carry your burden, not be be the cause of more.
      I don't know how to give you the next move. There are so many factors at play that changing just one would likely change your strategy.
      One thing I will say is that even if something is legal, the use can still be used as evidence against a parent. Alcohol is a perfect analogy.
      Also, here in Texas, if CPS has taken you to Court and obtained an Order for Actions, then your options for compliance/noncompliance become rather limited.

    Im in California but I had CPS come to my home a few days ago when we were all out and let a notice to ckntact them, my mother in-law was home at the time and let them in the front door but not our rooms. Should I be worried about this? Im not planning on calling or talking to them. The person who called was my wifes uncle and he used the condition of our home to call cps we are renting rooms from my mother in-law.

    Michigan cps took my brothers baby. His wife overdosed whilebthe baby was in the car. My brother was not high, and passed his drug screen. He stopped at a gas station and the mother needed cpr, and the gas station clerk helped and my brother did not leave the baby at all. The mother got 3 shots of narcan, and was sent to hospital. The only crime my brother committed was driving without a license. I went and got the baby, my nephew cause they wouldnt let my brother take the baby. I thought theyd possibly let the baby go home with my brother and the grandma if the wife was told to leave..the baby had never been away from the 3 of them (grandma)..never spent the night anywhere else, hes only 14 months old. He cried and cried. Cps told me to take the baby for a drug screen....the baby passed the drug screen. The cps worker made an emergency petition for removal without even waiting for the results, or giving my brother a chance. The cops came later that day and took the baby....the cps worker lied in court saying the baby failed the drug screen, and had drugs in its diaper. LIES! they arrestedbthe mother at court on warrants etc. My brother is without his wife, and his son....all he wants is his son. The mother is going to go into rehab when she gets out of jail. Any advice? I printed out copies of the patient portal of the drug screen saying everything was negative....emailed to my brothers lawyer...i feel so helpless, hurt, and dont know what to say to my brother.

    This is all very nice and sounds good. In reality it is assumed you are guilty if parents do what you say. Sir, I'm looking for just one... you heard right ... one single lawyer or team that would take on this case here in Florida. 25 years have passed and I did not find one. The one I hired for my (only) son, when he was accused of lewd & lascivious acts, threatening a girl (both around 12 years old) just "forgot" to show that the allegation was 3 years after a neighbor alleged child abuse, organized by a frustrated state attorney and said to be at a location in a hallway, while (during class) nobody else could witness ... most important: according to his daily planner (a school document kept by teachers) he was never out of class! All this - was considered irrelevant. It was also irrelevant that this neighbor is a serious mental case (schizophrenia) and has since left Florida. If you know someone (between Tampa Bay and Citrus County), let me know. Otherwise thanks for trying to "educate" victims. You are on the losing end, like my wife, who died, because the case judge told her she would commit a felony by showing exculpatory evidence in the entire DCF report, because the accuser and DCF reports are "confidential", no matter what they say. Why did we know the accuser? Well, the state attorney sent us the papers with Gary's signature - along with the BRADY EVIDENCE (no evidence at all). For more you can contact me or my son - now 33 years old and deprived of all his rights in America. Last not least one question: Why do you say a "mother's parental rights"? A father has the exact same rights, Sir.

      You may have misunderstood my statement regarding the termination of a mother's parental rights. I was providing a specific example of a case that I've seen (which involved a mother). Of course fathers have the same parental rights as mothers. 😊
      I honestly do not care if a parent "looks guilty" to a caseworker by invoking their constitutional rights. That caseworker doesn't matter and the only opinion that does will wear a robe and hold a gavel.
      Finally, I'm terribly sorry to hear about your terrible experience with CPS. That is just horrible to have to endure. That's one of the reasons that we work so hard to educate the public is to stop that from happening to another family.

      I know you're going through something painful right now, and I'm terribly sorry that your family is having to endure this. But you need to know that you can't have your parental rights terminated just because you don't have money.
      If CPS is trying to take your children, you're entitled to a court appointed attorney. Not all court appointed attorneys are bad, in fact I was one for years. That's where I gained the knowledge and distrust that I have today.

    I got CPS called on me because they think I don’t feed my son. Is it legal for them to question my son at school when I told them not to? I didn’t allow them in or anything and they haven’t gotten a court order to place him anywhere else so I don’t think it’s going to go anywhere.     Another dude trying to scare ya into a lawyer, listen dude ,I'd go with the lawyer that gave the most information on one of these videos,,,u hold back info and are not giving much ....come pay me then I'll tell u,,,, what that tells me you're only in it to make money and help yourself

      What info do you think I'm holding back? There's a fine line when it comes to writing blogs and producing videos. They have to answer a specific question without being so long that nobody can read/watch them.
      I PROMISE you that these videos aren't to get us more clients. I'm already at 100% capacity, but I still find time to educate the public. But just curious, which lawyer do you think is giving more information that you're considering hiring?

      For googling what to do as a learning tool maybe something before we get a lawyer or some of us might not be able to afford a lawyer or some of us may not know the right lawyer to pick but basically we're googling how to deal with DCF when they come knocking at your door and then you think pops up get a lawyer use me that's all I'm saying I just think you should tell us some information and some steps if you're going to make the video might as well make it helpful seems like I got to pay you to be helpful with children wrong or right but when I Google something to get help and you try to tell me a lawyer I get aggravated

      @@tomtom6508 Dang man, I'm sorry I didn't see this comment sooner. I still think this video gave some great tips/pointers on how to handle that initial interaction with a CPS Investigator. Obviously, one video can't answer every question.
      I know it's frustrating to hear a lawyer recommend hiring a lawyer. It's the vacuum cleaner salesman telling you that you need a vacuum. lol. However, in all the years that I've been doing this, I've seen how parents get taken advantage of by CPS when the parents don't know the law, rules of evidence, and rules of civil procedure.
      We're going to keep putting out videos, and in fact, we have a Court Appointed CPS Attorney video coming out later this month. Remember we've only been publishing videos for a few months, but I think you'll get some value if you stay tuned.

      @@tomtom6508 bud I think you don't understand how the judicial system works. The prosecution side will NEVER take a normal citizen seriously if you haven't went to law school and passed the BAR exam. Also they do thus shit EVERY day so they know every little trick they try to get you to screw yourself. Like he even said in the video, even if you're an attorney yourself you should still get a attorney to represent you.

      @Keeng Marbulz did you read the title? And he clearly advised to seek counsel. He is explaining that you have rights and there is a proper process they must follow. Nothing said about acting like a renegade. Sadly, complying can lead to worse issues and a longer investigation. Just hire an attorney just as you would do with any other legal matter.

Either way, your blessed that your experience (if any)dealing with CPS was a positive one, one can say your a unicorn of sorts...I was once, even felt they saved my life...Im just saying.... theres nothing more embarrassing then blissful ignorance and Im just gunna leave it that.
