- The plaintiff says it was her lifelong dream to own a horse, but claims that the animal she purchased from the defendants is ill and cannot stand up properly. She’s suing for her money back. The defendants refuse. They claim the plaintiff rode the horse for three days before purchasing him, and they say she has buyer’s remorse.

Why would she expect her money back when she already got rid of the horse.
As the kids say she's de lu lu😂

I'm not at this part yet, but that's ridiculous! She did everything wrong.
The plaintiff doesn't seem like she's very smart though. Lol
You got a bad back?? And you want to ride a horse......named TANK😮
I survived the eclipse just to watch The People's Court
🎉yay🎉
Me too it was awesome!
😂😂
Me, too! It was really cool!

I live in California, There is NO lemon law for horses. She is Mental.
There actually is. LOL
Source: Trust Me Bro.
Your post cracked me up...I use the term mental, too 😃
Mental with a bad wig.
@ButtonsCasey Its not "lemon law". It's equine liability. And it requires specific steps.
Vetting a horse is usually standard procedure before a sale. That being said, if they knew of the condition and didn’t tell her, that was crappy of them. Also, the plaintiff constantly calling the horse “it” is really annoying. It really sounds like she doesn’t know a lot about horses.
Or care about them
She should have gotten a vet to check the horse out. Instead she didn't. Buyers remorse.
More afraid the husband was gonna back out of the deal...what does that tell ya?
She didn't even have her copy of the contract. What a loon. No wonder she sued, because she completely forgot what she signed.
Right, she isn't very together.
Even if there was a verbal agreement, she wouldn’t be able to prove it. Move it on.
Bad back and claims to be too "old" for any horse? Yeah, she doesn't need a horse. She needs physical therapy instead! 😂😂😂
And mental therapy too
@@batmang9014 🤣🤣🤣 FACTS!!!
She had buyers remorse. Too bad
Actually it's called Carrot Law!! When buying a horse!!😂
😄😄
😂
🤣😂🤣😂🤣😂🤣😂
Just as you should get a used vehicle checked out by a reputable mechanic before purchasing it, one should apply the same logic for animals 🤷🏽♀️
She should have done all that research and paid a vet before buying the horse. Any verbal agreements, she should have wrote it in the contract then they all initialed by it. Fair judgement
As Milian says, “Say it, forget it. Write it, regret it.”

What about the feelings of the horse? Shouldn't we care about how the horse feels?
Nobody seemed to have any concern for that poor horse...
That’s what I was thinking. Poor house 😢
@@jojobee42I mean the plaintiff made a deal where he wouldn't be put down, and I'm sure she paid for the medication to possibly cure him.
I do, sadly the law doesn't 😢
Get Atv to ride around and give those Animals a break 🙄
Many horses enjoy being ridden. If you really know horses, you would be able to tell that. Certainly some don’t, but many do
Especially in 100 degree heat
My thoughts exactly!
Why didn’t JM tell the plaintiff “Phones are not just for nasty pictures” like she does everyone else? 😭😂
I can't help but feel a horse's life is worth a lot more than $8,000 and that it doesn't deserve to be treated as a financial transaction.
Plaintiff signs a contract that states "no other agreement will be adhered to except this written one"
Plaintiff argues there was verbal agreement she could return the horse completely ignoring the return policy, as-is mentions and the fact there is only allowed one contract - the written one.
Lemon laws for cars only apply to new cars. But I floors me that people sign contracts without doing their due diligence. It doesn't cost that much to have a vet come out and take a look.
This woman doesn’t know how to hold the reins properly much less ride. I feel sorry for any horse she gets.
What’s on the plantiff’s teeth? 😮 She came to court without the contract because she knew it would blow her case! 😊
Looks like lipstick when you blow it up. And maybe a partial gold tooth.
“I know it’s the law but it’s not justice” LMAO
I like when the judge reminds her she's a grown ass woman and needs to own her decisions. A lot of adults can't except the fact that not every hand you're dealt will work out in your favor. Life favors us one day and not the next. Just own it and move on. Not everything is a lawsuit and someone else's fault.
She should get a cat
@lorirogers9304 -
Better yet, a hobby horse😂!
AS IS sale people! when will they learn? regardless if it's a horse or car
Plaintiff is so full of crap. There is no lemon laws for AS IS sales on cars, horses, houses or drugs.
Rich people’s problems
This woman knows nothing about horses. A vet check is standard. She has buyers remorse. Shes ridiculous. Also, she gave the horse away and has the audacity to sue?! She's nuts
Plaintiff is "up a creek without a paddle!" NO REFUND FOR YOU!!😀
OR soup for her !

