is painting someone's photography stealing?

artist's way week four had me taking a bit of a break from painting, which allowed me to explore other things and stop to smell the roses in life a little more. i was faced with a dilemma on ethics, Painting from Photos - Theft or Inspiration? Let me know your thoughts! :)

You raise some interesting points in this vlog! I think the intention of painting from a photograph is important. If you are using the photograph as a personal challenge and give credit to the artist I see nothing wrong with using the picture as inspiration. If you were to make an exact replication of the photo and sell the painting or prints of the painting I think that is different. With art (like creative writing) transparency is very important. I look forward to seeing what you do next.

right, i feel like painting an exact replication of the photograph hyper-realistically and selling it would be a lot like taking a photo of someone's painting and selling prints, which simply isn't fair. I LOVE the comparison you made with creative writing and citing your sources. I see painting someone's photograph as a sort of cover. Most people wouldn't say that making a cover of a song is stealing, it's your interpretation of that specific song.
But I see how it could be different in visual arts, where the final result is what matters whereas in music it's the performance that matters, how well you can sing or play.
But I still think that someone's photograph is still fair since (if you mention it of course) your are producing something by yourself.

i would have never noticed the similarity to music covers. that makes a lot of sense. thank you for your feedback. i agree that mentioning the photographer is important, and honestly makes the product more fascinating to look at, and see the difference and how the painter makes it their own :)

If you paint the artist's work in a different style or change the gender of the figure in the painting then it would be totally fine

Having the right to is irrelevant. A professional would want nothing to do with anyone else's aesthetic. Also professional artists are already dealing with glomming and other artists making hybrids of their work. If you want to make a living at this, get your own look at avoid using any other artist or photographer or movie...anything recognizable as source material. Unless you want to be a crappy pop-decor artist...if so do the opposite.

i appreciate your strong stance! i agree that it can be pop-decor if its too exact and not individualized enough, which is an important facet of creation especially in visual arts. i totally understand your point of view, and thank you for your feedback.

@@jenjencartridge Just remember, good art isn't as important as consistent repetitive slowly evolving art that doesn't look like anything else. Find a thing and hammer at it for decades and you'll do well.
