    I just watched a DYKG about the gamecube last night, and it talked about how the guy who implemented the morphball in the original received an "additional thanks" credit even though he worked on something that Miyamoto and the Creative Director saw it as a make or break system for the game. - the additional thanks credit was given bc he left prior to completing the game as a result of the very heavy crunch culture there. He left to save his marriage, and went to work at EA Tiburon, which also had a bad crunch culture. He left games after 18 months and has never gone back.....

    Major Scandal? Other sites have dug a little depper and found that it was the external translator company that didnt push to have their individual translators credited; as Nintendo always gives the general credit for these companies, unless they ask. These translation companies sign a contract and it is on them to produced the names of their team memebers up front and in a timely manner. People running with the whole "Big Company refused basic human rights" angle once again.

      Something like this was my assumption. Figured Nintendo was subcontracting translation duties out and it was more of a legal oversight rather than some nefarious plot.

    The contractors who worked for these translations were under a specific contracting company that enforced the NDA, not Nintendo themselves. And sadly the latter can’t just enforce credits to be added or else the deal would be off, and this is also unfortunately a worldwide problem

    The NDA is to keep design secrets from the game from being leaked (I have had people sign them when I was in the industry). That being said, we always credited everyone who worked on a project whether or not they were internal.

    As a hardware dev I sign NDA's all the time, mostly 2-5yr. There is more work out there then I can do, so I never have to sight previous projects specifically. If you have the skills you can get the work. It would be cool if they wall got credited though.

    I work in video production and I NEVER get credit on anything and i've done thousands of videos for fortune 500 companies. It's not a given. I have plenty of other ways to promote myself and can certainly put whatever I want to on my portfolio and back it up with a private video if necessary.

    I don’t see the problem. Nintendo just used a translation emulator from the original translators source material. The translator wasn’t making it available and Nintendo just wanted to preserve it. Besides. They didn’t make any money off it

    I had worked with a company that did waterproofing and roofs. I had to sign a paper saying I wouldn’t start my own company in the same county for 5 years after I left. I think this thing with Nintendo is similar so they can make sure these companies don’t get credit for huge titles which insures Nintendo can continue to hire them for less money than some other company seeing the great work they did and trying to take them away for more money. If no one knows they work they did why would anyone try and give them more money or opportunities than Nintendo themself?

    An NDA does not mean that a person who is under one cannot identify themselves, unless under special circumstances, and otherwise expressively listed within the NDA itself. Nintendo is not going to subject an employee to this rule as self identification does not disclose protected information. Nintendo is also not a government entity. The most a person can be ordered not to do is identify their position within a company, what their role is, and what they have worked on.
    These people who wish to remain anonymous are doing so in fear of backlash from Nintendo. "That bothers me when people don't use their brains".

    This isn't a major scandal, in fact it's not even a scandal at all. Maybe you should have done a little more research before trying to be the first Nintendo CZcamsr social justice warrior to cover this. Nintendo credits external companies that translate, like Keywords for example. As for the NDA, don't sign it if you don't like it. If you do sign up, don't complain about it because it was your choice.

    The NDA is likely designed to stop translators and localisation teams from sharing information about the game's story, and any future DLC which might exist. Why Nintendo won't credit them is perhaps to stop potential hackers from targeting the studio conducting the work, especially if they're small and unprepared; although that would really only apply to future projects as once the game has been released, most of the time it's a self-contained work. I agree that people should be credited for the work they do, so just playing devil's advocate here.

      @@dylanbanningto translate a game from that far back in the past they’d have to hire people to do so, then those translators would have to be able to not only translate and localize the game text, but also format it into the same font so it doesn’t look out of place. Plus rewriting those parts of the game’s code to replace the Japanese text with other languages (because no everyone speaks English and if they’re going to do one they might as well do the others at the same time) which would cost even more money and take even more time and require more testing to make sure it all works as intended. And at the end of the day if a company isn’t going to get a decent ROI then what’s the point of spending that money in the first place?
      Not some blind defence of any company, but a simple bit of logic.

    Same goes for testing. I worked at Nintendo of America for a few years on huge projects like ocarina of time, dk 64, perfect dark, banjo and others. Never was in any credits. Not one. It was through a temp agency.

    In an industry like games, movies, etc.. landing work is VERY resume, portfolio based. It's important to be credited to remain working in the industry. Nintendo has no excuse. Imagine if they didnt credit either art team members. Bringing us back to the super secretive 80s and 70s game dev days where companies were afraid of having their employees leave for another company if they are credited.

    I think there should be clauses not to disclose prior to game release or during game development, the period when the translators get paid. But afterwards there aint no reason. smh

    It might be so the translators always look for work at the same translation company. They might not be able to put on their resumee that they worked on Paper Mario, but the company who hired for the translations already knows it.

