      To be brutally honest your a bit soft!
      No rent, no excuses, evict!
      If want them out, why are you helping them to stay?
      Are you sure being a landlord is a good idea?
      DCBL, use them!
      Section 8 notice, they've probably run out of toilet paper.
      Not letting a gas safety check happen is ILLEGAL!

    Absolutely ridiculous how long and biased the process is toward the tenants. I'm all for protecting tenants that pay on time and are respectful of the property. Once a tenants misses payment they have broken contract and should not be entitled to any of the protections that a contract gives

    Wow , my heart goes out to you , as a one property landlord, this is my worst nightmare. This is scary . No rent for a year , over ÂŁ1000, in court fees . Please do a video of how we can avoid this type of horrible Tennet.

      @@new2property Thank you so much for this informative video - much appreciated! I'm actually going through the same thing right now. My brother lives in my property and refusing to move out, even though he has not paid for 13months now - I took him to court previously and it was dismissed because he said he's a tenant even though there was no tenancy agreement. He has refused access to carry out the EPC, ECIR and Gas safety checks. I have made the LA aware and they have advised I can serve section 8 under the grounds of rent arrears and refusal to give access for important checks. Please I need help - do you run some sort service for guidance? This is truly a nightmare!!!!

    This is an excellent case study of the realities of being a landlord. This is something I am going through and I am totally appalled by how the gov has set this up. There is no consideration for the landlord. It is totally one sided. Everyone in the process is ticking boxes and being paid to add no value. It’s a total scam.

      Thank you very much for watching and for your comment, I do believe that landlord rent guarantee insurance is worth considering with things as they are. If the courts do catch up and notice stays at the standard 4 weeks then it could be a risk worth taking, however, with a wait of 6 months I think that the guarantee insurance is a must.
      Since this incident I have really tightened up on the referencing of my new tenants and my agent has changed the company they use to reference the tenants.

    Horrified by this story as somebody who wants to get into rentals. The government relies on landlords as their house building is atrocious, but this is the way they treat people providing houses? Cannot believe the power tenants have. Surely this will have to swing back into landlord favour eventually?

      It's mad, I was shocked myself and still am as I try and recoup the money they owe me. Literally, no right for the landlord and the tenants can simply do what they want, and get away with it.

      How are you mate?
      I`ve opened an official complaint with the referencing agent as I`m not convinced that they did any checks, I requested the tenants previous landlords details and called her, she had no idea who the tenants were. The result should be in the final video in this series.
      My agent has now moved to another referencing agent and I don`t let anyone in my properties until I have spoken to their previous landlord or agent and employer, I`ve had three new tenants since this happened and its working well so far.

    I'm so sorry you experienced that absolute shit show. As a life long tenant that's such disgusting behaviour.
    Sadly my landlord is the landlord equivalent of your tenants. It started after I complained about his son propersitioning me for sex and was stalking the house. Although my landlord was apologetic at the time the tenancy descended into years of years of both my landlord and his son tuning up at all hours. Constant threats to evict me and my kids for reporting repairs and general abuse, personal comments and being shouted at. I hadnt reported any repairs for 2 years over covid and then the bath developed a plumbing issue. This time my landlord started yelling at me threatened me with evicting (AGAIN) demanded that I pay for the repairs and accused me of intentionally unscrewing the waste pipe. This was not the case. It was just the sealant that had gone. I've lived here 13 years so that sort of thing happens after many years. Anyway, when he came to repair the bath he apologised and asked me is I'd like a energy efficiency survey of the house as he'd been offered one for free and it might help me save money. Turns out it was him gaining access for the energy efficiency cert he needed to serve a sec 21. Over the next couple of weeks he turned up with further paperwork so that he could evict us. I thought it was odd but I'm desensitised to this guy invading my right to quiet enjoying of this place. Then he turned up again, this time to serve the sec 21. I have a ring doorbell recording of the beginning of the conversation... its honestly was disgusting the way he spoke to me... but then again, that's not unusual for him. Anyway, since then he's withholding a boiler repair, carried on with the abuse and insults and generally been action like a d*ck. Fortunately for me there's unaddressed mold in the house so I have reported this and his refusal to fix the boiler to environmental health. This should void his sec 21 and give me an opportunity to find a new home on my terms and not his. I don't owe this guy any rent. I've looked after the house but have been made to feel uncomfortable for years and I'm not sure why. If I could have moved before now I would have, but with a very sick daughter it's not been a priority til now.
    The reason for telling you this is to say well done for being receptive and reasonable. It's restored my faith that not all landlords are like mine.

    Aggh !! The pain of this process!!! I was letting a property to a non-paying tenant, and even after going to Court and getting a Possession Order, they still did not leave. This went on for 10 months !!!! I ended up instructing a private company called Quality Bailiffs to do the job and my tenant was gone in 4 weeks !! Can't recommend them enough. Safe to say, it put me off letting out my property for a long while :')

    The system is skewed so much for the tenant instead of the landlord. Just because you made smart decisions in your life and invested wisely, you get treated like the red headed step child and the tenants are treated like royalty. I'm blessed with my tenants. Very rarely do I have to evict. In fact, out of 20 properties, this month is my first eviction in close to ten years. Everyone pays by the fifth and stays in the property. I'm a pretty attentive landlord, though, and if they call with a problem I am there that day or the next day at the latest. I treat them well and they treat me well. The person I had to evict were actually already in there when I took.ownership.when my dad died and left it to me in 2007. They had been there since 2003, so almost 20 years. They were section 8 for a long time but eventually became paying customers. When the mom moved out.and the daughter's boyfriend moved in, that is when my problems started. When t
    I started having to chase them for the rent, I told them it was time.to go(they were on month to month rent at that point). They were angry, I didn't care. I'm not chasing anyone for rent. So, they left, and left a huge mess, but it could be worse, and I am done with them. Thank you, God. All I did was send them a letter saying that our agreement says all I need to do is give 30 days notice, so here's the 30 day notice. Be out October 1. And they were. No court filing, they just left. They didn't pay September but that was the only month they didn't pay. I'm re doing the place now. Yay!!! Now, I can pick a tenant myself, and they will be like all the others I have chosen..good, reliable, clean tenants

    i had a squatter family who wouldnt leave ..i met them told them to go they refused i said fine on such a such date i am moving in with 10 other people and they are welcome to stay....aka dont evict the squatter become one yourself.. ..on the date i was to move in i put the key in the door went inside and low abd behold the house was empty...i guess the shelfish tenants did not like sharing

