Her mother was visiting and asked to stay at my house that I share with my husband and I said NO! Because I was protecting my husband. I told him NEVER to be anywhere in the house near that girl alone. We Need to protect our men and boys from these spoiled or mentally ill little manipulating girls/women.
That is a very wise decision. It does not take much to get a person arrested for child abuse and a lot to clear them of such charges. You are forward thinking in keeping the niece at a distance. Even a short holiday visit should not be allowed. I commend you!
If a victim testifies to all the elements of the offense and the jury believes that witness beyond a reasonable doubt, that is sufficient to convict a person with no other evidence. Example is sexual abuse of a child. Touching the breast or sexual organ of a child will not leave any evidence. If the child testifies and is believed beyond a reasonable doubt. That is sufficient.
My son is going through this. Matches EXACTLY what he's going through. Except her mother threatened to send her to her dad's because she couldn't control her. There are videos of my granddaughter actually using drugs on social media.

Unfortunately the system works that way. If the cops believe the other people, you could end up getting arrested. Then you will need a lawyer and so forth. I few years ago a client of mine was dating a lady and her 15 year old daughter told the cops he touched her breast. Two years and a jury trial later he was found not guilty, avoiding a conviction for sex assault of a child, several years in prison and 10 year registration as a sex offender. All on the word of one angry teenager.

You will need to get a good PI and try to catch the deputy in a lie. It also depends on the situation. Is the deputy falsifying evidence or intimidating witnesses?

That would be not even be enough for an arrest in my opinion. But you can be convicted without physical evidence. Most child sex abuse cases are "he said" "she said." Child says teacher touched her inappropriately. There would be no physical evidence in this case. But if the jury believes the child beyond a reasonable doubt, teacher can be convicted. I had a case a few years ago where the 15 year old daughter of my client's girlfriend said he touched her breast. He was arrested, had to bond out, hire a lawyer to defend him, and go to trial by jury where he was found not guilty. The only evidence was the girl's testimony.

I don't know enough of the circumstances to give you a good answer to that question. If it has been a long time the evidence might be skimpy. But she should look into it. There may be evidence that she is not considering. Also a baby being killed should have raised a lot of concerns with family members and the police. Your girlfriend should at least give it a try for her baby's sake.

and what if that one witness is a LYING deputy guilty of false swearing and NO ONE will enforce the law AGAINST him ?