If she was really a horse 🐎 lover she wida kept that horse and looked after it. She had enough money to go buy another horse so she shoulda had enough money to look after and it and buy her another one and the horses coulda been friends 🐎🩶🤎
She’s one of those types that love the “idea” of a horse but doesn’t want the real work that goes into it.
When JM asked the plaintiff if she had a cell phone that takes pictures, she forgot to add her classic line, "it's not just for nasty pictures" 🙄
I said "classic", but should have said "classless". 🙊
Never buy a non talking horse, of course. And did you know there are lemon larrrs for buying used toilet paper?
The defendants live in horse and livestock territory...of course there are going to be vets around. She just didn't want to pay that extra money, same as those who don't have a mechanic check out a used car prior to purchase.
At the very least, she should have gotten permission to contact the poor horse's previous vet and gotten his records prior to finalizing the deal. She's way too old to cry foul after entering into a written contract on a $7500 horse about which she knew nothing.
On the other hand, I'm not giving credit to the "no possum" claims of the defendant. There are plenty of them in the High Desert, so they may have been less innocent than they portrayed themselves to be. Regardless, "I had a horse 40 years ago", and "I was excited" are no reasons to impulse buy a large animal.
poor Tank, he's a beauty! I hope the other fellow is really taking care of Tank and hasn't shipped him. He was tossing his head when he was at his own home.....i'm not surprised that he was nervous at his new place. Horses aren't cars...
There should be lemon laws for ppl. Like when you get into a relationship 😅
If the contract is in writing, any amendments must be in the same format.
If your buying a living animal to ride you should know enough to take it to a vet first!
The Plaintiff clearly is trying to Buck the System 🤣🤠🐴👍
She horsed around and found out. 🐎
That guy looks like Hulk Hogan
As an avid equestrian, problems are generally due to rider error. We say frequently, “it’s not the horse it’s the rider”.
She not only bought one horse but bought a second one…I’m not concerned with her bank account :/
Daddy defendant has an amazing voice 😍
"We stand by our horses" could mean anything. The woman clearly regrets losing the money - who wouldn't? But she made a hasty decision, as she said; she was afraid her husband would change his mind.. It's on her, sadly! She signed the contract. There was no guarantee. THAT SAID. I didn't see much concern for that poor horse from anyone ~ money aside ~ let's hope that poor horse has recovered, and is being looked after and appreciated now!
So many issues with this... Yes, it takes time for a horse to become acclimated to a new environment, training or not. You say the horse fell, then you got on it AFTER THAT 🙄. Why would the defendants say you could exchange the horse if the contract says AS IS/FINAL? Also, lady, a verbal agreement was never agreed to by texts or emails or anything. There was not a meeting of the minds.
This case would have been more interesting if the Horse would have testified 👍🤠🐴
I kept getting distracted by the lipstick on her teeth LOL
Me, too! Ick!
If a helmet cracks your knocked out cold and or have brain damage. Horses are sure footed it would have to be pretty sick to fall down I smell BS
Mhm, that lady is nuts. It's exactly like buying a car. An animal is property in the eyes of the law
Buyers remorse. No lemon law for animals. She could use a little assistance learning laws.
Any thing used without a warranty the judge will rule in the defendants favor
Did he say prepurchase head exam? 😂
Maybe she should have had the horse check by a mechanic.
Actual temperament 1 horses are 10K+ not $3,000.
That’s not exactly true lol A lot goes into the price of the horse such as breeding, age, training, talent, registration. You can get a wonderful grade horse for $1000 that wouldn’t hurt a fly
Plaintiff is a nasty liar. She stayed with them for 3 days , and she knows it 🙄 those poor people. I'm so glad she lost.
So many different factors to this. I do somewhat believe the defendants knew the issue with the horse and didn't disclose, BUT this woman is gullible and trying to portray the situation differently from what it really was. She doesn't want to own up to the fact that she made several stupid decisions for the sale and put the blame of her stupidity on the defendants.
2.5 aces for that many horses and they also have training equipment on those grounds as well. No way id buy from them
The guy interviewing at the end.. I find embarrassing.
Plaintiff, Did you have the horse checked out by a vet (horse mechanic) before purchase? Or did you do a test ride? Did you sign an “as is” sale doc.”
Buyer's remorse on the fact she bought the horse without a vet check first. And then she sold it to someone else, who did not know about how the horse was health wise.
Wow how dumb can you be to not take that horse to the vet first before you sign SALE IS "AS IS" bone yourself doing it the way she did.
If plaintiff would had won she would have had to give the horse back to the defendants. The fact that she don’t even have the horse to give back, the case should have been dismissed on that fact alone.
She is too old to not have any wisdom in a situation like this. I'm glad the judge got on her at the end.
I'm against the verdict in this case. Epm is a very serious disease that's often deadly to the horses. Treatment is very very expensive. Hiring a vet to do a simple check of the horse wouldn't be able to detect EPM without a blood test. The defendants NEVER should have sold that horse.
so now prove they knew the horse had that disease
How she think she only stayed with defendants for 1 day and they say it was 3 days? No reason not to have a vet look at the horse first.
Judge Milian: Next time take a picture of the contract
Next time…
Judge Milian: Do you have the original? I like to see the original, somebody could’ve altered this
