- Conservative peer Lord Ed Vaizey talks about JK Rowling warning that Scotland’s new hate crime law is “wide open to abuse”.
The Harry Potter author, who has become a fierce critic of the Scottish Government’s stance on transgender rights, has been one of the highest profile critics of the legislation.
The Hate Crime and Public Order (Scotland) Act came into effect on Monday, consolidating existing hate crime legislation and creating a new offence of stirring up hatred against protected characteristics.
However, women have not been given protection under the law, with the Scottish Government instead promising to bring forward legislation to tackle misogyny.
Ed says: “She’s quite right to point out the flaws in this debate. The intolerance that is being generated by some aspects of the trans lobby is outrageous.”

A lot of places in America already have “family” or gender neutral bathrooms along with the traditional ones. It’s a one room bathroom which makes it much easier to go to with toddlers in tow. It’s more like a home bathroom.

It's not tricky at all. Biological men and boys use the male toilet, biological women and girls use the female toilet, those that are not sure or identify as something else use the unisex disabled toilet.

@@KernowFay Agreed, and disabled people would like to be able bodied but the reality is they can't be. I'm afraid people that transition need to be considered as disabled. They're not in any way denied a life as a woman, just that when it comes to shared spaces they have to use a different facility in the same way someone in a wheelchair would. There's far more disabled people out there than trans people, so its not exactly a hardship for them is it, and lets face it they've been forced to use facilities they don't identify as being appropriate to them till very recently.

To "transition" is of course a social concept, to live & dress (like a woman) as one can never actually transition into the opposite sex (even with surgery) which of course proves JK Rowling correct in her tweets 👍

If people want to live as if they’re the sex they’re not, that should be fine in settings where sex doesn’t matter, such as the majority of workplaces where being good at the job is what’s important, not what sex you are.
If we want to accommodate that in places where sex does matter (such as loos) we need three - male, female and other.
We have a precedent - disabled loos aren’t gender specific.
