      As a practicing criminal defense lawyer, the first person broke my heart. I definitely think the attorney should have filed a motion to determine competency. It isn’t the highest standard, but it appears that she has cognitive delays that may actually affect her ability to understand the proceedings and assist her attorney. Because she is so compliant, she could be agreeing that she understands because she wants to be helpful. The attorney is an ass and sadly one of many in the state of Texas.

    • @Dr.JudeAEMasonMD
      @Dr.JudeAEMasonMD Před 25 dny +11

      @@jeanettesmith765 not even so much mental health but mental capacity. She needs a competency assessment so that it can be determined whether or not she has the mental capacity to understand her own defence participating in her defence and make truly informed choices about her legal options. This is ain’t it. one presiding over this, I would strongly admonish this attorney for inadequately preparing his client to accept a plea.

      Trouble is a competency exam can take up to a year sometimes, theres a backlog. They stay incarcerated the whole time. The system sure is great 👍

    A truly just society wouldn't have prisons full of the poor, the sick and the unfortunate. It would have prisons full of predators regardless of their economic class, mental health and who their parents were.

    Calling someone who clearly has some mental problems "idiotic" is disgusting. In the very case you reference with the title, Judge Boyd shows so much compassion and empathy. You could learn from her.

    I don’t like using “idiotic”.. that poor woman wasn’t ignorant or an idiot. She truly didn’t know. She clearly has something going on cognitively.
    And shame on her public defender. They he was talking to her and about her.

    That lawyer is not good!! He is forcing her to follow what he says.
    She told the lawyer, she doesnt understand.
    Can see she is not the fully understanding.
    Her lawyer would have told her to say, "Yes mam". When the judge asks her a question.
