Kidnapping (Section 359 to 369 IPC) is an offence in which a person is forcibly taken away or transported from one place to another without their consent. The intention behind the act is to cause harm or to put pressure on the person or their family for some unlawful purpose. Kidnapping is punishable under various sections of IPC depending on the circumstances of the case, including Section 363 (kidnapping) and Section 364 (kidnapping for ransom).
Abduction (Section 362 and 363 IPC) is an offence in which a person is taken away or detained against their will, but not necessarily by using force or by causing harm. The intention behind abduction may be to compel the person to marry, to force them to do something against their will, or for some other unlawful purpose. Abduction is punishable under Section 363 of IPC.
The punishment for both offences varies depending on the severity of the act and the circumstances involved. For example, kidnapping for ransom is punishable with life imprisonment or death penalty under Section 364A of IPC, while simple kidnapping is punishable with imprisonment for up to seven years and fine under Section 363 of IPC. Abduction is punishable with imprisonment for up to seven years and fine under Section 363 of IPC.
