Great I got one important point that, we can file case against false case, defamation case in any place, where she or he can file case in resident's hometown court.
Sir Kindly advise
1: FIR is registered against husband and chargesheet is submitted by the police, Husband is not appeared before the police for the last more than a year.
2: Husband bail is dismissed by the session court .
3: Non bailable warrants are issued by the court
4: Look out notice is also issued by the MHA as husband resides out side India
5: Along with FIR wife has filed a case of Maintenance as well and husband has not appeared and summons has been sent via electronic mode - registered post and by dasti as well but are not acknowledged / received by the husband.
Query
A- What are the chances that Judge can give xparty decisions in maintenance case ?
B- Is wife can request for shelters rights in husbands house under maintenance case ?
C - Is wife can take stay on husband property?
D- Is Passport authority can impound the passport of husband ?
Please advise what other remedies a wife can take for her rights.

It has been seen that police out the name of accused as per his power. It is not necessary they are accused or not. Generally it has been seen that police out the accused name as per wish. Supreme Court has already say that 95 percent chargesheet filed false. So that there is no any hope of any relief after filing defamation suit.

This is about my brother married in 2012..after 3 year his wife started torturing him mentally, physically and financially...after 6 months he has filed divorce case in lower court .. judgement came and court given judicial sepration...since then both are living separatly...
My brother has challenged this decision in high court jabalpur for divorce....we don't know when the hearing will come..
Sir wife always says that she want to live with my brother meanwhile she lodge criminal against him...
Sir it seems like she neither want to live nor want to give divorce..

Sir how to know if other family members names are removed from the case. We have attended two hearings in 498A but magistrate told that as there is no cognizance taken so far, no case is made out so far. Can we check charge sheet whether the names have been removed or not?

Sir if relative name was not included by police in FIR after investigation in 2016 and wife filed 319 CrPC application in court in 2016 to include that relative's name as accused but court dismissed her 319 crpc application in 2017 & wife did not challenge that order. Can that relative file cases told by you now or its barred by limitation now?🙏