It just seems suspicious that they make sure to put all that no returns information in the contract while saying they stand by their horses. Also if it was a puppy and it turns out to have Pavo and you can prove it had it before you paid for it you are entitled to a refund. it seems like a neurological disorder would be something you’d know about and the fact that he knew exactly what it was and how horses catch it seems odd…
You get a copy of the plaintiff’s complaint when they sue you. So if she accused them in that document, they’d know to look up the disorder before they came to court
@@SipLikeTea. I was just going to write this.
And also people that breed dogs have to abide by rules if they sell a certain amount of dogs. It might’ve applied to them if she could prove they were in the horse selling business.
@@SipLikeTea so why didn’t the judge know what it was? She also gets a copy of
@SipLikeTea she reads it for the benefit of the audience since we probably don't know what it is.
I think the defendants screwed her over and knew it but she made the deal and signed the contract. So she's out of luck.
There have been cases on the PC that involved the sale of a puppy who had an unknown disease and the seller was bound by certain laws and obligations there. I wonder how or if those apply here since it seems like a similar case.
the plaintiff is a lune. "A no Return policy". It's a contract lady.
LOON.
I just looked this up. Florida is the only state with a lemon law for horses. This law was passed in 2008.
Lemon law for cars only apply to new vehicles. She may want to try that horse lemon law on........well nevermind
She signed the lease. She cant win this one. Why didnt she have a vet check him out BEFORE she bought him? Her mistake.
We have a HALF ACRE Horse Ranch"... You mean a house with horses in the backyard😂. They absolutely knew the horse had issues. Only one percent of horses get EPM(but he sure knew what it was, without reading the vet report). Aprox. 15 to 25 percent recover fully(with proper treatment). That horse had to have been ill for a long time. She's foolish, but they are kind of shady as well. At least the horse is being treated and will not be put down if the treatment fails, and that's the most important thing.
2.5 acres, not 1/2 acre. I’m sure she told him the horse had EPM, even if he hadn’t seen the report
The only horse she should be buying is a rocking horse. Does she have any idea that horses are animals with minds of their own? Behaviour can not be guaranteed no matter how calm the horse is or has been.
There is no Lemon Laws for horse purchases.
Even if the judge decided that she could return the horse, she gave the horse away. There's no way she could actually return Tank.
People need to grow up and be responsible. The plaintiff needs to seriously grow up.
Buyers remorse for sure
Just like with a car, how on earth does a person expect a refund if they don't have the car or horse any more. She traded it in and so got her money back. And she conveniently 'lost' her contract, and she hoped they wouldn't have their copy because it proved that it was an AS IS sale and NO REFUNDS. And if she has a bad back, then she should NOT be riding a horse...
Having 8 horses in 2 1/2 acres of land is cruel to the animals. That's not enough acres for horses. You should have at minimum 2 acres per horse.
Just like getting a used car checked out, before you buy it. The whole are had vets 😂
Defendant looks like Hulk Hogan
A Bad Back and you want to ride a Horse 🐴🐎😂
Lipstick all over her teeth like a cheap trick.
Of course of course - love it !!
EPM is tricky to diagnose. There can be months or years between symptoms and symptoms can be extremely varied. One horse can stumble occasionally, another horse can start walking like they are drunk. Some horses are affected temperamentally. A well broke horse that has never bucked can suddenly start bucking for no apparent reason. A kind horse can have bouts of aggression.
Some horses get it and never show symptoms, and others get it and go down hill quickly.
The only was to test for it is by doing a spinal tap and checking the spinal fluid for the protazoa.
shoulda just got a golf cart.shes too old to be putting herself in danger like that
The defendant looks like one of the ghosts from The Frighteners
I don't think any law would override a written contract.
Plaintiff's claim sounds like a bunch of horsesh!+ 😂😂😂😂
Lemon laws for horses is only in Florida. No other state. And lemon laws for cars is only on brand new ones
This is the second case in 2 days where a wife, in a hurry made a big animal purchase to pass their husbands and got ripped off 🤷🏽♂️
Still at the case intro and all I hear is: “I had pony!”
You can only change a written contract with another written contract. I think the Defendants scammed her and she stupidly walked right into it.
She is what I call Strong and Wrong. She was so self assured she was was correct and she was totally wrong on every point, buying the horse because she was coerced and the drive was too long to bring a vet and even though I singed a no returns as is contract I was assured I could trade the horse…. None of that made sense
a horse would act differently, no matter how well trained, when moved to a new home, with new owners. they take a while to settle into their comfort zone again. She would have to prove that they knew about the cephalitis in advance. I would never buy a horse for that amount of money, or any horse over $3000 with out a vet check. The vet check is around $100 and saves you a lot of grief.
California does not have a lemon law for horses, but it does have a puppy lemon law. In California, the owner of a horse is required to disclose any known problems before the sale or lease is complete. The buyer must be able to prove that the horse had a condition before the purchase and that the seller did not disclose any issues. A buyer cannot simply claim that a horse is lame and expect that assertion to stand up in court. Instead, a horse expert must rate the animal on a lame scale from 1 to 5-AI overviews are experimental
Should have bough the Horsefax. 😂
I had a horse and you can’t control it 100%! It’s a giant dog lol and it’s a lot of work and costs big bucks to maintain especially if you have a horse that gets colicky and if it’s finicky about food.
The horse isn't like a pair of jeans 👖. Like you can exchange him.
