- Prosecutors in the trial of Bryan Kohberger are blasting the suspected University of Idaho killer’s alibi, saying it lacks specificity required by state code. Meanwhile, Kohberger’s defense team is pressing to unseal DNA records used to pinpoint him as the suspect. NBC’s Liz Kreutz reports and Danny Cevallos provides analysis for TODAY.

Once the campus protests are over, and the Trump trial is dropped, there will be a vacuum. This trial will then be put into that vacuum, and the news industry will be drooling all over the place regarding this trial. The prosecution hopes that local Idaho people will be impressed, and declare the defendant guilty, and bingo, time for everyone to pay attention to the Democratic Party National Convention.

Why is there such a holdup for the trial? The victims family won't get any peace. So, I can't mourn properly. The families wanted the house to stand, until the trial's over. But, did the Prosecutor care? No. All these corrupt people, only care about is money.

A lot of people do this though. To clear their mind. I've done it many times late at night... imagine doing this and a crime happened and this is legitimately your alibi. What are you supposed to do? Lie and give a "better" fake alibi that just sounds better?
@jasonscott4366 actually a car of a different year, same make/model was driving around that night... soo idk what to tell ya. It has not been proven that it was bryans car specifically and if he did that crime then why isn't there a single drop of blood or other evidence? I know the defense is required to provide an alibi, but in this situation HE DOES NOT HAVE A VALID ONE. What they came up with was all they could say. When a person commits a crime they dont have a real fact checked alibi. Things are starting to come to light because he actually did the crime. They need to get on with this trail so we can be done with it and him.
How is his alibi different than someone who says they were home sleeping and are alone in the house? I think it will come down to the cellphone data. His defense team says they can prove with the data that he was not there. Anne Taylor could face significant legal trouble for herself if she said that when knowing it wasn't true.
@@JustMe-us1vh He was there so the defense cannot prove he was not. Defense Attorneys lie all the time. IMO they should be held accountable for saying things without proper evidence to support it. Three things will take Kohberger down. 1. An eyewitness who very accurately described Kohberger as being in the house at the time of the murders. She gave an almost perfect description of a unique looking individual the very morning after the killings before anyone knew who Kohberger was. 2. DNA from Kohberger at the scene. Nowadays DNA is indisputable. 3. Camera footage of his car driving around the neighborhood at the time of the murders and numerous times prior. Match that with the car the person’s DNA found owns which is his.

This "alibi" is so bad that to me it proves more that he is lying than his innocence.
You're not required to prove your innocence as a defendant. But when you provide an alternate theory, the jury is required to weigh your evidence equally. Which can essentially wind up in you being convicted just because you didnt prove YOUR case. If you're going to provide an alternate theory, you better be ready to prove it.
You are not understanding the law. Evidence and an alibi are 2 different things. A defendent in Idaho IS requried to give an alibi within 60 days of being indicted. BK got over a year to come up with his. Just because Idaho requires an alibli does not mean the tables turn and now the defesne has to prove the case. An alibi is not an alternate theory its an alibi.
@TJ-so9xo you're 100% correct. I didn't feel like going through the distinction but an alibi is not necessarily an alternate theory. But when you tailor your alibi to the known evidence, that's got you pretty well boxed in, it starts to blur the lines between the two. If Bryan Kohlburger can prove his “alibi” through phone records then he should be allowed to present it to a jury in his defense. It should be up to the prosecution to dismantle said alibi if alibi is weak. Mr. Kohlburger has a right to due process and a fair trial.

Ultimately in order to preserve Mr. Kohlburger’s right to a fair trial he must be allowed to have this phone expert testify on his behalf to prove that he was never at the crime scene when the crime happened. At the very least the Judge should allow a Voir Dire of the defenses expert to see if said expert is a credible expert to give testimony on said evidence. As long as the expert meets the qualifications of being an expert then he should be allowed to testify in front of a jury as a defense witness. @@rayray8687 I'm aware it's definitely never going to withdraw the charges and clear the suspect before a trial date. Keep in mind It's not the guys fault if he was really out driving around all alone and it's not a crime to be doing that. @@insanemamegamer1: Once a suspect has been identified and investigated it becomes the prosecutor’s job to piece together the evidence and move forward with a trial. There is a convincing amount of evidence released so far that points to Brian, and while the case might not be 100% airtight we’ll need to see what the defense comes up with at trial.
