  • Child custody in Florida starts with the presumption that both parents should have substantial, continuous and meaningful timesharing with their minor children. Child custody laws in Florida are intended to protect the rights of both parents. Child custody in Florida may involve cases within the context of a paternity or a divorce case. Joint custody in Florida is not necessarily equal, though the court may start with that framework in mind. For unmarried fathers, Florida child custody laws may seem a little disadvantageous, but there is a lot to consider. The establishment of paternity is generally automatic in a divorce, but may require a paternity action for unmarried fathers.
