small claims court. get a contract made up and offer to "sell" him the extra 4/6 inches and if he rejects it then say fine but its going to small claims over boundary issues.
the worst thing is when they lie, i.e. missus reckons it never existed and the bloke says it rotted away and fell down when he cut it down as the video shows. That really winds me up hence I posted the video..... It's not something I wanted to do but you know the straw that broke the camels back.....
It appears that the fence is on your neighbours side.. I could be wrong but I don't think there is any legal requirement for any particular fence unless it says something in the covenant. I can understand why the neighbour removed it to give them more room.. Why is it such an issue?
Watch the video the fence on the wall to the left is the boundary fence of that home owner, just as his fence on his left wall is his, the issue is the bugger next wanted me to move my fence OFF my wall and attach it TO the side of my wall! Boundary fences exist for a reason! You can't cut you neighbours boundary fence down cos it gives you some extra inches i.e. increases the value of your property! And that he says it rotted away and fell down when he cut it down as I took a video before he disposed of it shows, can't trust him, whilst the missus reckons it never existed!
@@WalayatFamily Moving the fence from the top of the wall to the near side of the wall would make no difference to where the property boundary is any more than moving it to the far side of the wall.
I made the mistake of being too soft in the interests of friendly neighbourly relations but they have turned out to be a right pair of greedy twats! Others should learn from my mistake!
first police report. after small claims court

To lose patience is to lose the battle 🤔
How many years patience should I show?

@@WalayatFamily Worrying over a few inches you are never going to use.
End up with a heart attack
@Bob if so when the fence fell it would have pulled the whole wall down with it.
I would reply giving in him a set amount of time to do it, 7 days / 14 days whatever, not let him dictate the terms
