    I had a detective who tried to con his way into my house 30 years ago. He said, I am here investigating break-ins in the neighborhood. BTW, Can I use your bathroom?” If he had found my joint in the bathroom, he could have arrested me by discovery. That is why you never let them inside your house. Talk to them outside.

      When I was renting and living with my brother it was a local property tax assessor who banged hard on the door. From the upstairs I talked to her
      She IDed herself as the tax assessor demanded entry and I said no
      She proceeded to say she would get the police. I said go ahead. I’m not the owner it’s my brother’s house and I’m not letting you in
      I knew it was a empty threat because in Michigan you do not have to let them inside your house
      She never came back

      I got into Jim Nichol’s house in Decker Michigan after stopping and chatting with him for 15 minutes
      I did ask him to use the bathroom I was surprised he agreed and I did
      The Federal surveillance was literally across the street and when I pulled out I could see they were recovering from just having passed out
      True story all of it

    If there was no crime permitted in your house, in order for a police officer to search your house….. they must have a court ordered warrant. Do not consent to a police officer to do a home investigation without a warrant. If you consent for a police officer to search or investigate your home, you are opening yourself up to trouble when there is no legal cause for it. They can find something against you and hold you accountable because you allowed an unauthorized search.

    Hi Mike, thank you for sharing your views on Canadian Law, i just subscribed as I want to learn more about Canadian law as I’m from Calgary. I am also a fan of the CZcams channel legal eagle which got me thinking of my own country’s laws. One situation came to mind with many of the issues occurring in the US these days. I was curious if Canada has similar laws to Qualified Immunity which shields police and other law enforcement officers from prosecution if they commit a act which violates a person’s rights like excessive force(like the young healthcare student in Vancouver), or willful damages to a person’s home through the execution of a warrant. Legal Eagle has a example where a fugitive took refuge in a person’s home in Colorado(Greenwood), the owners of the home were away shopping and the police were in hot pursuit of the suspect. They used a tactical team with tear gas and took out external walls and windows of the home in order to detain the suspect. After they finished and apprehended the suspect, the home was literally destroyed and the police and the city were found not liable for the damages as they were acting in the best interest of the city and the public in apprehending the suspect. I was wondering if we have something similar in Canada. This is purely a inquisitive request. Wishing you all the best and Happy Canada Day!!! 🇨🇦

    A few small corrections:
    1. Coming up to a home and knocking on the door isn't a "police tactic." Perhaps 20 years ago it was, but today if Police know that they need a warrant, they won't bother knocking and will just apply for the warrant as long as they have the reasonable grounds to do so.
    2. Exigent Circumstances aren't simply "people committing crimes inside their home" - exigent circumstances are in order to protect from bodily harm or destruction of evidence. For example, if police go up to a home (not pursuant to a 911 call) and the person inside is breaking their own things (but nobody is in danger), those would NOT be exigent circumstances and police will not enter. On the other hand, if police go up to a house pursuant to a 911 call and hear someone screaming inside, those ARE exigent circumstances.

      Nonsense, the reason they usually try to con their into your home, is when they know that the warrant would be refused by the judge but they still wanted to get in your home anyway. This is done a lot more often than the bring the warrant with them way.
      What police station you said you work out of again?

    Police pushed open my front door when I opened it to talk to them. I asked to talk outside they said no. I asked wouldn’t they need to show me a warrant they said no.
    They got a call about a male discharging a rifle in a trench coat on my front step. I don’t own either of those things. And I definitely wasn’t doing that. They tore my house apart and didn’t find either items. But took a legal Airsoft pistol out of my house and then left after threatening me with physical violence if I don’t admit it.

    If you are pulled over for a traffic violation, say running a stop sign, do the police have the right to search your vehicle?

      No, they do not. Running a stop sign is a traffic violation, not a criminal offence. Unless you did it with a criminal amount of speed, it involved dangerous driving or they suspect you of a DUI and you either fail or refuse a breathalyser.

    Yes to enter, the FBI, ATF and cops need warrants to enter homes even if the house isnt being lived in. Unless its a life or death situation. Unless your in canada then they can do what they want

    I live in Boca Raton Florida in the Riviera located on the island barrier across the street from the beach an officer entered my home and held a gun to my head without a warrant because the neighbor call the police because she said she heard a disturbance I was in my pajamas tried to force me off my own property I need a lawyer to sue them I would like to sue the city of Boca Raton they're well aware of what happened I did nothing to rectify the situation I called the state's attorney's office and the FBI about this

    You did not mention the "Plain View Doctrine" where if the Police see evidence of a crime in plain view (such as a prohibited weapon) they could enter your home to seize that evidence and charge you.
    Of course "Plain view" would mean not moving anything, perhaps observed through a window or upon opening the door etc. but it would be from where they are standing.
    I would also not recommend having illegal things such as prohibited weapons and other contraband laying around in plain view of the front of your house for that exact reason!

    Can bounty hunters enter your home without a search warrant they do have a warrant for a suspect

      Bounty hunting is illegal in Canada as it is not a recognized profession and is viewed as a form of vigilantism. In Canada, individuals are not permitted to apprehend or detain fugitives or suspects on their own, as such activity is viewed as an invasion of privacy and a breach of the criminal justice system.

    You should specify your talking about candian law I didn't see anything indicating that in the description or title and I don't think you mentioned anything about it until you mention the charter of rights.

      Also you know if there's peacefully entry in Canada? I see cop shows in Europe use that all the time to enter unlocked houses

    I had my front door window smashed and they reached in and unlocked, entered, arrested me for no crime , took me to jail overnite..then escorted me to my bank and forced me to withdraw 1200$ and give it to them😮 because i owed 1200$ in traffic tickets. True story😊 on a diff occasion..I was strip searched in the back of a cruiser in Burlington Ontario.. only seeing under my taint would satisfy them😮 true story😊