    Nintendo does this to lock in their external translators ...if they can't take credit other companies won't see they have the experience to hire them and that way they have to keep working for Nintendo within the 10 years

    Just a thought it might benefit Nintendo in that talent can't be poached wether they are good or bad. Nintendo would always have access if they don't get credited. Translators are highly much needed for worldwide companies or releases. Just a thought

    This was the same deal with the NOA QA testers back when I was there. No credit. I believe that changed a bit around 2012/13 for team leads; possibly changed further by the time Switch came about, because I saw a former colleague credited in BotW, but not totally sure.

    Okay first NDA comes first before you do the work, so it's not do these translations and then after the works is done the NDA then ambushed these translators.
    NDA always comes with the contract BEFORE people do the works, so if being credited is important to these translators then they should've not sign the contract and the NDA

    I now have worked on aound 5 Games(and even more gamification stuff) and only am credited on 2. at least 1 company was polite enough to ask if they could just put the company name in the credits to reduce its length, the others just did it that way. And that is actually sad for an industry where commercially released games are a part of the salary negotiations(at least here).

    The reason is really, really simple RGT85.
    These people work for an external company who contracts with Nintendo. Nintendo does not vet or even know who is working for the company.
    Nintendo will NEVER list a person who they do now know on their games. These people could turn out to be huge scumbags.
    Nintendo will not take the risk of that PR hit for anyone who is not a company employee.
    I would be interested to see the NDA, but I am highly doubtful it would prevent them from stating they worked for the contractor and did translation on various Nintendo titles. They did not, and should not be able to claim, they worked directly for Nintendo.

    The translators signed a contract where they knew they wouldn't get credit and now they're complaining. Although I think Nintendo should not do this anymore, this is still the translator's own fault

    How about a special thanks to everyone that work on original game and the translators. I feel like there are a lot of people who don't even watch the credits and or have any idea who any of these people really are. Maybe a web site could be made with all names due credit for projects. All i know is I don't want to see two sets of credits at the end of my game or movie. Thanks too all of the people that put in the work on all projects from me.

    It's super ridiculous that this tl'ing situation is only "possibly" an issue. This is fully a predatory practice, in that the NDA's involved are at least definitely designed to keep these external translators "attached" to Nintendon't, even though they are not in any way employed by Nintendon't. Whether by design or intent, NDA agreements are not allowed to prevent employees from furthering their career to my knowledge. Regardless of their field of work. That's exactly what the NDA's that Nintendon't are doing by design and possibly intent as well. Within the law of US NDA, and their format, this is the case to my knowledge, although i am unaware of the law in countries other than the US unfortunately, and how they utilize NDA agreements and such. Doesn't make it wrong, but only in countries other than the US. which that kind of "policy" is genuinely illegal to enforce on outside employees, or "contractors/contracted employees" unless it is specifically an NDA about things like literally trade secrets or inside information, which are already illegal to speak of for profit anyway.

    I think, it's so, that Nintendo has cheap and easy access to "their" translators. They can't put their projects on their resumes, so they get less jobs, so they have more time for Nintendo projects, and, as they are in need of work, Nintendo can dictate the price.

    When an artist makes a cover of a song, the original song writer is listed in the credits of the new version. So why shouldn't the old developers get credits in the remaster?

    Back in tbe day, in Japan, if a game had credits at all they were false names/non de plumes. Companies did this to prevent poaching from other companies. I am wondering if this mindset is why Nintendo isn't giving the external translators credit. They can't list past projects so it is a problem if they leave their company and try to get hired by another OR start their own company. And it leaves their availability open because other gaming companies don't know to contact them for translation. Now they are available when needed at a lower price.

      Hold your fire dude, several gaming news sites have clarified that Nintendo isn't actually responsible for what happened. It was the external translation company who is actually at fault for what happened. Nintendo is innocent on this case.

    The legal non disclosure order they signed shouldn’t disallow them from using their work resume on a project once the project comes out .
    Maybe it’s also partially put in place so the translators can’t leak information..?

    It seems like the right thing to do with these upgraded versions of games is to just include the original game's credits after listing all of the people who worked on the upgrade.

    I see their point but I think the reason why they are not listed, they are more like private contractors you hire to do some minor adjustments. All the major creative stuff that went into making the game was already done they are just doing the some fine tuning. They don't want to be associated with them they are just paying them to do work and not be associated with the translator. Its like after your house was built you will hire a contractor do some minor adjustments. The contractor can't say he was associated with the company that built your house.

    I suppose one silver lining for them is that they cannot be tracked down and harassed by insane gamers trying to foil some perceived conspiracy. Regardless though, it should still be up to them, and they could always go under an alias and still get credit.

    Even if the NDA allowed them to say they worked on a title under the NDA. That would not help much because the credit to that person was "conveniently" missing in the credits of that game. They wouldn't be able to prove anything. Nintendo wants the awareness of the translators work buried.

    I'm sure the reason those external translators were not credited was to obscure their identities from competing organizations. External translators are generally cheaper, so if you have some reliable cheap labor, you're absolutely going to make use of it. It's incredibly unfortunate for these workers, because they have a lot less power.
