The defense doesn't have to prove innocence, there's a presumption of innocence in criminal cases. It's the prosecution that has to prove guilt.

I always thought having a retrial after 13 years was going to be difficult, demanding and troublesome. I was particularly concerned about witnesses and evidence being produced after 13 years. Remember; pieces of evidence were suspect even in the original trial. After listening to the Prosecution arguments so far, It would appear to me that the Government's case for a retrial is extremely weak, and the Prosecution's argument for a retrial appears to be born out of spite and malice. A retrial in such case therefore is clearly NOT in the interest of justice.