    Hi I am going through same situation. My Tenant have never ever paid rent on time and last year when I mentioned I lost job and I need to sell my property as I am not entitled to any state benefits due to this property I owned and I need to sell to live off it,until I find job again.She completely stopped to pay me rent and started to put barrier in my way of re possession. I have not been able to inspect my property since last 12 months and she keeps damaging property deliberately and reporting to Council and when I tell them situation they say,you must repair and than try taking legal action, but until than you must take step to repair all damages been reported to us.
    So far I served section 21 and I lost the possession case after 11 months and I spent 5k on legal fees and she used legal Aid...I lost job I am on ESA only and I have 2 young children to feed.I have am only entitled to child benefit and ESA and I still wasn't able to get legal Aid or any support. This system is unfair and absolutely insane

    Hi Dan. Just got your book in the post thanks for that .. just had tennants use our property as a dog breeding kennel too. The smell was so bad we had to recarpet the whole house and repaint throughout 
 ripped off bedroom door , and a 90litre dustbin of dogs
 incl. maggots .. lovely .. all part of the learning curve I suppose .. 3 grand of costs for us .. and they make 7 grand selling puppies .. tried to get in for inspection .. but they had „ Covid „. Any tips to stop these people ??merry Christmas . And thanks for your great content

      Gary, I`m so sorry that you had to experience this too.
      I have changed referencing agents, I have my agent check new tenants following the referencing agents report and then I check them myself, I look into previous renting history and also employment. I`m far more involved now and personally screen anyone who my agent finds to take the tenancies.

    Once you have the possession order with the money order can get an order from the court to see the tenants’ bank statements, check books, any investments the have, all financial documents which they have, and then they have to turn up to court and answer loads of questions under oath as to why they haven’t paid up, what they have done with their money instead, etc, and then you can get a CCJ AND a payment plan in place to pay you back ordered by the judge if they aren’t in employment, decided by the judge, and you can also gert their bank accounts frozen as well if they don’t comply. So they have to pay all your court costs as well, and they have to provide a income and expenditure sheet so you get to decide with the judge how much they have to pay every week or month. They then have to stick to it as if they don’t you enforce the CCJ and you send the bailiffs to their new address. They can’t hide. Don’t let them away with it

    The whole system in the UK is broken. You get shite landlords and shite tenants. Trouble is if you have good tenants or landlords...eventually both will come jaded over time because they will eventually come across bad ones, respectively. So , if you are a good tenant and you end up with a bad landlord it might make you jaded and become a bad tenant ,likewise for Landlords. This creates a never ending cycle of bad sentiment. The Law needs to change for the betterment of decent Landlords and Tenants alike and more punishing for bad tenants and Landlords.

    Btw they didn't need to let you inspect the place even with 24 hours. If they refused younwould need a court order to gain access UNLESS there was a provable emergency. Otherwise it's harassment.

      There was no guarantor in place as both tenants were working at the time of referencing and the referencing agent gave them an all clear. I now work with a different referencing agents and have much a much stricter criteria.

    Question. Here in The Netherlands the bailiff can seize your bank account so the paiments will be automaticly taken of that bank account or they can freeze the bank account. Does England have something like that? because all i see is that the ballifs do is take cars or the stuff inside the house

    What i dont get is why a landlord who has a property business has to live in "hope" of rental income and be a psychologist; employment officer; Samaritan and a mediator just to get the damn money? I can't take a taxi anywhere an not pay. I also can't walk into a shop and take all the food i need and not pay and if I did and knew that the ASDA had to ask me nicely for almost a year and give me a job and wake me up with a coffee, drive me to work and wipe my arse, I'd be taking food all day! What are Shelter doing in these situations? They should be giving tenants a GOOD name instead of letting these punks get away with making landlords add another reason to avoid certain tenants. Should the government or local council not have a faster system that protects landlords? Thats months these thiefs have gotten away with not paying when there's a huge backlog of people looking for housing that the local councils could put in there with guaranteed rent. Isn't Australia's eviction process a lot faster? Do we not have that and if not, why??
    I know 3 "companies" now in Scotland that you pay ÂŁ300 to and they approach bad tenants away from the properties and urge them directly to leave the area (without mentioning the property). This is becoming common place and the be honest, I'm totally for it until the government start protecting landlords. Just listening to the amount of work and money this guy has to go through to evict someone from HIS asset is criminal so why is he the only one being fair when the tenant and government are not?

    Wow. Obviously the system is set up to make sure the court system and the solicitors are well compensated. I am sorry to hear how much non-sense you are going through. Here in the US the eviction laws are set by each state. Conservative states like Texas and Florida allow removal within the month and Liberal states like California and New York can take years. These "compassionate" laws only help the professional dead beat tenants. At the same time they drive up rent costs for everyone else. No coincidence that rents tend to be proportional to how hard it is to remove a bad tenant. Your experiences makes our process in Virginia look like a cake walk. Hope you are able to recover some of your losses but based on your first video I wouldn't hold my breath. CHEERS.
