@@shobhitgupta2261 it is a very good question but not answered. I have faced this problem in June 2024. I sold my old house that was in my single name. I purchased a flat of Rs90 lac in joint name of my wife. We both paid TDS of Rs45000 each and I was in trouble. As I invested my amount of Rs90 lac just to avoid tax on capital gain but after TDS paid both by us my share of investment came down from 90 lac to 45 lac. I think one person can pay total TDS
Purchasers are required to deduct tds and not pay.
@@cyrildsouza7887 after deduction what will you do. Do not respond wrongly. It is duty of buyer to deposit TDS amount on seller PAN card.
Please answer the question asked, the point is can only 1 buyer pay the whole TDS instead of paying in 2 halves by both buyers.
Sir we purchased property above 50 lakhs tds remitted one percent but buyers r two persons we received notice to deduct 20percent not 1 percent because sellers pan inoperative later seller pan link completed so what can i do to waive the notice

If some body takes 50 lakh loan and sales the property at 60 lakh ,has to return bank loan 50 lakh and gain only 10 lakh , how much TDS. He has to deposit now.
Taking loan is your personal matter, only purchasing value and selling value will be considered, I think..
Sir suppose property value Rs 50 lakh or more in this case transferor has received Rs 52 lakh (original flat price), transferee was not aware and was not instructed by the transferor properly. what will happen in such case to the transferee since such tax was not deducted by the purchaser? the said flat purchased having two person 50% sharing. now this amendment effect either retrospective or prospective?
It is not retrospective. Effective from 23rd July 2024.
